HomeMy WebLinkAbout87-213 - Resolutions RESOLUTION NO. 87-213 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, CONDITIONALLY APPROVING TENTATIVE PARCEL MAP NUMBER 10972 WHEREAS, Tentative Parcel Map Number 10972, submitted by Ahmanson Development, Incorporated, applicant, for the purpose of subdividing into 3 parcels, the real property situated in the City of Rancho Cucamonga, County of San Bernardino, State of California, identified as APN(s) 201-271-55, located at the southwest corner of Milliken Avenue and Banyan Street; and WHEREAS, on December 9, 1987, the Planning Commission held a duly advertised public hearing for the above-described map. NOW, THEREFORE, THE RANCHO CUCAMONGA PLANNING COMMISSION RESOLVED AS FOLLOWS: SECTION 1: That the following findings have been made: 1. That the map is consistent with the General Plan. 2. That the improvement of the proposed subdivision is consistent with the G#neral Plan. 3. That the site is physically suitable for the proposed development. 4. That the proposed subdivision and improvements will not cause substantial environmental damage, public health problems or have adverse affects on abutting property. SECTION 2: This Commission finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and, further, this Commission hereby issues a Negative Declaration. SECTION 3: That Tentative Parcel Map No. 10972 is hereby approved subject to the attached Standard Conditions and the following Special Conditions: Special Conditions 1. The following items shall be completed upon development of either Parcel 2 or 3: a. Milliken Avenue from Highland Avenue to Banyan Avenue, b. Banyan Avenue from Milliken Avenue to the east side of Deer Creek Channel . RESOLUTION TENTATIVE PARCEL MAP 10972 DECEMBER 9, 1987 PAGE 2 c. Street "A" from Banyan Avenue to Milliken Avenue, d. The offsite parkway improvements for the above streets may be delayed until development of the adjacent property, e. The entire storm drain system from Deer Creek Channel to and including the interium debris basin on the north side of Banyan Avenue, f. The undergrounding of the utilities along Highland Avenue, and g. Provide a drainage easement along the north side of Highland Avenue as determined by the City Engineer prior to Final Map approval . 2. Drainage control devices such as paved ditches, A.C. berms or curbs shall be installed along the north side of Banyan Stret as approved by the City Engineer. 3. Banyan Street shall be constructed to City half-street standards with a minimum of 26' wide pavement within a minimum 40' wide dedicated right-of- way. 4. The existing overhead utilities (telecommunication and electrical ) on the project side of Highland Avenue shall be undergrounded from the first pole on the east side of Milliken Avenue to the first pole offsite west of Deer Creek Channel prior to public improvement acceptance or occupancy of any buildings, whichever occurs first. The Developer may request a reimbursement agreement to recover one-half the City adopted costs for undergrounding from future development (redevelopment) as it occurs on the opposite side of the street. 5. The Developer shall form a separate assessment district for the maintenance of the interim debris basin unless the San Bernardino County Flood Contol District agrees to assume the maintenance. The basin and assessment district can be removed in the future when alternate facilities are provided. 6. The Developer shall construct the bridge over Deer Creek Channel for Banyan Avenue to the satisfaction of the City Engineer. The Developer shall receive credit and a reimbursement from the Systems Development Fee if approved by the City Council . If not approved by the City Council , this condition shall be waived. 7. Additional dedication for the access ramps to the San Bernardino County Flood Control Channel at Banyan Avenue and the bridge crossing shall be required to the satisfaction of the City Engineer and San Bernardino County Flood Control District.
