HomeMy WebLinkAbout87-150 - Resolutions RESOLUTION NO. 87-150 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA APPROVING TENTATIVE TRACT MAP NO. 13644, LOCATED AT SOUTHEAST CORNER OF HERMOSA AVENUE AND VISTA GROVE STREET IN THE VERY LOW RESIDENTIAL DISTRICT - APN 201-101-06, 08, 11, 28 AND 29 A. Recitals. (i ) Nordic Development has filed an application for the approval of Tentative Tract Map No. 13644 as described in the title of this Resolution. Hereinafter in this Resolution, the subject Tentative Tract Map request is referred to as "the application". (ii ) On August 26, 1987, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. (iii ) All legal prerequisites to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission during the above-referenced public hearing on August 26, 1987, including written and oral staff reports, together with public testimony, this Commission hereby specifically finds as follows: (a) The application applies to property located at the southeast corner of Hermosa Avenue and Vista Grove Street with a street frontage of 330 feet and lot depth of 1287 feet and is presently improved with a single family residence and a chicken ranch; and (b) The property to the north of the subject site is zoned for residential uses and developed with single family residences, the property to the south is zoned for residential uses and development with a chicken ranch, the property to the east is zoned for residential uses and is vacant, and the property to the west is zoned for residential uses and developed with single family residences and a chicken ranch. 3. Based upon the substantial evidence presented to this Commission during the above-referenced public hearing and upon the specific findings of facts set forth in paragraph 1 and 2 above, this Commission hereby finds and concludes as follows: PLANNING COMMISSION RESOLUTION NO. TT 13644 - NORDIC August 26, 1987 Page 2 (a) That tentative tract is consistent with the General Plan, Development Code, and specific plans; and (b) The design or improvements of the tentative tract is consistent with the General Plan, Development Code, and specific plans; and (c) The site is physically suitable for the type of development proposed; and (d) The design of the subdivision is likely to cause substantial environmental damage and avoidable injury to humans and wildlife or their habitat; and (e) The tentative tract is likely to cause serious public health problems; and (f) The design of the tentative tract will conflict with any easement acquired by the public at large, now of record, for access through or use of the property within the proposed subdivision. 4. This Commission hereby finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and, further, this Commission hereby issues a Negative Declaration. 5. Based upon the findings and conclusions set forth in paragraph 1, 2 and 3 above, this Commission hereby approves the application subject to each and every condition set forth below and in the attached Standard Conditions attached hereto and incorporated herein by this reference. (a) Planning Division: i. Eucalyptus Maculata shall be planted at eight (8) feet on center along Hermosa Avenue to replace the window being removed. A deep watering system shall be provided to property irrigate the trees. The location of the trees and method of irrigation shall be shown on the final landscape plan which shall be reviewed and approved by the City Planner prior to the issuance of building permits. ii . Architectural detailing used on the front elevation shall be used on the house side of the garage. The revised plans shall be reviewed and approved by the City Planner prior to the issuance of building permits. PLANNING COMMISSION RESOLUTION NO. TT 13644 - NORDIC August 26, 1987 Page 3 iii . Architectural detailing used on the front elevation shall wrap around and extend down the side elevations. The revised plans shall be reviewed and approved by the City Planner prior to the issuance of building permits. iv. More extensive use of brick shall be used on the front elevation of Plan 2650B. The revised plans shall be reviewed and approved by the City Planner prior to the issuance of building permits. v. A temporary emergency access shall be provided on the east side of Lots 5 and 6 or another location approved by the City Planner and the Foothill Fire District. The emergency access shall be fully constructed to the satisfaction of the Foothill Fire District prior to final occupancy of Lots 17-24. vi . Corner side yard walls (decorative block) shall be provided on all corner lots. The design and location of the walls shall be shown on the final landscape plan which is subject to review and approval by the City Planner prior to the issuance of building permits. vii . Window trim detail shall be provided around all windows. viii . The placement of Plan 1850 on Lot 11 shall be reversed to avoid visibility into the garage from Hermosa Avenue. The revised site plan shall be reviewed and approved by the City Planner prior to the issuance of building permits. ix. A twelve (12) foot dedicated community equestrian trail shall be provided on the east side of Hermosa Avenue. The design and landscaping shall be consistent with the tract to the north. The revised tract map shall be reviewed and approved by the City Planner prior to recordation. x. A twelve (12) foot local equestrian trail shall be provided along the south tract boundary. The revised tract map shall be reviewed and approved by the City Planner prior to recordation. xi . A twelve (12) foot clear, unobstructed local equestrian trail shall be provided along the east tract boundary. The trail shall be located on the west side of the existing Eucalyptus windrow. xii . The windrows within the site, with the exception of the windrow along Vista Grove, shall be removed and replaced with 15 gallon Eucalyptus Maculata at eight (8) feet on center. The location of replacement trees shall be shown on the final landscape plan which is subject to review and issuance by the City Planner prior to the ssuance of building permits. The Alta Loma Basin, located to the south of the site shall be excavated to provide sufficient storm water retention to off-set the increase runoff generated by the development or an in-lieu fee shall be paid to the City prior to recordation of the Final Map. ii . The existing overhead utilities (telecommunication and electrical ) on the project side of Hermosa Avenue shall be undergrounded from the first pole on the north side of Vista Grove Street to the first pole off-site south of the project's south boundary, prior to public improvement acceptance or occupancy, whichever occurs first. Reimbursement of one-half the City adopted cost for undergrounding from future development as it occurs on the opposite side of the street is feasible because the property is undeveloped. iii . A portion of the Master Plan Storm Drain shall be constructed in Vista Grove Street from the westerly side of Hermosa Avenue to the easterly property boundary. Credit from the drainage fees shall be applied towards construction of this storm drain line in Vista Grove Street. iv. Vista Grove Street shall be constructed full width from Hermosa Avenue to the easterly property boundary to the satisfaction of the City Engineer. 6.
