HomeMy WebLinkAbout85-121 - Resolutions RESOLUTION NO. 85-121 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, CONDITIONALLY APPROVING TENTATIVE TRACT MAP NO. 13062 AND DEVELOPMENT/DESIGN REVIEW 85-21 WHEREAS, Tentative Tract Map No. 13062, hereinafter "Map" submitted by Lincoln Property Company, applicant, for the purpose of subdividing the real property situated in the City of Rancho Cucamonga, County of San Bernardino, State of California, described as a residential subdivision for condominium purposes on 8.6 acres located on the north side of 19th Street, between Archibald and Amethyst Street into 1 lot, regularly came before the Planning Commission for public hearing and action on August 28, 1985; and WHEREAS, the City Planner has recommended approval of the Map subject to all conditions set forth in the Engineering and Planning Division's reports; and WHEREAS, the Planning Commission has read and considered the Engineering and Planning Division's reports and has considered other evidence presented at the public hearing. NOW, THEREFORE, the Planning Commission of the City of Rancho Cucamonga does resolve as follows: SECTION 1: The Planning Commission makes the following findings in regard to Tentative Tract No. 13062 and the Map thereof: (a) The tentative tract is consistent with the General Plan, Development Code, and specific plans; (b) The design or improvements of the tentative tract is consistent with the General Plan, Development Code, and specific plans; (c) The site is physically suitable for the type of development proposed; (d) The design of the subdivision is not likely to cause substantial environmental damage and avoidable injury to humans and wildlife or their habitat; (e) The tentative tract is not likely to cause serious public health problems; (f) The design of the tentative tract will not conflict with any easement acquired by the public at large, now of record, for access through or use of the property within the proposed subdivision. Resolution No. TT 13062/DR 85-21 Page 2 (g) That this project will not create adverse impacts on the environment and a Negative Declaration is issued. SECTION 2: Tentative Tract Map No. 13062 and Design Review 85-21, a copy of which is attached hereto, is hereby approved subject to all of the following conditions and the attached Standard Conditions: DESIGN REVIEW 1. Certain existing trees shall be preserved as shown in attached Exhibit "J". A tree removal permit shall be issued for the selective removal of the remaining trees. 2. A 6' decorative block wall shall be provided along the northern property and western property boundaries. 3. A sound barrier consisting of a minimum 5 foot wall or wall/berm combination shall be required along the northern property boundary adjacent to the freeway. Detailed plans shall be submitted to Planning Division for review and approval prior to issuance of building permits. In lieu of installing the 5-foot sound barrier at this time, a trust fund equivalent to the cost of this sound barrier shall be provided by the developer and entered into an agreement with the City to the satisfaction of the City Engineer. Such trust fund shall be used for future installation of a sound barrier as required at the time of construction of the Foothill Freeway. 4. The balconies on the second floor buildings within the noise impacted area shall sound attenuation walls sound attenuation surface. 5. A final acoustical report to provide mitigation measures for interior noise reduction in compliance with Title 25 standards (45 CNEL) shall be submitted to Planning Division for review and approval prior to issuance of building permits. 6. The exterior surface of the block wall along the western property boundary shall be upgraded to be compatible with other required decorative block wall . 7. All trees to be saved shall be enclosed by a chain link fence prior to the issuance of any grading or building permit and prior to commencement of work. Fences are to remain in place during all phases of construction and cannot be removed without the written consent of the City Planner until construction is complete. 8. Grading along 19th Street shall be contoured for an undulating appearance. Resolution No. TT 13062/DR 85-21 Page 3 TENTATIVE TRACT 1. The public sidewalk shall extend westerly from the west property line to the drive approach on the adjacent property. 2. Reciprocal access shall be provided along the east propery line for future development. 3. A„joint-use driveway along 19th Street shall be provided for future use by the development to the east. 4. A flood protection wall shall be provided along the northwest boundary of the site per the project drainage report the final design shall be approved by the City Engineer.
