HomeMy WebLinkAbout89-57 - Resolutions RESOLUTION NO. 89-57 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA APPROVING TENTATIVE TRACT MAP NO. 13664, FOR THE SUBDIVISION OF 24 SINGLE FAMILY LOTS AND 4 LOTS FOR THE DEVELOPMENT OF 86 CONDOMINIUM UNITS, LOCATED WITHIN THE TERRA VISTA COMMUNITY PLAN DISTRICT, AT THE NORTHEAST CORNER OF HAVEN AVENUE AND CHURCH STREET IN THE MEDIUM RESIDENTIAL DISTRICT (8-14 DWELLING UNITS PER ACRE) , MD MAKING FINDINGS IN SUPPORT THEREOF - APN: 1077-091-15. A. Recitals. (i) Lewis Hones has filed an application for the approval of Tentative Tract Map No. 13664 as described in the title of this Resolution. Hereinafter in this Resolution, the subject Tentative Tract Map request is referred to as "the application". ( ii) On the 26th of April , 1989, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date . (iii) All legal prerequisites to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined and resolved by the Planning Commission of the City of Rancho Cucamonga as follows : 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission during the above-referenced public hearing on April 26, 1989, including written and oral staff reports, together with public testimony, this Commission hereby specifically finds as follows: (a) The application applies to property located at the northeast corner of Haven Avenue and Church Street with a street frontage of ±1,133 feet and is presently vacant; and (b) The property to the north of the subject site is single family hones, the property to the south of that site consists of Deer Creek Flood Control Channel , the property to the east is single family hones and Deer Creek Channel , and the property to the west is single family hones. 3. Based upon the substantial evidence presented to this Commission during the above-referenced public hearing and upon the specific findings of facts set forth in paragraphs 1 and 2 above, this Commission hereby finds and concludes as follows: PLANNING COMMISSION RESOLUTION NO. 89-57 RE: 7 13664 - LEWIS HOMES April 26 , 1989 Page 2 (a) That tentative tract is consistent with the General Plan, Development Code, and specific plans; and (b) The design or improvements of the tentative tract is consistent with the General Plan, Development Code, and Terra Vista Community Plan; and (c) The site is physically suitable for the type of development proposed; and (d) The design of the subdivision is not likely to cause substantial environmental damage and avoidable injury to humans and wildlife or their habitat; and (e) The tentative tract is not likely to cause serious public health problems; and (f) The design of the tentative tract will not conflict with any easement acquired by the public at large, now of record, for access through or use of the property within the proposed subdivision. 4. This Commission hereby finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and, further, this Commission hereby issues a Negative Declaration. 5. Based upon the findings and conclusions set forth in paragraphs 1 , 2, 3, and 4 above, this Commission hereby approves the application subject to each and every condition set forth below and in the attached Standard Conditions, attached hereto and incorporated herein by this reference. Special Conditions 1) A master plan for the landscaping of the median islands within Church Street from Haven Avenue to Rochester Avenue shall be completed by the developer and approved by the City prior to submittal of the improvement plans to the City for review. 2) Landscaping shall be provided and a separate landscape and irrigation plan per City standards shall be provided, subject to approval of the City Engineer for the following areas: a) Triangular property located at the southeast corner of Haven and Church; and b) Area within the Deer Creek Channel right-of-way at Church Street; and PLANNING COMMISSION RESOLUTION NO. 89-57 RE: TT 13664 - LEWIS HOMES April 26 , 1989 Page 3 c) Median island on Church Street from Haven Avenue to the first street to the east; and d) Parkway area adjacent to Lots 1 and 24 on Haven Avenue. 3) The developer shall submit two final maps to separate the single family development from the condominium development. 4) A right-turn lane shall be constructed from the bus bay northerly to the entrance of the condominium development. The curb return shall be reconstructed at the intersection of Church and Haven Avenue in order to keep traffic, turning right from Church Street, out of the bus bay. Any required modification to the existing traffic signal shall be the responsibility of the developer. 5) The following perimeter landscaped areas are required to be annexed into the landscape maintenance district: a) Church Street median island; and b) Triangular property at the southeast corner of Church and Haven ; and c) Deer Creek Channel right-of-way; and d) Parkway area adjacent to Lots 1 and 24 on Haven Avenue. 6.
