HomeMy WebLinkAbout87-31 - Resolutions { RESOLUTION NO. 87-31 A RESOLUTION OF THE RANCHO CUCAMONGA PLANNING COMMISSION RECOMMENDING DENIAL OF TERRA VISTA PLANNED COMMUNITY AMENDMENT 86-02, TO MODIFY THE COMMUNITY PLANNED TEXT BY ESTABLISHING A BUSINESS PARK OVERLAY ZONE FOR AREAS DESIGNATED AS OFFICE PARK DISTRICT, COMMERCIAL DISTRICT AND MIXED USE DISTRICT WITHIN THE PLANNED COMMUNITY BOUNDARY. A. RECITALS (i ) WHEREAS, Western Properties has filed an application for the approval of a Terra Vista Planned Community Amendment 86-02, described above in the title of this Resolution. (ii ) WHEREAS, on October 8, 1986, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the proposed amendment and, at the request of the applicant, said hearing was continued. The applicant on November 5, 1986 submitted the first revision to the proposed amendment for Planning Commission review. At the continued November 11, 1986 meeting, the Planning Commission continued the hearing at the request of staff, to allow sufficient time to review the proposed revision to the amendment. Thereafter, on December 10, 1986 and February 11, 1987, the Planning Commission again held public hearings on the proposed amendment where on each such date, it was continued at the request of the applicant. On February 10, 1987, the applicant submitted the second revision to the proposed amendment for Planning Commission review. (iii ) WHEREAS, at the continued meeting of February 25, 1987, the Planning Commission held a public hearing to consider the subject matter of the proposed amendment and directed staff to prepare a resolution recommending denial for their review at the March 25, 1987 regular Planning Commission meeting under a Consent Calendar Item. (iv) WHEREAS, all legal prerequisites to the adoption of this Resolution of have occurred. B. RESOLUTION NOW, THEREFORE, it is found, determined and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all the facts set forth in the Recitals, Part A, of this Resolution are true and correct. PLANNING COMMISSION RESOLUTION NO. Based upon substantial evidence presented to this Commission during the above referenced October 8, 1986, November 12, 1986, December 10, 1986, February 11, 1987 and February 25, 1987 public hearings, including written staff reports, this Commission hereby specifically finds as follows: a. The proposed amendment, by adding custom manufacturing industrial type of land uses, substantially alters the present planned land use of the Terra Vista Planned Community and the General Plan. b. The proposed amendment would conflict with the objectives and policies of the General Plan, Industrial Specific Plan and the Terra Vista Community Plan. c. The proposed amendment, in adding custom manufacturing industrial uses within the residentially planned community, could have a significant impact on the environment by exposing people to an increase in traffic hazard since truck traffic would increase substantially; and, expose people to an increase in health, safety and nuisance factor such as noise and odor. 3. Based upon the substantial evidence presented to this Commission during the above referenced public hearings and upon the specific findings of facts set forth in Paragraphs 1 and 2 above, this Commission hereby finds and concludes as follows: a. The amendment is in conflict with the land use policy of the General Plan. b. The amendment does not promote the goals of the land use element. c. The amendment would be materially injurious or detrimental to adjacent properties. 4. Pursuant to Section 65850 to 65855 of the California Government Code, the Planning Commission of the City of Rancho Cucamonga hereby recommends denial of Terra Vista Planned Community Amendment 86-02. 5. The deputy secretary to this Commission shall certify to the adoption of the Resolution. PLANNING COMMISSION RESOLUTION NO.
