HomeMy WebLinkAbout88-99 - Resolutions RESOLUTION NO. 88-99 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA RECOMMENDING APPROVAL OF GENERAL PLAN AMENDMENT 88-02A, REQUESTING TO AMEND THE GENERAL PLAN FROM MEDIUM RESIDENTIAL (8-14 DWELLING UNITS PER ACRE) TO LOW-MEDIUM RESIDENTIAL (4-8 DWELLING UNITS PER ACRE) FOR 15 ACRES OF LAND LOCATED NORTH OF HIGHLAND AVENUE, SOUTH OF LEMON AVENUE EXTENSION, AND WEST OF DEER CREEK CHANNEL - APN: PORTIONS OF 201-271-34 AND 41, AND 201-271-42 A. Recitals. (i ) Acacia Construction has filed an application for General Plan Amendment 88-02A as described in the title of this Resolution. Hereinafter in this Resolution, the subject General Plan Amendment is referred to as "the application." (ii) On May 25, 1988, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. (iii ) All legal prerequisites to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined, and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part "A", of this Resolution are true and correct. 2. Based on substantial evidence presented to this Commission during the above-referenced public hearing on May 25, 1988, including written and oral staff reports, together with public testimony, this Commission hereby specifically finds as follows: (a) The application applies to approximately 15 acres of land, basically an inverted "L" configuration, located north of Highland Avenue, south of Lemon Avenue extension, and west of the Deer Creek Channel , and is presently undeveloped. Said property is currently designated as Medium Residential ; and (b) The property to the north of the subject site is designated as Low-Medium Residential , vacant, and proposed for single family development. The property to the west is designated Medium-High Residential and is undeveloped. The property to the east is designated Medium Residential and is vacant (settling basin, Deer Creek) . The property to the south is designated Medium Residential and is primarily vacant with the exception of 2 vacant and boarded-up houses; and PLANNING COMMISSION RESOLUTION NO. GPA 88-02A - ACACIA CONSTRUCTION May 25, 1988 Page 2 (c) This amendment does not conflict with the Land Use Policies of the General Plan and will provide for development within the district in a manner consistent with the General Plan and with related development; and (d) This amendment promotes the goals and objectives of the Land Use Element; and (e) This amendment would not be materially injurious or detrimental to the adjacent properties. 3. Based upon the substantial evidence presented to this Commission during the above-referenced public hearing and upon the specific findings of facts set forth in Paragraphs 1 and 2 above, this Commission hereby finds and concludes as follows: (a) That the subject property is suitable for the uses permitted in the proposed district in terms of access, size, and compatibility with existing land use in the surrounding area; and (b) That the proposed amendment would not have a significant impact on the environment nor the surrounding properties; and (b) That the proposed amendment is in conformance with the General Plan. 4. This Commission hereby finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and, further, this Commission hereby recommends issuance of a Negative Declaration. 5. Based upon the findings and conclusions set forth in Paragraphs 1, 2, and 3 above, this Commission hereby resolves as follows: (a) That pursuant to Section 65850 to 65855 of the California Government Code, the Planning Commission of the City of Rancho Cucamonga hereby recommends approval on the 25th day of May, 1988, General Plan Amendment 88-02A. (b) The Planning Commission hereby recommends that the City Council approve and adopt General Plan Amendment 88-02A for that property described herein and attached as part of this Resolution hereof. (c) That a Certified Copy of this Resolution and related hereby adopted by the Planning Commission shall be forwarded to the City Council . PLANNING COMMISSION RESOLUTION NO.
