HomeMy WebLinkAbout88-56 - Resolutions RESOLUTION NO. 88-56 A RESOLUTION OF THE RANCHO CUCAMONGA PLANNING COMMISSION APPROVING CONDITIONAL USE PERMIT NO. 87-37, DESIGN REVIEW THEREFOR, AND THE MODIFICATION TO PHASE III OF THE MASTER PLAN OF DEVELOPMENT REVIEW 86-13 FOR THE DEVELOPMENT OF AN AUTO SERVICE CENTER CONSISTING OF 3 BUILDINGS TOTALING 47,220 SQUARE FEET ON 4.45 ACRES OF LAND LOCATED AT THE NORTHEAST CORNER OF 9TH STREET AND VINEYARD AVENUE IN THE GENERAL INDUSTRIAL DISTRICT - APN 209-012-17 A. Recitals. (i ) Auto Serve Mall , Inc. has filed an application for the issuance of the Conditional Use Permit No. 87-37 as described in the title of this Resolution. Hereinafter in this Resolution, the subject Conditional Use Permit request is referred to as "the application". (ii) On the 23rd of March, 1988, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. (iii ) All legal prerequisites to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission during the above-referenced public hearing on March 23, 1988, including written and oral staff reports, together with public testimony, this Commission hereby specifically finds as follows: (a) The application applies to property located at the northeast corner of 9th Street and Vineyard Avenue with a street frontage of approximately 845 feet and lot depth of 361 feet and is presently unimproved; and (b) The property to the north of the subject site is an existing industrial building that is unoccupied, the property to the south is vacant, the property to the east is vacant and with a newly completed warehouse building, and the property to the west is a mini-warehouse and a multi-tenant industrial park; and PLANNING COMMISSION RESOLUTION NO. 88-56 RE: CUP 87-37 - MARTENS March 23, 1988 Page 2 (c) The proposed site plan with the deletion of the proposed driveway off Vineyard Avenue complies with the City access policy and will not create traffic impact; and (d) The proposed use, building design and site plan together with the recommended conditions of approval are in compliance with the Industrial Specific Plan and all other applicable provisions of the City standards. 3. Based upon the substantial evidence presented to this Commission during the above-referenced public hearing and upon the specific findings of facts set forth in paragraph 1 and 2 above, this Commission hereby finds and concludes as follows: (a) That the proposed use is in accord with the General Plan, the objectives of the Industrial Specific Plan, and the purposes of the district in which the site is located. (b) That the proposed use, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. (c) That the proposed use complies does comply with each of the applicable provisions of the Development Code and the Industrial Specific Plan. 4. This Commission hereby finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and, further, this Commission hereby issues a Negative Declaration. 5. Based upon the findings and conclusions set forth in paragraph 1, 2 and 3 above, this Commission hereby approves the application subject to each and every condition set forth below and in the attached Standard Conditions attached hereto and incorporated herein by this reference. Planning Division (1) Dark tinted glass shall be used (PTG Gray No. 14) . (2) Details of reveal , building edges, corner edges for the brick material , detailing of how the two different materials transition into one another, etc. shall be provided for City Planner review and approval prior to issuance of building permits. PLANNING COMMISSION RESOLUTION NO. 88-56 RE: CUP 87-37 - MARTENS March 23, 1988 Page 3 (3) The first roll-up door at the north side of the west elevation of Building A shall be moved southerly while the landscape planter shall be moved northerly. (4) Additional landscape planters shall be provided across from the southwest corner of Building C subject to City Planner review and approval prior to issuance of building permits. (5) All future signs shall be of individual channel letters instead of cannister signs. (6) Special landscape treatment shall be provided along 9th Street and Vineyard Avenue with increased number of trees, specimen size trees and accent trees. (7) Dense landscaping shall be provided along the east property boundary and the north property boundary. (8) Special landscape treatment with increased number of trees, accent trees and specimen size trees shall be provided at all project entries. (9) Texture pavement for walkway and across circulation aisles shall be provided and shall be designed to be compatible with the architectural style and shall have integral color for richness, subject to City Planner review and approval . A full sample of this texture pavement shall be submitted to the Planning Division for review and approval prior to issuance of building permits. (10) A uniform hardscape and street furniture treatment, including trash receptacles, benches, bike racks, etc. shall be utilized and designed to be compatible with the architectural style. Detailed designs shall be submitted for Planning Division review and approval prior to issuance of building permits. (11) The site shall be developed and maintained in accordance with the approved site plan, which includes architectural elevations, exterior materials and colors, landscaping and grading on file with the Planning Division, the conditions therein, Development Code regulations, and the Industrial Specific Plan. (12) Provisions for the following design features in the trash enclosure to the satisfaction of the City Planner: a) Architecturally integrated into the design of the project. b) Separate pedestrian access that does not require opening the main doors to include self- ' closing pedestrian doors. PLANNING COMMISSION RESOLUTION NO. 88-56 RE: CUP 87-37 - MARTENS March 23, 1988 Page 4 c) Large enough to accommodate two trash bins. d) Trash bins with counter-weighted lids. e) Architecturally treated overhead shade. (13) Roll-up doors that fronts on 9th Street and Vineyard Avenue shall be closed between the hours of 7:00 P.M. to 7:00 A.M. daily. (14) Outdoor display and sales of merchandise shall not be allowed. (15) Reciprocal driveway easement for the shared driveway at the northeasterly side of the project site and along the east property boundary shall be recorded prior to issuance of building permit. Engineering Division (1) Overhead Utilities: a) Vineyard Avenue - The existing overhead utilities (electrical , except for the 66 KV electrical ) on the project side of Vineyard Avenue shall be undergrounded from the first pole south of 9th Street to the first pole north of the northerly property line, prior to public improvement acceptance or occupancy, whichever occurs first. The developer may request a reimbursement agreement to recover one-half the City adopted cost for undergrounding from future development (redevelopment) as it occurs on the opposite side of the street. b) Ninth Street - The existing overhead utility (telecommunications and electrical ) on the project side of 9th Street shall be undergrounded from the first pole off- site east of the easterly property boundary to the first pole on the west side of Vineyard Avenue, prior to public improvement acceptance or occupancy, whichever occurs first. The developer may request a reimbursement agreement to recover one-half the City adopted cost for undergrounding from future development (redevelopment) as it occurs on the opposite side of the street. (2) One driveway is permitted onto Vineyard avenue between 9th Street and Arrow Route which shall be aligned with the middle driveway on the opposite side of the street. This project may share that driveway if all other existing driveways are removed. 6. The Deputy Secretary to this Commission shall certify to the adoption of this Resolution.
