HomeMy WebLinkAbout88-89 - Resolutions RESOLUTION NO. 88-89 A RESOLUTION OF THE RANCHO CUCAMONGA PLANNING COMMISSION APPROVING DEVELOPMENT AGREEMENT AND DEVELOPMENT DISTRICT CHANGE NO. 87-03, REQUESTING A CHANGE IN THE DISTRICT DESIGNATION FROM OFFICE/PROFESSIONAL (OP) TO NEIGHBORHOOD COMMERCIAL (NC) LOCATED AT THE SOUTHWEST CORNER OF LOMITA COURT AND ARCHIBALD. A. Recitals. (i ) Weirick Properties has filed an application for the Development District Change No. 87-03 and Development Agreement as described in the title of this Resolution. Hereinafter in this Resolution, the subject Development District Change request is referred to as "the application". (ii ) On May 11, 1988 the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. (iii ) All legal prerequisites to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission during the above-referenced public hearing on May 11, 1988, including written and oral staff reports, together with public testimony, this Commission hereby specifically finds as follows: (a) The application and Development Agreement applies to property located at southwest corner of Lomita Cour and Archibald Avenue with a street frontage of 520 feet and lot depth of 298 feet and is presently unimproved. (b) The property to the north of the subject site is Office/Professional , the property to the south of that site consists of Neighborhood Commercial , the property to the east is Medium High and Neighborhood Commercial , and the property to the west is High (Senior Housing Overlay District) . 3. Based upon the substantial evidence presented to this Commission during the above-referenced public hearing and upon the specific findings of facts set forth in paragraph 1 and 2 above, this Commission hereby finds and concludes as follows: PLANNING COMMISSION RESOLUTION DDA 87-03 May 11, 1988 Page 2 (a) That the subject property is suitable for the uses permitted in the proposed district in terms of access, size, and compatibility with existing land use in the surrounding area; and (b) That the proposed district change would not have significant impact on the environment nor the surrounding properties; and (c) That the proposed district change is in conformance with the General Plan. 4. This Commission hereby finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and, further, this Commission hereby recommends issuance of a Negative Declaration. 5. Based upon the findings and conclusions set forth in paragraph 1, 2 and 3 above, this Commission hereby resolves as follows: (a) That pursuant to Section 65850 to 65855 of the California Government Code, that the Planning Commission of the City of Rancho Cucamonga hereby recommends approval on the 11th day of May 1988, District Change No. 87-03. (b) The Planning Commission hereby recommends that the City Council approve and adopt District Change No. 87-03. (c) That the Planning Commission recommends that the City Council approve the accompany Development Agreement No. 87-03. (d) That a Certified Copy of this Resolution and related material hereby adopted by the Planning Commission shall be forwarded to the City Council . 6. The Deputy Secretary to this Commission shall certify to the adoption of this Resolution. APPROVED AND ADOPTED THIS 11TH DAY OF MAY 1987.
