A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO CUCAMONGA, CALIFORNIA, RECOMMENDING APPROVAL OF
ENVIRONMENTAL ASSESSMENT AND DEVELOPMENT AGREEMENT NO.
88-01 - TERRANCE MELCHER, FOR ANNEXATION AND DEVELOPMENT
OF A 96 ACRE PORTION OF SAN BERNARDINO COUNTY
UNINCORPORATED AREA LOCATED AT THE NORTHWEST CORNER OF
ETIWANDA AVENUE AND 24TH STREET, APN 225-071-65.
A. Recitals.
(i ) California Government Code Section 65864 now provides, in
pertinent part, as follows:
"The Legislature finds and declares that:
"(a) The lack of certainty in the approval of development projects
can result in a waste of resources, escalate the cost of housing and other
developments to the consumer, and discourage investment in and commitment to
comprehensive planning which would make maximum efficient utilization of
resources at the least economic cost to the public.
"(b) Assurance to the applicant for a development project that upon
approval of the project, the applicant may proceed with the project in
accordance with existing policies, rules and regulations, and subject to
conditions of approval , will strengthen the public planning process, encourage
private participation in comprehensive planning, and reduce the economic costs
of development."
(ii ) California Government Code Section 65865 provides, in
pertinent part, as follows:
"Any city. . . , may enter into a development agreement with any person
having a legal or equitable interest in real property for the development of
such property as provided in this article. . . . "
(iii ) California Government Code Section 65865.2 provides as
follows:
"A development agreement shall specify the duration of the agreement,
the permitted uses of the property, the density or intensity of use. . ."
(iv) Attached to this Resolution, marked as Exhibit "1" , and
incorporated herein by this reference, is a proposed Development Agreement
concerning that property located at the northwest corner of Etiwanda Avenue
and 24th Street. Hereinafter in this Resolution, that agreement attached
hereto as Exhibit "1" is referred to as "the Development Agreement."
(v) On June 22, 1988, the Planning Commission of the City of
Rancho Cucamonga held a duly noticed public hearing concerning the proposed
Development Agreement and concluded said hearing on that date.
(vi ) All legal prerequisites prior to the adoption of this
Resolution have occurred.
B. Resolution.
NOW, THEREFORE, it is hereby resolved by the Planning Commission of
the City of Rancho Cucamonga as follows:
1. In all respects as set forth in Recitals, Part A, of this
Resolution.
2. In conjunction with this Development Agreement, an Initial Study
and Preliminary Environmental Assessment, in conformity with the requirements
of the California Environmental Quality Act, has been prepared. The Planning
Commission has determined that this project would not have a significant
adverse effect on the environment, and hereby recommends a finding of no
significant impact and the issuance of a Negative Declaration by the City
Council .
3. The Planning Commission specifically finds that:
(a) That the 96 acre property is suitable for a master planned
residential development and is compatible with the existing General Plan
designation for the land use in the surrounding area; and
(b) That the Development District pre-zone will not have a
significant impact on the environment; and
(c) That this agreement is in conformance with the General
Plan designation of Low Density Residential (2-4 dwelling units per acre) .
4. The Planning Commission hereby recommends approval of the
Development Agreement attached hereto as Exhibit "1".
APPROVED AND ADOPTED THIS 22ND DAY OF JUNE, 1988.

I , Brad Buller, Deputy Secretary of the Planning Commission of the City of
Rancho Cucamonga, do hereby certify that the foregoing Resolution was duly and
regularly introduced, passed, and adopted by the Planning Commission of the
City of Rancho Cucamonga, at a regular meeting of the Planning Commission held
on the 22nd day of June, 1988, by the following vote-to-wit:
