HomeMy WebLinkAbout89-77 - Resolutions RESOLUTION NO. 89-77 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING HOME OCCUPATION PERMIT NO. 89-185 FOR A MULTI-TRACK RECORDING STUDIO LOCATED AT 9292 ARROW ROUTE IN THE LOW DENSITY RESIDENTIAL DISTRICT (2-4 DWELLING UNITS PER ACRE) - APN: 208-361-19, AND MAKING FINDINGS IN SUPPORT THEREOF A. Recitals. (1) Michael Dolan has filed an application for the issuance of the Home Occupation Permit No. 89-185 as described in the title of this Resolution. Hereinafter in this Resolution, the subject Conditional Use Permit request is referred to as "the application". (ii) On the 10th day of May, 1989, and continued on May 24, 1989, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. (iii) All legal prerequisites to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission during the above-referenced public hearing on May 10, 1989, and continued on May 24, 1989, including written and oral staff reports, this Commission hereby specifically finds as follows: (a) The application applies to property located at 9292 Arrow Route with a street frontage of 65 feet and lot depth of 120 feet and is presently improved with a 1 ,300 square foot single family residence; and (b) The property to the north of the subject site is single family residential , the property to the south of that site consists of industrial building, the property to the east is single family residential , and the property to the west is single family residential ; and (c) The application for the Home Occupation Permit contemplates a 200 square foot multi-track recording studio, including 8-track and 2-track recorders,, amplifier, keyboards and other musical instruments, and 75 watt speakers. Further, the application contemplates approximately one individual recording customer per day between the hours of 12:00 noon and 9:00 p.m. PLANNING COMMISSION RESOLUTION NO. 89-77 HOP 89-185 - DOLAN May 24, 1989 Page 2 3. Based upon the substantial evidence presented to this Comnission during the above-referenced public hearing and upon the specific findings of facts set forth in paragraphs 1 and 2 above, this Commission hereby finds and concludes as follows: (a) That the proposed use is in accord with the General Plan, the objectives of the Development Code, and the purposes of the district in which the site is located; and (b) That the proposed use is in accord with the objective of the Development Code and the purposes of the district in which the site is located; and (c) That the proposed use is in compliance with each of the applicable provisions of the Development Code ; and (d) That the proposed use, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity; and 4. Based upon the findings and conclusions set forth in paragraphs 1, 2, and 3 above, this Commission hereby approves the application subject to each and every condition set forth below. (a) Approval of this request shall not waive compliance with any or all sections of the Development Code and all other City Ordinances. (b) Operating hours shall be limited to 12:00 noon to 9:00 p.m. (c) Clients shall be limited to no more than 2 at any given time and only two group sessions per day. (d) If the operation of the facility causes adverse effects upon adjacent residences, including but not limited to noise, the Home Occupation Permit shall be brought before the Planning Commission for the consideration and possible termination of the use. 5. The Secretary to this Commission shall certify to the adoption of this Resolution. APPROVED AND ADOPTED THIS 24TH DAY OF MAY, 1989.
