A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO CUCAMONGA APPROVING TENTATIVE TRACT MAP NO. 13359,
A RESIDENTIAL SUBDIVISION OF 6 SINGLE FAMILY LOTS ON 3.79
ACRES OF LAND IN THE VERY LOW RESIDENTIAL DISTRICT,
LOCATED ON THE EAST SIDE OF SAPPHIRE STREET, SOUTH OF
HILLSIDE ROAD - APN: 1061-691-09, 10 and 11.
A. Recitals.
(i ) Arlan Walton has filed an application for the approval of
Tentative Tract Map No. 13359 as described in the title of this Resolution.
Hereinafter in this Resolution, the subject Tentative Tract Map request is
referred to as "the application".
(ii ) On the 27th of January, 1988, the Planning Commission of the
City of Rancho Cucamonga conducted a duly noticed public hearing on the
application and concluded said hearing on that date.
(iii ) All legal prerequisites to the adoption of this Resolution
have occurred.
B. Resolution.
NOW, THEREFORE, it is hereby found, determined and resolved by the
Planning Commission of the City of Rancho Cucamonga as follows:
1. This Commission hereby specifically finds that all of the facts
set forth in the Recitals, Part A, of this Resolution are true and correct.
2. Based upon substantial evidence presented to this Commission
during the above-referenced public hearing on January 27, 1988, including
written and oral staff reports, together with public testimony, this
Commission hereby specifically finds as follows:
(a) The application applies to property located on the east
side of Sapphire Street, south of Hillside Road with a street frontage of 40
feet and lot depth of 665 feet and is presently vacant; and
(b) The property to the north, south, east and west is zoned
for residential uses. The property to the north is presently vacant. The
property to the south and west is developed with single family residences.
The property to the east is developed with an elementary school ; and
(c) The proposal is in compliance with the Master Plan of
Trails and the objectives of the Equestrian Overlay District; and
(d) The development of 6 single family lots on 3.79 acres of
land is consistent with the Very Low Residential land use designation of the
General Plan.

3. Based upon the substantial evidence presented to this Commission
during the above-referenced public hearing and upon the specific findings of
facts set forth in paragraph 1 and 2 above, this Commission hereby finds and
concludes as follows:
(a) That tentative tract is consistent with the
General Plan, Development Code, and specific
plans; and
(b) The design or improvements of the tentative
tract is consistent with the General Plan,
Development Code, and specific plans; and
(c) The site is physically suitable for the type of
development proposed; and
(d) The design of the subdivision is not likely to
cause substantial environmental damage and
avoidable injury to humans and wildlife or
their habitat; and
(e) The tentative tract is not likely to cause
serious public health problems; and
(f) The design of the tentative tract will not
conflict with any easement acquired by the
public at large, now of record, for access
through or use of the property within the
proposed subdivision.
4. This Commission hereby finds and certifies that the project has
been reviewed and considered in compliance with the California Environmental
Quality Act of 1970 and, further, this Commission hereby issues a Negative
Declaration.
5. Based upon the findings and conclusions set forth in paragraph
1, 2 and 3 above, this Commission hereby approves the application subject to
each and every condition set forth below and in the attached Standard
Conditions attached hereto and incorporated herein by this reference.
Planning Division
(1) Approval of Tentative Tract 13359 is granted subject to approval
of Variance 87-15.
(2) The driveways on lots 3 and 4 shall be limited to 12 feet in
width. The revised plans shall be reviewed and approved by the
City Planner prior to the issuance of building permits.
(3) The driveway on lot 3 shall be located on the east side of the
lot and the driveway on lot 4 shall be located on the west side
of the lot. The revised plans shall be reviewed and approved by
the City Planner prior to the issuance of building permits.

(4) Approval of the Tentative Tract is contingent upon approval of a
General Plan Amendment changing designation from Park to Very
Low Residential .
Engineering Division
1) Existing Overhead Utilities:
a. Sapphire Street: An in-lieu fee as contribution to the
future undergrounding of the existing overhead utilities
(telecommunication and electrical ) on the project side of
Sapphire Street shall be paid to the City prior to
recordation of the final map. The fee shall be one-half
the adopted unit amount times the length of the project
frontage on Sapphire Street.
b. Utility lines (electrical ) extending from Sapphire Street
easterly along the proposed Street "A" shall be underground
or removed, if not in service, from Sapphire Street to the
last pole located within lot 1. If undergrounding is
necessary, reimbursement for one-half the City adopted cost
is feasible because the property to the north is
undeveloped.
2) The developer shall construct the "A" Street improvements along
the frontage of the "Not a Part" parcel to the satisfaction of
the City Engineer.
3) An underground storm drain pipe shall be constructed and
appropriate easements dedicated to convey flows from the south
end of Street "A" to Turk Street to the satisfaction of the City
Engineer. The size of the catch basin and storm drain pipe are
to be determined by the final drainage study.
4) The lot line adjustment as shown on the tentative tract map
shall be recorded prior to recordation of the final tract map.
5) A detailed study to evaluate the effects of the drainage
outletted onto Turk Street shall be completed prior to
recordation of the Final Map. Based upon the results of the
study, the developer shall construct drainage protection
facilities as required by the City Engineer which may include
the installation of a storm drain pipe extending from the
proposed outlet onto Turk Street to Demens Channel to the
south. The study shall , in particular, investigate in detail
the effects on flow due to the irregular shape of the Turk
Street cul-de-sac bulb, and the confluence of flows at the
intersections of Cameo Street with Thoroughbred Street and Turn
Street with Cameo Street.
6. The Deputy Secretary to this Commission shall certify to the
adoption of this Resolution.
