HomeMy WebLinkAbout87-165 - Resolutions RESOLUTION NO. 87-165 A RESOLUTION OF THE RANCHO CUCAMONGA PLANNING COMMISSION APPROVING DESIGN REVIEW FOR TRACT NO. 12659 LOCATED AT THE SOUTHWEST CORNER OF ETIWANDA AVENUE AND 24TH STREET IN THE VERY LOW RESIDENTIAL DISTRICT - APN: 225-011-35. A. Recitals. (i ) Security Management has filed an application for the Design Review of Tract No. 12659 as described in the title of this Resolution. Hereinafter, the subject Design Review request is referred to as "the application". (ii ) On September 9, 1987, the Planning Commission of the City of Rancho Cucamonga held a meeting to consider the application. (iii ) All legal prerequisites to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission during the above-referenced meeting on September 9, 1987, including written and oral staff reports, this Commission hereby specifically finds as follows: a. That the proposed project is consistent with the objectives of the General Plan; and b. That the proposed design is in accord with the objective of the Development Code and the purposes of the district in which the site is located; and c. That the proposed design is in compliance with each of the applicable provisions of the Development Code; and d. That the proposed design, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. Based upon the findings and conclusions set forth in paragraph 1 and 2 above, this Commission hereby approves the application subject to each and every condition set forth below and in the attached Standard Conditions attached hereto and incorporated herein by this reference. a. Planning Division i . All applicable conditions of Resolution 85-168 shall apply. ii . The site plan shall be revised to provide a minimum front yard setback of 20 feet with a tract average front yard setback of 30 feet. The revised plans shall be reviewed and approved by the City Planner prior to the issuance of building permits. iii . Window trim shall be required on those elevations that need additional relief as determined by the City Planner. The plans shall be reviewed prior to the issuance of building permits. iv. Decorative block walls shall be required on all corner side yards. The design and location of the wall shall be shown on the final landscape plans which is subject to review and approval by the City Planner prior to the issuance of building permits. v. Plans 3 and 5 shall be designed to incorporate a usuable porch area. The final designs shall be reviewed and approved by the City Planner prior to the issuance of building permits. b. Engineering Division i . The existing overhead utilities (telecommunications and electrical ) on the project (south) side of 24th Street shall be undergrounded from the first pole on the west side of the northerly projection of future Hanley Avenue to the first pole on the east side of Etiwanda Avenue, prior to public improvement acceptance or occupancy, whichever occurs first. Reimbursement of one-half the City adopted cost for undergrounding from future development as it occurs on the opposite (north) side of the street is not feasible because the property is in the County. An in-lieu fee as contribution to the future undergrounding of the existing overhead utilities (telecommunications and electrical ) on the opposite (east) side of Etiwanda Avenue shall be paid to the City prior to approval of the Final Map. The fee shall be one-half the City adopted unit amount times the length from the south project boundary to the terminus of the lines near the north project boundary. 4. The Deputy Secretary to this Commission shall certify to the adoption of this Resolution. APPROVED AND ADOPTED THIS 9TH DAY OF SEPTEMBER, 1987.
