HomeMy WebLinkAbout87-139 - Resolutions RESOLUTION NO. 87- 139 A RESOLUTION OF THE RANCHO CUCAMONGA PLANNING COMMISSION APPROVING VARIANCE NO. 87-09 TO ALLOW REDUCING THE AVERAGE LANDSCAPE SETBACK FROM 35 FEET TO 18 FEET ALONG BAKER STREET AND FROM 35 TO 13 FEET ALONG BOWEN STREET, LOCATED AT THE NORTHWEST CORNER OF BOWEN STREET AND BAKER AVENUE, IN THE LOW RESIDENTIAL DISTRICT - APN: 207-531- 31 AND 50. A. Recitals. (i ) Irving Hammer has filed an application for the issuance of the Variance, No. 87-09, as described in the title of this Resolution. Herein- after in this Resolution, the subject Variance request is referred to as "the application". (ii ) On the 12th day of August, 1987, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. (iii ) All legal prerequisites to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission during the above-referenced public hearing on August 12, 1987, including written and oral staff reports, together with public testimony, this Commission hereby specifically finds as follows: (a) The application applies to a 1. 1 acre parcel in the Low Residential District (2-4 dwelling units per acre), located at the northwest corner of Bowen Street and Baker Avenue. (b) The properties to the north, south and west of the subject site are presently designated for residential uses are currently developed with an elementary school to the north and with single family dwellings to the south and west. The property to the east of the subject site is designated for industrial uses and is currently developed with single family dwellings. (c) The application has been submitted to allow the reduction of the average landscape setback to 18 feet along Baker Street and to 13 feet along Bowen Street contrary to the requirements of Section 17.10.040 of the Rancho Cucamonga Development Code requiring an average landscape setback of 35 feet. VA 87-09 - Hammer August 12, 1987 Page 2 (d) The variance as specified in the application will not contradict the goals or objectives of the Rancho Cucamonga General Plan or Development Code and will not promote a detrimental condition to the persons or property in the immediate vicinity of the subject site for the reasons as follows: (i ) The 35 foot average landscape setback can be achieved by providing parking at the rear (west) of the site. This would, however, result in the removal of several mature trees, considered "heritage trees" by the City. (ii ) The 35 foot average landscape setback can be achieved by along Baker and Bowen Street. This would, however, result in a substandard drive aisle providing an unsafe situation to the public safety in the event of the need for emergency vehicle access. (iii ) The property has unique physical limitations ("heritage trees", existing structures) that are not typically found under similar zoning classifications. (e) The granting of the subject variance will not be detrimental to the public health, safety or welfare, or materially injurious to properties of improvements in the vicinity. 3. Based upon the substantial evidence presented to this Commission during the above-referenced public hearing and upon the specific findings of facts set forth in paragraph 1 and 2 above, this Commission hereby finds and concludes as follows: (a) Approval of Variance 87-09 shall be contingent upon approval of conditional Use Permit 87-22. (b) All applicable conditions in the Resolution of approval for Conditional Use Permit 87-22 shall apply. APPROVED AND ADOPTED THIS 12TH DAY OF AUGUST, 1987.
