HomeMy WebLinkAbout88-34 - Resolutions RESOLUTION NO. 88-34 A RESOLUTION OF THE RANCHO CUCAMONGA PLANNING COMMISSION APPROVING CONDITIONAL USE PERMIT NO. 86-20 FOR THE DEVELOPMENT OF A BUSINESS PARK CONSISTING OF SIX BUILDINGS TOTALING 155,029 SQUARE FEET ON 12.9 ACRES OF LAND LOCATED AT THE NORTHEAST CORNER OF ELM STREET AND TOWN CENTER DRIVE IN THE OFFICE PARK DISTRICT OF THE TERRA VISTA PLANNED COMMUNITY - APN: 1077-421-06, 1077- 091-17 A. Recitals. (i ) Western Properties has filed an application for the issuance of the Conditional Use Permit No. 86-20 as described in the title of this Resolution. Hereinafter in this Resolution, the subject Conditional Use Permit request is referred to as "the application". (ii ) On the 24th of February, 1988, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. (iii ) All legal prerequisites to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission during the above-referenced public hearing on February 24, 1988, including written and oral staff reports, together with public testimony, this Commission hereby specifically finds as follows: (a) The application applies to property bounded by Terra Vista Parkway, Church Street, Town Center Drive, and Elm Street with a street frontage of 3,200 feet and lot depth of approximately 600 feet and is presently vacant; and (b) The property to the north of the subject site is apartments, the property to the south of that site is vacant with an approved shopping center, the property to the east is vacant, and the property to the west is the Virginia Dare Business Park and Brunswick/Deer Creek Center; and (c) The Terra Vista Community Plan designates a Major Greenway Trail , type B, along the entire Elm Street frontage; and PLANNING COMMISSION RESOLUTION NO. 88-34 CUP 86-20 - WESTERN PROPERTIES February 24, 1988 Page 2 (d) The proposed use, building design, and site plan, together with the recommended conditions of approval are in compliance with the Terra Vista Planned Community and all other applicable provisions of the City standards. 3. Based upon the substantial evidence presented to this Commission during the above-referenced public hearing and upon the specific findings of facts set forth in paragraph 1 and 2 above, this Commission hereby finds and concludes as follows: (a) That the proposed use is in accord with the General Plan, the objectives of the Terra Vista Planned Community, and the purposes of the district in which the site is located. (b) That the proposed use, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. (c) That the proposed use complies with each of the applicable provisions of the Development Code and the Terra Vista Planned Community. 4. This Commission hereby finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and, further, this Commission hereby issues a Negative Declaration. 5. Based upon the findings and conclusions set forth in paragraph 1, 2 and 3 above, this Commission hereby approves the application subject to each and every condition set forth below and in the attached Standard Conditions attached hereto and incorporated herein by this reference. Planning Division (1) Additional pedestrian amenities such as benches and free-standing light fixtures shall be provided along Elm Street for the major greenway trail . A detailed design of this trail shall be subject to City Planner review and approval prior to issuance of building permits. (2) Pedestrian connections shall be provided to the corners of Town Center Drive and Terra Vista Parkway, and Church Street and Terra Vista Parkway. (3) The horizontal roof line for the rear elevation along the service drive shall be broken up with additional architectural elements, subject to City Planner review and approval prior to issuance of building permits. PLANNING COMMISSION RESOLUTION NO. 88-34 CUP 86-20 - WESTERN PROPERTIES February 24, 1988 Page 3 (4) Special landscape treatment shall be provided to the greenway trail subject to City Planner review and approval prior to issuance of building permits. (5) The landscape theme shall tie in with the office park project and the town center project. (6) The textured pavement for walkways and across circulation aisles shall be compatible to the architectural style and shall have integral color for richness, subject to City Planner review and approval . A full sample of this textured pavement shall be submitted to the Planning Division for review and approval prior to issuance of building permits. (7) A uniform hardscape and street furniture treatment including trash receptacles, benches, bike racks, and etc. , shall be utilized and designed to be compatible with the architectural style. Detailed designs shall be submitted for Planning Division review and approval prior to issuance of building permits. (8) The site shall be developed and maintained in accordance with the approved site plan which includes architectural elevations, exterior materials and colors, landscaping and grading on file with the Planning Division, the conditions contained herein, Development Code regulations and the Terra Vista Planned Community. (9) Provisions for the following design features in the trash enclosure to the satisfaction of the City Planner: a. Architecturally integrated into the design of the project. b. Separate pedestrian access that does not require opening the main doors to include self-closing pedestrian door. c. Large enough to accommodate two trash bins. d. Trash bins with counterweighted lids. e. Architecturally treated overhead shade. ( 10) Graffiti shall be removed within 72 hours. PLANNING COMMISSION RESOLUTION NO. 88-34 CUP 86-20 - WESTERN PROPERTIES February 24, 1988 Page 4 (11) The entire site shall be kept free of trash and debris at all times, and in no event shall trash and debris remain for more than twenty-four (24) hours. Engineering Division (1) The following streets shall be constructed full width for the stated limits except that off-site sidewalks and parkway landscaping may be deferred until development of the adjacent property: a. Terra Vista Parkway from Church Street to Town Center Drive; b. Church Street from Haven Avenue to Elm Street; c. Elm Avenue from Church Street to Town Center Drive; and d. Town Center Drive from Haven Avenue to Elm Avenue. (2) Full construction of trail type B improvements as outlined in the Terra Vista Community Plan text. (3) Only one median opening, centered on the proposed driveway, will be permitted along the project frontages of Church Street and Terra Vista Parkway. (4) A portion of the storm drain system line 1-3 from Deer Creek Channel to the intersection of Town Center Drive and Elm Avenue shall be constructed in accordance with the approved Terra Vista Master Plan of Storm Drains prior to occupancy of any buildings. 6. The Deputy Secretary to this Commission shall certify to the adoption of this Resolution. APPROVED AND ADOPTED THIS 24TH DAY OF FEBRUARY, 1988.
