HomeMy WebLinkAbout87-180 - Resolutions RESOLUTION NO. 87-180 A RESOLUTION OF THE RANCHO CUCAMONGA PLANNING COMMISSION APPROVING A TIME EXTENSION FOR TENTATIVE PARCEL MAP NO. 8578. (APN 229-111-23) I . Recitals. ( i ) Santa Fe Development Company has filed an application for the extension of Parcel Map No. 85/8 as described in the title of this Resolution. Hereinafter in this Resolution, the subject Time Extension request is referred to as "the application". (ii) On October 24, 1984 this Commission adopted its Resolution No. 84-122, thereby approving, subject to specific conditions and time limits, Parceap No. 8578. (iii ) All legal prerequisites to the adoption of this Resolution have occurred. II . Resolution. NOW, THEREFORE, it is hereby found, determined and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: A. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part I, of this Resolution are true and correct. B. Based upon substantial evidence presented to this Commission, including written and oral staff reports, this Commission hereby specifically finds as follows: 1.The extention of the Tentative Map is not likely to cause public health and safety problems; and 2.The extension is within the time limits prescribed by state law and local ordinance; and 3.That strict enforcement of the conditions of approval regarding expiration would not be consistent with the intent of the Development Code. C. Resolution No. 84-122 is hereby modified to add, under the section entitled "General Requirements and Approvals", the following condition: RESOLUTION PAGE 2 15. Existing Overhead Utilities (a) Arrow Route - The existing overhead utilities (electrical and telecommunications) on the project side of Arrow Route shall be undergrounded from the first pole offsite east of the project east boundary to the first pole offsite west of the project west boundary, prior to public improvement acceptance or occupancy, whichever occurs first. The Developer may request a reimbursement agreement to recover one-half the City adopted cost for undergrounding from the future development (redevelopment) as it occurs on the opposite side of the street. (b) Communication lines within the A.T. & S.F. Railroad right of way - An in-lieu fee as contribution to the future undergrounding of the existing overhead Railroad Communication lines shall be paid to the City prior to final approval of the parcel map. The fee shall be one- half the City adopted unit amount times the length of the project frontage. (c) Communication lines for 66 K.V. electrical - An in-lieu fee as contribution to the future undergrounding of the existing overhead utilities (communications for 66 K.V. electrical ) located within a Southern California Edison Easement south of the south boundary line of the project shall be paid prior to final approval of the parcel map. The fee shall be one-half the City adopted unit amount times the length of the project frontage. D. Based upon the findings, conclusions and modifications set forth in paragraphs A, B and C above, this Commission hereby grants a Time Extention for: Parcel Map Applicant Expiration 8576 Santa Fe Development Co.
