A RESOLUTION OF THE PLANNING COMMISSION APPROVING A
MODIFICATION OF A CONDITION OF APPROVAL FOR PARCEL MAP
9537, A SUBDIVISION OF 26.4 ACRES OF LAND INTO 2 PARCELS,
LOCATED ON THE NORTHEAST CORNER OF VINEYARD AVENUE AND
NINTH STREET IN THE GENERAL INDUSTRIAL DISTRICT (SUBAREA
2)
WHEREAS, on the 26th day of January, 1988, a request for a
modification of conditions was filed by Messenger Investment Company for the
above stated project.
WHEREAS, on the 9th day of March, 1988, the Rancho Cucamonga Planning
Commission considered the above-described condition modification.
NOW, THEREFORE, THE RANCHO CUCAMONGA PLANNING COMMISSION RESOLVED AS
FOLLOWS:
SECTION 1: If the property owner of Parcel 1 of Parcel Map No. 9537
records a covenant against said Parcel 1 agreeing to accept the responsibility
for undergrounding the existing overhead utilities along Ninth Street fronting
said Parcel 1 upon development of said Parcel 1, then Condition (G.-3b.) under
Engineering Division of Resolution No. 86-35 shall be replaced to read as
follows:
Ninth Street - The existing overhead utilities (telecommunications
and electrical ) on the project side of Ninth Street shall be undergrounded as
follows: (1) Parcel 2 - along the entire Parcel 2 frontage extending to the
first pole offsite (east and west) ; and ( 2) Parcel 1 - along the entire Parcel
1 frontage from the first pole east of the east boundary of Parcel 1 to the
first pole west of Vineyard Avenue, prior to public improvement acceptance or
occupancy for each parcel, whichever occurs first. The Developer may request
a reimbursement agreement to recover one-half the City adopted cost for
undergrounding from future development (redevelopment) as it occurs on the
opposite side of the street.
APPROVED AND ADOPTED THIS 9TH DAY OF MARCH, 1988.

I, Brad Buller, Deputy Secretary of the Planning Commission of the City of
Rancho Cucamonga, do hereby certify that the foregoing Resolution was duly and
regularly introduced, passed, and adopted by the Planning Commission of the
City of Rancho Cucamonga, at a regular meeting of the Planning Commission held
on the 9th day of March, 1988, by the following vote-to-wit:
