HomeMy WebLinkAbout87-15 - Resolutions RESOLUTION NO. 87-15 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, CONDITIONALLY APPROVING TENTATIVE TRACT MAP NO. 12870. WHEREAS, Tentative Tract Map No. 12870, hereinafter "Map" submitted by Tony Mize, applicant, for the purpose of subdividing the real property situated in the City of Rancho Cucamonga, County of San Bernardino, State of California, described as a residential subdivision of 67 residential custom lots and one remainder parcel on 66.9 acres of land in the Very Low Residential District (less than 2 dwelling units/acre) located on the north side of Highland Avenue between Etiwanda and East Avenues - APN: 255-181-11, 12, 13, 19, 20, 21, and 30 and Tree Removal Permit 87-02 to remove two (2) east-west Eucalyptus windrows and (1) north-south Eucalyptus windrow, into 68 lots, regularly came before the Planning Commission for public hearing and action on January 28, 1987; and WHEREAS, the City Planner has recommended approval of the Map and Tree Removal Permit subject to all conditions set forth in the Engineering and Planning Division's reports; and WHEREAS, the Planning Commission has read and considered the Engineering and Planning Division's reports and has considered other evidence presented at the public hearing. NOW, THEREFORE, the Planning Commission of the City of Rancho Cucamonga does resolve as follows: SECTION 1: The Planning Commission makes the following findings in regard to Tentative Tract No. 12870 and the Map thereof: (a) The tentative tract is consistent with the General Plan, Development Code, and specific plans; (b) The design or improvements of the tentative tract is consistent with the General Plan, Development Code, and specific plans; (c) The site is physically suitable for the type of development proposed; (d) The design of the subdivision is not likely to cause substantial environmental damage and avoidable injury to humans and wildlife or their habitat; (e) The tentative tract is not likely to cause serious public health problems; PLANNING COMMISSION RESOLUTION NO. : TENTATIVE TRACT 12870 January 28, 1987 Page 2 (f) The design of the tentative tract will not conflict with any easement acquired by the public at large, now of record, for access through or use of the property within the proposed subdivision. (g) That this project will not create adverse impacts on the environment and a Negative Declaration is issued. SECTION 2: Tentative Tract Map No. 12870, a copy of which is attached hereto, and Tree Removal Permit 87-02 are hereby approved subject to all of the following conditions and the attached Standard Conditions: PLANNING DIVISION: 1. Applicant shall submit final landscaping and irrigation plans showing details for neighborhood entry statement, street trees, community trails entry details, parkway landscaping (Etiwanda Avenue) to Design Review, prior to map recordation. 2. Tree replacement plan shall be submitted to the City Planner for review and approval , in accordance with the Etiwanda Specific Plan requirements, showing Eucalyptus windrows consisting of Eucalyptus Malculatta (15 gallon) 8 feet on center, planted where windrows are scheduled for removal , prior to issuance of a grading permit. 3. Equestrian Trails Plan and details shall be submitted to the Equestrian Trails Committee for review and approval prior to final map recordation. 4. Lot 28 shall access on north side of Street "B", lot 50 shall access on south side of Street "B", lot 58 shall access on north side of Street "C", lot 9 shall access on south side of Street "A". 5. Existing Eucalyptus windrows to remain on project site shall be protected during grading and public improvements activities by erecting a six-foot high chain link fence. Fence shall not be removed without written permission from the City Planner or public improvements acceptance by the City. 6. In accordance with the acoustical study, a combination 5 foot earthern berm/ landscaping shall be required along project side of Etiwanda Avenue and a 7 foot high decorative masonry wall shall be required at the top of slope along the south tract boundary. Details shall be submitted to the Design Review Committee for review and approval , prior to final map recordation. 7. An acoustical study shall be required providing mitigation measures for interior noise reduction to 45 CNEL at Design Review for subject tract. 8. North/south trail between lots_ and 10 shall terminate at lot 9 and prove a required access to lot . PLANNING COMMISSION RESOLUTION NO. TENTATIVE TRACT 12870 January 28, 1987 Page 3 9. East/west trail between lots 51, 56, and 57 shall terminate at lot 58 and provide required access to lot 58. North/south trail between lots 51, 53, and 54 shall terminate at lots 55/56 and provide required access to lots 55/56. 10. North/south trail between lots 51 and 52 shall proceed across Street "A" with trail easement being provided between lots 26 and 27. 11. Equestrian Trails Plan showing revised trail alignments, ramps and gate details, and fencing details are to be submitted to the Equestrian Trails Committee for review and approval prior to tract recordation. ENGINEERING DIVISION: 1. EXISTING OVERHEAD UTILITIES: a. Etiwanda Avenue - The existing overhead utilities (telecommunications and electrical ) on the project side of Etiwanda Avenue shall be undergrounded from the first pole south of Highland Avenue to the first pole north of the project' s north boundary, prior to public improvement acceptance or occupancy, whichever occurs first. Reimbursement of one-half the adopted cost of undergrounding from future development as it occurs on the opposite side of the street is feasible, because the property is presently undeveloped. b. Highland Avenue - An in-lieu fee as contribution to the future undergrounding of the existing overhead utilities (telecommunication and electrical ) on the north side of Highland Avenue shall be paid to the City prior to occupancy or final inspections, whichever occurs last. The fee shall be one-half the adopted unit amount times the length from the center of Etiwanda Avenue to the east tract boundary. c. Remainder Parcel - An in-lieu fee as contribution to the future undergrounding of the existing overhead utilities (telecommunication and electrical ) on the north side of Highland Avenue and the east side of East Avenue shall be paid to the City prior to occupancy or final inspection, whichever occurs last. The fee shall be one-half the adopted unit times the length of the south and east boundaries plus one-half the total width of East Avenue. 2. Victoria Basin shall be excavated and permits obtained as required by the Flood Control District and City Engineer. 3. In the event that the Tract is not protected from drainage from the north by other development, measures shall be provided to protect the Tract from such drainage as approved by the City Engineer. 4. Dedication shall be made of sufficient right-of-way for the future construction of Master Plan Storm Drain Line NQ. 2-1 along the Tract' s south ounary boundary approved by Caltrans and the City Engineer. The right-of-way for the future Freeway along the Tract's south boundary shall be reserved as required by Caltrans and the City Engineer. 6. Rock curb per City Standard No. 307 shall be provided along Etiwanda Avenue. 7. Intersection drains shall be provided at the intersections of "C" and "D" Streets with "A" Street or as otherwise approved by the City Engineer. 8. The portions of Master Plan Storm Drain Line Nos. 2-1 and 2-2 shall be constructed from Victoria Basin to the Tract. The developer shall be eligible for reimbursement of the cost of construction in accordance with City Ordinance No. 75. 9. The developer shall bear all costs incurred (including condemnation proceedings) in the acquisition of the off-site right-of-way required for Storm Drain Line Nos. 2-1 and 2-2, if it is not acquired by some others means prior to recordation of the final map. An agreement to this effect between the developer and the City shall be executed prior to recordation of the final map. 10. Standard drainage acreage fees shall be paid prior to recordation of the final map if Storm Drain Line Nos. 2-1 and 2-2 are constructed by others. 11. The temporary drainage swale within the right-of-way for the future Master Plan Channel along the south tract boundary shall be designed and constructed as approved by the City Engineer.
