RESOLUTION NO. 87-03
A RESOLUTION OF THE RANCHO CUCAMONGA PLANNING COMMISSION
APPROVING VARIANCE NO. 86-07 TO BARBARA ANN MOBERG
LOCATED 7201 ARCHIBALD #11 IN THE NEIGHBORHOOD COMMERCIAL
DISTRICT
WHEREAS, on the 1st day of October, 1986, an application was filed
and accepted on the above-described project; and
WHEREAS, on the 14th day of January, 1987, the Planning Commission
held a duly advertised public hearing pursuant to Section 65854 of the
California Government Code.
SECTION 1: The Rancho Cucamonga Planning Commission has made the
following findings:
1. The center has existing outdoor plaza areas that encourage
pedestrian traffic to the center. The center is adjacent to
Medium and Medium High density projects and provisions for
pedestrian connections are provided to the center from these
projects.
2. That a frozen yogurt shop is extraordinary from a typical
restaurant in that it has a limited single item menu.
3. That a frozen yogurt shop is extarordinary from a typical retail
food outlet in that much of its business is derived from
spillover from adjacent businesses.
4. That a condition of limited seating would regulate the number of
patrons in the shop at any one time.
5. That strict or literal interpretation and enforcement of the
specified regulation would result in practical difficulty
inconsistent with the objectives of the Development Code.
6. That a combination of the aforementioned findings support the
granting of a Variance that will not constitute a special
privilege over other properties in the same district.
7. That the granting of the Variance will not be detrimental to the
public, health, safety, or welfare, or materially injurious to
properties or improvements in the vicinity.
CONDITIONS:
1. The menu shall be restricted to frozen yogurt, beverages,
assorted yogurt toppings, cookies, brownies, frozen yogurt pies,
waffle cones, and frozen yogurt on waffles.
2. The maximum number of seating at tables and/or counters shall be
limited to twelve (12) .

I, Brad Buller, Deputy Secretary of the Planning Commission of the City of
Rancho Cucamonga, do hereby certify that the foregoing Resolution was duly and
regularly introduced, passed, and adopted by the Planning Commission of the
City of Rancho Cucamonga, at a regular meeting of the Planning Commission held
on the 14th day of January, 1987, by the following vote-to-wit:
