HomeMy WebLinkAbout88-33 - Resolutions RESOLUTION NO. 88-33 A RESOLUTION OF THE RANCHO CUCAMONGA PLANNING COMMISSION APPROVING CONDITIONAL USE PERMIT NO. 88-05 FOR A CHURCH OFFICE AND ASSEMBLY AREA LOCATED AT 9757 ARCHIBALD AVENUE (SUITE 807) IN THE GENERAL INDUSTRIAL DISTRICT A. Recitals. (i ) Calvary Chapel has filed an application for the issuance of Conditional Use Permit No. 88-05 as described in the title of this Resolution. Hereinafter in this Resolution, the subject Conditional Use Permit request is referred to as "the application". (ii ) On the 24th of February, 1988, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. (iii ) All legal prerequisites to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission during the above-referenced public hearing on February 24, 1988, including written and oral staff reports, together with public testimony, this Commission hereby specifically finds as follows: (a) The application applies to property located at 9757 7th Street, Suite 807, a suite located in a multi-tenant industrial complex with approximately 230 parking spaces; and (b) The suites surrounding the application are occupied by tenants with operating hours typically between 8:00 A.M. and 5:00 P.M. and weekdays and which are closed on weekends; and (c) The applicant proposes to operate the church office between 8:30 A.M. and 4:30 P.M. and assembly for children 's activities will be conducted on weekends and after 6:00 P.M. on weeknights. 3. Based upon the substantial evidence presented to this Commission during the above-referenced public hearing and upon the specific findings of facts set forth in paragraph 1 and 2 above, this Commission hereby finds and concludes as follows: PLANNING COMMISSION RESOLUTION NO. 88-33 CUP 88-05 - Calvary Chapel February 24, 1988 Page 2 (a) That the proposed use is in accord with the General Plan, the objectives of the Industrial Area Specific Plan, and the purposes of the district in which the site is located. (b) That the proposed use, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. (c) That the proposed use complies with each of the applicable provisions of the Industrial Area Specific Plan. 4. This Commission hereby finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and, further, this Commission hereby issues a Negative Declaration. 5. Based upon the findings and conclusions set forth in paragraph 1, 2 and 3 above, this Commission hereby approves the application subject to each and every condition set forth below and incorporated herein by this reference. Conditions: (1) Approval of this request shall not waive compliance with all conditions of approval for CUP 87-15. (2) Approval of this request shall not waive compliance with all sections of the Industrial Specific Plan, and all other applicable City Ordinances. (3) The building shall not be occupied, until completion of all improvements required by Building and Fire Codes to the satisfaction of the Building and Safety Division and Foothill Fire Protection District. Prior to occupancy, plans shall be submitted to the Foothill Fire Protection District and the Building and Safety Division to show compliance. The building shall be inspected for compliance prior to occupancy. (4) The building may be used for religious assembly and other large group (50+ persons) activities only on Saturdays and Sundays and after 6:00 p.m. on weeknights. (5) Preschools or schools are not allowed by this permit; however, this shall not preclude nurseries or Sunday School during the hours of religious or group assembly. PLANNING COMMISSION RESOLUTION NO. 88-33 CUP 88-05 - Calvary Chapel February 24, 1988 Page 3 (6) All signs proposed for this Conditional Use Permit shall be designed in conformance with the City's Sign Ordinance and the approved Uniform Sign Program for the project and shall require review and approval by the Planning Division prior to installation. (7) If the operation of this Conditional Use Permit causes adverse effects to neighboring businesses, the Conditional Use Permit shall be brought before the Planning Commission for their review and possible termination of the use. 6. The Deputy Secretary to this Commission shall certify to the adoption of this Resolution. APPROVED AND ADOPTED THIS 24TH DAY OF FEBRUARY, 1988.
