HomeMy WebLinkAbout88-90 - Resolutions RESOLUTION NO. 88-90 A RESOLUTION OF THE RANCHO CUCAMONGA PLANNING COMMISSION APPROVING CONDITIONAL USE PERMIT NO. 87-29 FOR A NEIGHBORHOOD RETAIL CENTER LOCATED ON THE SOUTHWEST CORNER OF ARCHIBALD AVENUE AND LOMITA COURT IN THE NEIGHBORHOOD COMMERCIAL DISTRICT - APN: 202-151-33 A. Recitals. (i ) Weirick Properties has filed an application for the issuance of the Conditional Use Permit No. 87-29 as described in the title of this Resolution. Hereinafter in this Resolution, the subject Conditional Use Permit request is referred to as "the application". (ii) On the 11th of May, 1988, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. (iii ) All legal prerequisites to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission during the above-referenced public hearing on May 11, 1988, including written and oral staff reports, together with public testimony, this Commission hereby specifically finds as follows: (a) The application applies to property located at the southwest corner of Lomita Court and Archibald Avenue; and (b) The property to the north of the subject site is vacant, the property to the south of that site consists of an existing retail center, the property to the east is an existing retail center, and the property to the west is a senior housing project. 3. Based upon the substantial evidence presented to this Commission during the above-referenced public hearing and upon the specific findings of facts set forth in paragraph 1 and 2 above, this Commission hereby finds and concludes as follows: PLANNING COMMISSION RESOLUTION NO. CONDITIONAL USE PERMIT 87-29 - WEIRICK May 11, 1988 • Page 2 (a) That the proposed use is in accord with the General Plan, the objectives of the Development Code, and the purposes of the district in which the site is located. (b) That the proposed use, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. (c) That the proposed use complies with each of the applicable provisions of the Development Code. 4. This Commission hereby finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and, further, this Commission hereby issues a Negative Declaration. 5. Based upon the findings and conclusions set forth in paragraph 1, 2 and 3 above, this Commission hereby approves the application subject to each and every condition set forth below and in the attached Standard Conditions attached hereto and incorporated herein by this reference. Planning Division (1) The service area for the restaurant shall provide a service truck loading zone, be reorganized to relocate the trash enclosure out of the north drive entry line of sight, and be properly screened. (2) The parking lot lighting standards shall be of metal . (3) Benches or integrated seating shall be provided throughout the project. (4) Enriched paving shall be provided at points of ingress and egress. (5) Sufficient area for service truck turn around shall be provided for Buildings "B" and "C". (6) The Archibald streetscape shall be consistent with the concepts for the Archibald beautification project. (7) Parking lot trees shall be low residual maintenance and canopy type. (8) The Archibald entry shall be designed with a stronger landscape statement. PLANNING COMMISSION RESOLUTION NO. CONDITIONAL USE PERMIT 87-29 - WEIRICK May 11, 1988 Page 3 (9) Special landscape considerations shall be made to buffer the south property line elevations. (10) Final Site and Landscape Plans shall be reviewed and approved by the City Planner prior to issuance of permits. (11) Provisions for the following design features in the trash enclosure to the satisfaction of the City Planner: (a) Architecturally integrated into the design of the shopping center. (b) Separate pedestrian access that does not require opening the main doors to include self- closing pedestrian door. (c) Large enough to accommodate two trash bins. (d) Roll-up doors. (e) Trash bins with counterweighted lids. (f) Architecturally treated overhead shade trellis. (g) Chain link screen on top to prevent trash from blowing out of enclosure and designed to be hidden from view. (12) Graffiti shall be removed within 72 hours. (13) The entire site shall be kept free of trash and debris at all times, and in no event shall trash and debris remain for more than twenty-four (24) hours. (14) Trash collection shall occur between the hours of 9:00 A.M. and 10:00 P.M. only. (15) Noise Levels - All commercial activities shall not create any noise that would exceed an exterior noise level of 60dBA during the hours of 10:00 P.M. to 7:00 A.M. and 65dBA during the hours of 7:00 A.M. to 10:00 P.M. (16) Loading and Unloading - No person shall cause the loading, unloading, closing, or other handling of boxes, crates, containers, building materials, garbage cans, or similar objects between the hours of 10:00 P.M. and 7:00 A.M. unless otherwise specified herein, in a manner which would cause a noise disturbance to a residential area. CONDITIONAL USE PERMIT 87-29 - WEIRICK May 11, 1988 Page 4 (17) The site shall be developed and maintained in accordance with the approved Site Plan which includes architectural elevations, exterior materials and colors, landscaping, sign programs, and grading on file with the Planning Division, the conditions contained therein and Development Code regulations. Engineering Division Cl) Existing and future storm drain facilities along the south project boundary: (a) An overflow channel to carry 100 year storm flows shall be designed and constructed to the satisfaction of the City Engineer. (b) The building footings shall be extended as necessary to allow the future replacement of the storm drain pipe. (c) Trees shall be placed a minimum of 5 feet from the outside diameter drain pipe or as otherwise determined by the City Engineer. (d) An easement over the internal drive aisles shall be provided to the City for maintenance vehicle access to the City storm drain easement. (e) On-site flows shall be directed to the existing storm drain pipe. (2) The developer shall be responsible for the maintenance of the overflow channel and the replacement and repair of fencing and landscaping within the City drainage easement. An agreement defining these responsibilities shall be provided to the satisfaction of the City Engineer and the City Attorney prior to issuance of building permits. (3) The developer shall request an abandonment of 10 feet of the existing 30 foot drainage easement prior to issuance of building permits. (4) Prior to building permit issuance, the developer shall comply with the reimbursement agreement for frontage improvements per City Council Resolution No. 85-329 for the construction of street improvements on Archibald Avenue. CONDITIONAL USE PERMIT 87-29 - WEIRICK May 11, 1988 Page 5 (5) Landscaping on Archibald Avenue shall be in conformance with the City' s Landscape Master Plan for Archibald. 6. Approval of Conditional Use Permit 87-29 is contingent upon Rancho Cucamonga City Council approval of General Plan Amendment 87-04B and Development District Amendment 87-03. 7.
