HomeMy WebLinkAbout87-02 - Resolutions RESOLUTION NO. 87-02 A RESOLUTION OF THE RANCHO CUCAMONGA PLANNING COMMISSION APPROVING CONDITIONAL USE PERMIT NO. 86-26 FOR AN OFF- SITE MODEL HOMES SALES COMPLEX LOCATED AT THE NORTHWEST CORNER OF CHURCH STREET AND WHITNEY COURT IN THE LOW DENSITY RESIDENTIAL DISTRICT WHEREAS, on the 22and day of October, 1986, a complete application was filed by CITATION BUILDERS for review of the above-described project; and WHEREAS, on the 14th day of January, 1987, the Rancho Cucamonga Planning Commission held a public hearing to consider the above-described project. NOW, THEREFORE, the Rancho Cucamonga Planning Commission resolved as follows: SECTION 1: That the following findings can be met: 1. That the proposed use is in accord with the General Plan, the objectives of the Development Code, and the purposes of the district in which the site is located. 2. That the proposed use, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. 3. That the proposed use complies with each of the applicable provisions of the Development Code. 4. That the model home sales office is compatible with and sensitive to the immediate environment of the site and neighborhood, and that its location will not be detrimental to the health, safety or welfare, or result in any significant adverse impacts for any residents within the surrounding established neighborhood. 5. That the location of the model home sales office is adjacent to a primary circulation route (collector, secondary, or arterial ) so that any additional traffic generated as a result of this project will not have any significant impact for the surrounding development. To insure that any traffic impacts associated with the establishment of a model home sales office are minimized, it will be required that concurrent with any application for a Conditional PLANNING COMMISSION RESOLUTION NO. CUP 86-26 - CITATION Use Permit for an off-site model home sales office, that the applicant will also include a traffic study to be prepared by a certified traffic engineer detailing all potential traffic impacts expected to result from the project, and proposing any required mitigation measures that would be necessary to reduce any traffic impacts to the surrounding established neighborhood. 6. That sufficient on-site, off-street parking is available so that any additional parking demand generated as a result of this project would not have any significant adverse impacts for the surrounding development 7. That the individual elements of the model homes sales office, i .e., lighting, signing, fencing, hours of operation, are designed in a collective, coordinated manner to ensure a safe, secure, and aesthetic environment, sensitive to and compatible with the surrounding development. 8. That the model home sales office is to be of a temporary, short-term nature; short term is defined as having a life expectancy not to exceed two years. SECTION 2: That this project will not create adverse impacts on the environment and that a Negative Declaration is issued on January 14, 1987. SECTION 3: That Conditional Use Permit No. 86-26 is approved subject to the following conditions: 1. An off-site parking lot containing eight spaces shall be provided within the confines of the model home complex prior to the issuance of building permits for any residence on Lots 1-10. 2. If on-site lighting is to be provided, a detailed lighting plan shall be submitted for review and approval of the City Planner within 30 days. The lighting shall be installed within 60 days from the date of the approved plan. 3. The hours of operation for the model home complex shall be limited from 10:00 a.m. to 6:00 p.m. daily. PLANNING COMMISSION RESOLUTION NO. CUP 86-26 - CITATION 4. The Conditional Use Permit shall expire on January 16, 1988. Any requests for extension of this Conditional Use Permit beyond the two years would require the application of a new Conditional Use Permit. Irrespective of the above, any model home sales office in existence as a combination of as first an on-site use, than as an off-site use, shall be in existence an aggregate total time not to exceed three years.
