HomeMy WebLinkAbout88-17 - Resolutions RESOLUTION NO. 88-17 A RESOLUTION OF THE RANCHO CUCAMONGA PLANNING COMMISSION APPROVING CONDITIONAL USE PERMIT NO. 87-26 FOR THE DEVELOPMENT OF A SPECIALTY COMMERCIAL CENTER INCLUDING THE PRESERVATION OF THE EXISTING WINERY BUILDING TOTALING 111,000 SQUARE FEET ON 10.51 ACRES OF LAND LOCATED AT THE NORTHEAST CORNER OF VINEYARD AVENUE AND FOOTHILL BOULEVARD IN THE SPECIALTY COMMERCIAL DISTRICT OF THE FOOTHILL BOULEVARD SPECIFIC PLAN - APN 208-101-10 AND 11 A. Recitals. (i ) OAS Investors has filed an application for the issuance of the Conditional Use Permit No. 87-26 as described in the title of this Resolution. Hereinafter in this Resolution, the subject Conditional Use Permit request is referred to as "the application". (ii ) On the 27th of January, 1988, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. (iii ) All legal prerequisites to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission during the above-referenced public hearing on January 27, 1988, including written and oral staff reports, together with public testimony, this Commission hereby specifically finds as follows: (a) The application applies to property bounded by Foothill Boulevard, Vineyard Avenue and San Bernardino Road with a street frontage of 1,845 feet and lot depth of 795 feet and is presently vacant with an existing winery building and a still building; and (b) The property to the north of the subject site is single family homes, the property to the south of that site is partly vacant and partly developed with a liquor store, the property to the east is an existing shopping center, and the property to the west is an existing roller rink and restaurants. PLANNING COMMISSION RESOLUTION NO. 88-17 CONDITIONAL USE PERMIT 87-26 - OAS January 27, 1988 Page 2 (c) This project complies with the Foothill Boulevard Specific Plan in that; the design of the project creates a community design image that expresses and enhances the unique character and identity of Rancho Cucamonga, the proposed project facilitates efficient and safe vehicular and pedestrian traffic, and the project maintained the highest possible quality of the environment by balancing the impacts of development to the surrounding areas. In addition, the proposed use, building design, and site plan, together with the recommended conditions of approval are in compliance with the Foothill Boulevard Specific Plan and all other applicable provisions of the City's standards. (d) The identified potential adverse environmental impacts have been addressed with mitigation measures being added to the project and added as conditions of approval to ensure this project would not result in a decrease in environmental quality. 3. Based upon the substantial evidence presented to this Commission during the above-referenced public hearing and upon the specific findings of facts set forth in paragraph 1 and 2 above, this Commission hereby finds and concludes as follows: (a) That the proposed use is in accord with the General Plan, the Foothill Boulevard Specific Plan, the objectives of the Development Code, and the purposes of the district in which the site is located. (b) That the proposed use, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. (c) That the proposed use complies with each of the applicable provisions of the Development Code. 4. This Commission hereby finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and, further, this Commission hereby issues a Negative Declaration. 5. Based upon the findings and conclusions set forth in paragraph 1, 2 and 3 above, this Commission hereby approves the application subject to each and every condition set forth below and in the attached Standard Conditions attached hereto and incorporated herein by this reference. Planning Division (1) All free-standing walls including retaining walls shall be of authentic river rock material with decorative caps. PLANNING COMMISSION RESOLUTION NO. 88-17 CONDITIONAL USE PERMIT 87-26 - OAS January 27, 1988 Page 3 (2) Low level open fence or solid wall at the top of the slope along San Bernardino Road shall be provided for safety purposes. Detailed design shall be subject to City Planner review and approval . (3) Sufficient shopping cart corrals shall be provided within the parking area, west of Building "D" to the satisfaction of the City Planner. (4) Reciprocal driveway access and pedestrian access easements shall be obtained from the easterly adjacent property owner and shall be recorded prior to issuance of building permit. The developer shall also obtain authorization to perform off-site work at the easterly property. (5) The final design of the two pedestrian connections to the easterly property shall be subject to City Planner review and approval prior to issuance of building permit. The pedestrian connection between Buildings "A" and "B" shall include pedestrian amenities such as seating benches, landscaping and sufficient lighting for safety/security purposes, etc. , to the satisfaction of the City Planner. (6) The final design of how this 5 foot landscape area along the east property boundary will interface the adjacent project shall be subject to City Planner review and approval prior to issuance of building permits. (7) The final design of detailed cross sections "H", "J" , "L" and "N" pertaining to height of retaining wall and slope area shall be subject to City Planner review and approval prior to issuance of any permits. (8) All lighting fixtures shall have a shielding mechanism to prevent light and glare. (9) The removal of the 12 mature trees shall require replacement in kind with the largest nursery grown trees available, as determined by the City Planner. The applicant shall submit documentation of replacement, including a plan, to the City Planner prior to the removal of the trees. (10) The existing Bottle tree next to the still building shall be preserved if possible. If not, replacement in kind shall be required in accordance with Condition No. 9. PLANNING COMMISSION RESOLUTION NO. 88-17 CONDITIONAL USE PERMIT 87-26 - OAS January 27, 1988 Page 4 (11) The final detailed landscape and irrigation plan shall be subject to City Planner review and approval prior to issuance of building permit. (12) Authentic river rock materials shall be utilized for this entire project. A 4 foot by 8 foot test section shall be completed for inspection and approval by the Planning Division prior to installation. (13) A uniform hardscape and street furniture treatment, including trash receptacles, free-standing potted plants, bike racks, light bollards, benches, etc. , shall be utilized for the shopping center and shall be designed to be compatible with the architectural style. Detailed designs shall be submitted for Planning Division review and approval prior to issuance of building permits. ( 14) All wood beam, trellis, and arbor work shall be of heavy duty lumber subject to City Planner review and approval . (15) All delivery activity along the rear service driveway shall occur between the hours of 7 A.M. and 7 P.M. on weekdays. (16) A detailed acoustical study to determine the construction method for the reduction of interior noise to the acceptable level of 45 db shall be submitted to the Planning Division and Building and Safety Division for review and approval prior to issuance of building permits. (17) Construction traffic shall occur between the hours of 7 A.M. and 7 P.M. on weekdays along San Bernardino Road. (18) The soil study shall address the issue of reinforced foundations and slabs as outlined in the geologic report completed by Owen Geotechnical (project no. 4144-1-1) prior to issuance of building permits. (19) The lease agreement for all tenants shall have a clause indicating the site is within the City's adopted Red Hill Fault Special Study Zone. The language for such clause shall be subject to City Planner review and approval . A copy of the lease agreement with the above clause shall be filed with the City prior to issuance of building permits. PLANNING COMMISSION RESOLUTION NO. CONDITIONAL USE PERMIT 87-26 - OAS January 27, 1988 Page 5 (20) The site shall be developed and maintained in accordance with the approved site plan which includes architectural elevations, exterior materials and colors, landscaping, sign programs, and grading on file with the Planning Division, the conditions contained therein and Development Code regulations. (21) Metal brackets shall be used for the arbor work only, without the galvanized metal plate. The metal bracket shall be painted to match the wood stain color. Sample should be submitted to the City Planner for review and approval prior to issuance of building permits. (22) The half circle gutter shall be painted to match the building color. (23) Variation to store front design, such as "popped out" , recess in, riverrock base, tile base, etc. shall be provided, and to be subject to the Design Review Committee review and approval prior to plan check. Material sample shall also be submitted for committee reivew prior to plan check. (24) Building A (Souplantation Restaurant) shall have the same exterior building color and material as the entire shopping center. Full material samples shall be submitted for City Planner review and approval prior to issuance of building permits. (25) The sign program for the shopping center, including the major tenants for Building D and A, shall be designed to be compatible with the architectural style. Variation of sign color shall be minimal . The size of the sign copy shall be visually balanced and proportionate to the building and the architecture style. Sign Program to be reviewed and approved by Design Review Committee prior to issuance of building permits. (26) The temporary relocation and the final location of the directional signs for the Historical Landmark of the Rains House shall be subject to Historic Preservation Commission review and approval prior to plan check. The removal of the existing monument sign shall be subject to Historic Preservation Commission review and approval prior to issuance of building permits. (27) The wood shake shall be of thick butt size to the satisfaction of the City Planner. The wood shake shall be treated with fire retardant material and the roof shall be fully sprinkled. If the developer cannot meet the above requirements, the alternative roof PLANNING COMMISSION RESOLUTION NO. CONDITIONAL USE PERMIT 87-26 - OAS January 27, 1988 Page 6 material shall be of flat concrete tile. Full samples of the roof material shall be submitted for City Planner's approval prior to issuance of building permits. (28) Provisions for the following design features in the trash enclosure to the satisfaction of the City Planner: (a) Architectually integrated into the design of the shopping center. (b) Separate pedestrian access that does not require opening the main doors to include self-closing pedestrian door. (c) Large enough to accommodate two trash bins. (d) Roll-up doors. (e) Trash bins with counterweighted lids. (f) Architectually treated overhead shade trellis. (g) Chain link screen on top to prevent trash from blowing out of enclosure and designed to be hidden from view. (29) Graffiti shall be removed within 72 hours. (30) The entire site shall be kept free of trash and debris at all times, and in no event shall trash and debris remain for more than twenty-four (24) hours. (31) Window mullion color samples shall be reviewed and approved by Design Review Committee prior to issuance of building permits. (32) An historical directory sign shall be provided in the plaza area. Detailed design shall be reviewed by Design Review Committee prior to issuance of building permits. (33) Grapevines shall be provided and the grape variety indentified by name plate to the satisfaction of the City Planner. Engineering Division (1) Overhead Utilities a. Vineyard Avenue - The existing overhead utilities (telecommunication and electrical , except for 66 Kv electrical ) on the project site of Vineyard Avenue shall be undergrounded from the first pole PLANNING COMMISSION RESOLUTION NO. CONDITIONAL USE PERMIT 87-26 - OAS January 27, 1988 Page 7 on the north side of San Bernardino Road to the first pole on the south side of Foothill Boulevard, prior to public improvement, acceptance or occupancy, whichever occurs first. The developer may request a reimbursement agreement to recover one-half the City adopted cost for undergrounded from future development (redevelopment) as it occurs on the opposite side of the street. b. San Bernardino Road - An in-lieu fee as contribution to the future undergrounding of the existing overhead utilities (telecommunications) on the opposite side of San Bernardino Road shall be paid to the City prior to issuance of building permits. The fee shall be one-half the City adopted unit amount times the length from the center of Vineyard Avenue to the east project boundary. (2) Upgrade, modifications, and relocations, as necessary, of the traffic signal at the intersections of Foothill Boulevard and Vineyard Avenue and San Bernardino Road and Vineyard Avenue, shall be the responsibility of the developer. The relocation and modification shall be to the satisfaction of the City Engineer. (3) Additional right-of-way for right turn lanes on Foothill Boulevard and San Bernardino Road shall be dedicated at ultimate street widths as shown on the approved striping plan. (4) Off site street improvements necessary for traffic safety on the west side of Vineyard Avenue shall be constructed to the satisfaction of the City Engineer. (5) An encroachment permit is required for the arbor which extends into the public street right-of-way on Vineyard Avenue. (6) The full width of Vineyard Avenue at Foothill Boulevard shall be reconstructed to eliminate the "dipped" section. (7) An in-lieu fee for one-half the cost of the construction including landscaping and irrigation for the median island within Foothill Boulevard and for one-fourth the cost of construction of the special pavers to be placed within the roadway at the intersections of Foothill Boulevard and Vineyard Avenue shall be paid to the City prior to issuance of building permits. The fee for the median island shall be based on the length of the project's Foothill Boulevard frontage. The fee for the special pavers PLANNING COMMISSION RESOLUTION NO. CONDITIONAL USE PERMIT 87-26 - OAS January 27, 1988 Page 8 shall be based on the square frontage of the intersections. (8) The existing storm drain systems within the Vineyard Avenue/ Foothill Boulevard intersections shall be reconstructed to continue to convey flows under Foothill Boulevard outletting onto Vineyard Avenue to the south and shall also be designed to facilitate the future redirection of flows to the Cucamonga Creek Channel to the west via a storm drain system parallel to Foothill Boulevard. (9) Disposal of on-site drainage shall be accomplished by one of the following methods in order of preference: a. Outletted directly into Foothill Boulevard through a parkway culvert if sufficient street capacity is available as approved by Caltrans. b. The installation of a private pipe system within easements on private property connecting to the existing storm drain system to the east. c. The installation of a public pipe system (24 inches minimum diameter RCP) within the Foothill Boulevard parkways connecting to the existing system to the east. d. An alternate system as approved by the City Engineer. ( 10) Reciprocal easements shall be obtained and provided for the construction, maintenance, and use of the vehicle connections to the property to the east. (11) San Bernardino Road shall be constructed full width to include curb and gutter on the north side to the satisfaction of the City Engineer. The portion of street improvements constructed on the north side shall be subject to reimbursement upon development of the property to the north. Building and Safety Division (1) The most easterly driveway shall be rolled to prevent inflow to the satisfaction of the Building Official . (2) The north elevations of Buildings "G" and "F" shall have gutters along the north and west roof line to be piped out to the south, independent of storm drain system, in order to reduce the amount of run-off to north sumps. Storm drain from the sumps shall be designed with two outlets and shall be able to carry twice the required Q100. Neither of the two outlets PLANNING COMMISSION RESOLUTION NO. CONDITIONAL USE PERMIT 87-26 - OAS January 27, 1988 Page 9 shall pass under the buildings and both shall be easily accessible for maintenance. This condition shall be subject to both City Planner and Building Official review and approval prior to issuance of building permits. 6.
