HomeMy WebLinkAbout88-58 - Resolutions RESOLUTION NO. 88-58 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA APPROVING VESTING TENTATIVE TRACT 13823, A RESIDENTIAL SUBDIVISION AND DESIGN REVIEW OF 265 CONDOMINIUMS ON 14.83 ACRES OF LAND IN THE MEDIUM-HIGH RESIDENTIAL DISTRICT (14-24 DWELLING UNITS PER ACRE) LOCATED ON THE SOUTH SIDE OF LEMON AVENUE, EAST OF HAVEN AVENUE - APN: 201-271-75. A. Recitals. (i ) Alta Loma - Oxford Limited Partnership has filed an application for the approval of Vesting Tentative Tract Map No. 13823 as described in the title of this Resolution. Hereinafter in this Resolution, the subject Tentative Tract Map request is referred to as "the application". (ii ) On the 23rd of March, 1988, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. (iii ) All legal prerequisites to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission during the above-referenced public hearing on March 23, 1988, including written and oral staff reports, together with public testimony, this Commission hereby specifically finds as follows: (a) The application applies to property located on the south side of Lemon Avenue, east of Haven Avenue with a street frontage of 657 feet and lot depth of 992 feet and is presently unimproved; and (b) The properties to the north, east, and west are designated for residential uses. The properties to the north and east are currently vacant. The property to the west is presently being developed with condominiums. The property to the south is designated for the future Foothill Freeway and is currently vacant; and (c) The project, with the recommended conditions of approval , complies with all minimum development standards of the City of Rancho Cucamonga; and PLANNING COMMISSION RESOLUTION NO. 88-58 VTT 13823 - ALTA LOMA-OXFORD March 23, 1988 Page 2 (d) The development of 265 condominiums on 14.83 acres of land is consistent with the Medium-High Residential land use designation of the General Plan. 3. Based upon the substantial evidence presented to this Commission during the above-referenced public hearing and upon the specific findings of facts set forth in paragraph 1 and 2 above, this Commission hereby finds and concludes as follows: (a) That tentative tract is consistent with the General Plan, Development Code, and specific plans; and (b) The design or improvements of the tentative tract is consistent with the General Plan, Development Code, and specific plans; and (c) The site is physically suitable for the type of development proposed; and (d) The design of the subdivision is not likely to cause substantial environmental damage and avoidable injury to humans and wildlife or their habitat; and (e) The tentative tract is not likely to cause serious public health problems; and (f) The design of the tentative tract will not conflict with any easement acquired by the public at large, now of record, for access through or use of the property within the proposed subdivision. 4. This Commission hereby finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and, further, this Commission hereby issues a Negative Declaration. 5. Based upon the findings and conclusions set forth in paragraph 1, 2 and 3 above, this Commission hereby approves the application subject to each and every condition set forth below and in the attached Standard Conditions attached hereto and incorporated herein by this reference. Tract Map (1) Approval of the Tract Map is contingent upon approval of the landscaping and/or buffering along the east tract boundary. To accomplish this objective, the plans may include, but not limited to, such things as a reduction in the number of units, PLANNING COMMISSION RESOLUTION NO. 88-58 VTT 13823 - ALTA LOMA-OXFORD March 23, 1988 Page 3 additional building setbacks, intensified landscaping, etc. The revised plans shall be reviewed by the Design Review Committee. (2) An in-lieu fee as contribution to the future undergrounding of the existing overhead utilities (electrical and telecommunication) located on the north side of Highland Avenue shall be paid to the City prior to approval of the final map. The fee shall be one-half the City adopted unit amount times the length of the project frontage. (3) Lemon Avenue shall be designed as a water carrying street requiring a rolled driveway at the property line. (4) In addition to the standard one-half street section improvements for Lemon Avenue, a 14 foot wide paved lane shall be provided on the north side of the centerline. This portion of pavement shall be eligible to cost reimbursement upon development of the property to the north. (5) Existing City storm drain along east tract boundary: a. The manholes shall be accessible by City vehicles which will require the relocation of two of them, possible reconstruction of a portion of the storm drain pipe, restricted landscaping, turf block, and as otherwise required by the City Engineer. b. An easement over the internal drive aisles shall be provided to the City for maintenance vehicle access to the manholes. c. The developer's engineer shall submit an analysis of the effect of the proposed project grading on the existing storm drain pipe. Measures shall be provided as necessary to protect the pipe from increased loads. d. The building footings shall be extended as necessary to allow the future replacement of the pipe. (6) Prior to approval of the final map or issuance of building permits, a drainage study shall be submitted detailing how the site will be protected from flows from the north if Tract No. 12873 has not been constructed. Protection measures such as PLANNING COMMISSION RESOLUTION NO. 88-58 VTT 13823 - ALTA LOMA-OXFORD March 23, 1988 Page 4 withholding permits for some buildings in order to provide a temporary on-site debris basin may be required. Design Review (1) The following items shall be incorporated into the final landscape plans which are subject to review and approval by the City Planner prior to the issuance of building permits: a. Monumentation elements for the building pods shall be consistent with the entry monumentation. b. The vine pockets along the drive aisles shall be a minimum depth of two feet and shall include necessary irrigation and be bordered by curbing. c. Deep watering techniques shall be provided for all trees. d. The "no parking" area at the northeast corner of the site shall be turf block. (2) The following items shall be incorporated into the final building plans which are subject to review and approval by the City Planner prior to the issuance of building permits: a. Planter boxes shall be integrated into the design of the buildings. The boxes shall be build into columns at the corners of the balconies. b. Detailing throughout the project shall be of a high quality to create crisp, defined edges. c. A final acoustical analysis shall be submitted to address construction techniques necessary to reduce interior noise levels to less than 45 CNEL. The analysis shall also address any changes in the design of the freeway. (3) A sound wall shall be required along the south tract boundary as recommended by the acoustical engineer. The design of the wall shall be reviewed and approved by the Planning Commission prior to the issuance of building permits. PLANNING COMMISSION RESOLUTION NO. 88-58 VTT 13823 - ALTA LOMA-OXFORD March 23, 1988 Page 5 (4) A decorative block wall shall be constructed along the east tract boundary prior to occupancy of the units or a cash deposit shall be posted to cover the cost of construction of the wall . When the wall is constructed, it shall be designed to accommodate additional height (if necessary) and to minimize any potential double wall , wall relocation, or grade differential conflicts that may result with the project to the east when it is constructed. The plans shall be reviewed and approved by the City Planner prior to the issuance of building permits for the wall . (5) That Tree Removal Permit 88-01 is approved subject to replacement planting as part of the overall site landscape concept. 6.
