HomeMy WebLinkAbout88-91 - Resolutions RESOLUTION NO. 88-91 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, CONDITIONALLY APPROVING TENTATIVE VESTING PARCEL MAP NUMBER 11410 WHEREAS, Tentative Parcel Map Number 11410, submitted by Carney- Theodorou, applicant, for the purpose of subdividing into 6 parcels, the real property situated in the City of Rancho Cucamonga, County of San Bernardino, State of California, identified as APN 209-142-17, located at the southeast corner of Haven Avenue and Arrow Route; and WHEREAS, on May 11, 1988, the Planning Commission held a duly advertised public hearing for the above-described map. NOW, THEREFORE, THE RANCHO CUCAMONGA PLANNING COMMISSION RESOLVED AS FOLLOWS: SECTION 1: That the following findings have been made: 1. That the map is consistent with the General Plan. 2. That the improvement of the proposed subdivision is consistent with the General Plan. 3. That the site is physically suitable for the proposed development. 4. That the proposed subdivision and improvements will not cause substantial environmental damage, public health problems or have adverse affects on abutting property. SECTION 2: This Commission finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and, further, this Commission hereby issues a Negative Declaration. SECTION 3: That Tentative Parcel Map No. 11410 is hereby approved subject to the attached Standard Conditions and the following Special Conditions: 1. A contribution in aid of construction for the median island within Haven Avenue shall be paid to the City prior to recordation of the Final Parcel Map. The amount of the fee shall be the City adopted unit amount for Phase II ($55) times the linear feet of property fronting on Haven Avenue (476 t feet), per resolution 87-587. 2. A drainage easement in favor of the of the Not A Part parcel shall be provided. PLANNING COMMISSION RESOLUTION NO. PM 11410 MAY 11, 1988 PAGE 2 3, The Developer shall pay the reimbursement fees per City Council Resolution No. 85-328 executed by the Daon Comporation for the construction of improvements on Arrow Route prior to approval of the Final Parcel Map. 4. Utica Avenue shall be constructed full width (except for off-site parkway improvements) from Arrow Route to meet the existing improvements to the south. 5. The Arrow Route street improvements (except for parkway improvements) shall be extended across the Not A Part parcel to the west. 6. Haven Avenue shall be widened across the Not A Part parcel to the north to provide a right turn lane for eastbound traffic onto Arrow Route, which shall include modifying and upgrading the existing traffic signal . 7. The Developer may request reimbursement agreements to recover the costs of constructing the improvements fronting on the Not A Part parcel upon its development and those east of the centerline of Utica Avenue from the property owner to the east upon its development. 8. If the required street improvements (Std. Condition B.3) are not completed prior to approval of the Final Parcel Map, an improvement certificate shall be placed upon the Final Parcel Map stating that they will be completed upon development of each parcel as follows (applicable special conditions in parentheses) : a) Parcel 1 and/or 2: 1) Haven Avenue from the south property line to Arrow Route (Special Condition 6) ; 2) Internal north-south drive aisle; and 3) Arrow Route between Haven Avenue and the north-south drive aisle, including the drive approach (Special Condition 5) . b) Parcel 3: Arrow Route between Haven and Utica Avenues (Special Condition 5). P M 11410 MAY 11, 1988 PAGE 3 c) Parcel 4: Arrow Route between Haven and Utica Avenues (Special Condition 5) and Utica Avenue between Arrow Route and the south property line (Special Condition 4). d) Parcel 5 and/or 6: Utica Avenue between Arrow Route and the south property line (Special Condition 4) and the portion of Arrow Route fronting on Parcel 4. However, if the Arrow Route improvements are existing fronting the NOT A PART parcel, then the Arrow Route improvements shall be extended across the Parcel 3 frontage. 9. Utility Undergrounding a) Arrow Route - the existing overhead utilities (telecommunications and electrical) on the project side of Arrow Route shall be undergrounded from the first pole on the west side of Haven Avenue to the first pole on the east side of Utica Avenue upon development of Parcel 3 and/or 4. The Developer may request reimbursement agreements to recover one-half the City adopted cost for undergrounding from future development (redevelopment) as it occurs on the opposite side of the street and to recover the full cost of undergrounding across the Not A Part parcel to the west upon its development. b) If Arrow Route street improvements precede Haven Avenue undergrounding, a conduit shall be placed across Arrow Route. c) Haven Avenue - the existing overhead utilities (communication for the 66KV electrical ) on the project side of Haven Avenue shall be undergrounded from the first pole south of the project south boundary to the first pole on the north side of Arrow Route upon development of Parcel 1 and/or 2. The Developer may request a reimbursement agreement to recover the full cost of undergrounding across the Not A Part parcel to the north upon its development. PLANNING COMMISSION RESOLUTION NO. PM 11410 MAY 11, 1988 PAGE 4 d) If Haven Avenue street improvements precede Arrow Route undergrounding, a conduit shall be placed across Haven Avenue. e) Haven Avenue - An in-lieu fee as contribution to the future undergrounding of the utilities (telecommunications and electical) on the opposite side of Haven Avenue shall be paid to the City prior to the issuance of building permits for Parcels 1 and/or 2. The fee shall be one-half the difference between the undergrounding cost of the utilities (telecommunications and electrical) on the opposite side of Haven Avenue minus those (communication for 66KV electrical) on the project side times the length of the project frontage. 10. The parcel lines shall be adjusted so that sufficient parking is contained within each parcel, as approved by the City Planner, prior to approval of the Final Parcel Map. 11. An easement for joint use of all driveways, in favor of the Not A Part parcel, shall be provided. APPROVED AND ADOPTED THIS 11TH DAY OF MAY, 1988.
