HomeMy WebLinkAbout89-86 - Resolutions RESOLUTION NO. 89-86 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT 89-12, A REQUEST TO ESTABLISH A CHURCH IN TWO EXISTING BUILDINGS TOTALING 5,116 SQUARE FEET ON 1 .08 ACRES OF LAND, LOCATED AT THE NORTHWEST CORNER OF BOWEN STREET AND BAKER AVENUE IN THE LOW RESIDENTIAL DISTRICT, AND MAKING FINDINGS IN SUPPORT THEREOF - APN: 207-531-31 & 50 A. Recitals . (i) Victory Baptist Church has filed an application for the issuance of the Conditional Use Permit No. 89-12 as described in the title of this Resolution. Hereinafter in this Resolution, the subject Conditional Use Permit request is referred to as "the application". (ii) On the 28th of June, 1989, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. ( iii ) All legal prerequisites to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission during the above-referenced public hearing on June 25, 1989, including written and oral staff reports, together with public testimony, this Commission hereby specifically finds as follows: (a) The application proposes utilizing an existing facility totaling 5,116 square feet located at 8736 Baker Avenue; and (b) The property to the north of the subject site is the Los Amigos Elementary School site, the property to the east, west, and south consists of existing single family residences; and PLANNING COMMISSION RESOLUTION NO. 89-86 RE: CUP 89-12 - VICTORY BAPTIST CHURCH June 28, 1989 Page 2 (c) The application contemplates a joint use of the site which currently contains the Serendipity School day care/preschool which was approved through Conditional Use Permit 87-22; and (d) The applicant proposes to use the facility on Sundays from 9:30 A.M. to 7:00 P.M. on Wednesdays from 7:00 P.M. to 8:30 P.M. , and during times when the Serendipity School is not in session. Serendipity School operates Monday through Friday from 6:00 A.M. to 6:30 P.M. 3. Based upon the substantial evidence presented to this Commission during the above-referenced public hearing and upon the specific findings of facts set forth in paragraphs 1 and 2 above, this Commission hereby finds and concludes as follows: (a) That the proposed use is in accord with the General Plan, the objectives of the Development Code, and the purposes of the district in which the site is located. (b) That the proposed use, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. (c) That the proposed use complies with each of the applicable provisions of the Development Code. 4. This Commission hereby finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and, further, this Commission hereby issues a Negative Declaration. 5. Based upon the findings and conclusions set forth in paragraphs 1, 2, 3, and 4 above, this Commission hereby approves the application subject to each and every condition set forth below and incorporated herein by this reference. Planning Division 1) Any modification, expansion, or other change in operation will require a revision to the Conditional Use Permit. 2) Approval of this request shall not waive compliance with all sections of the Development Code, all other applicable City Ordinances and any community or specific plans in effect at the time of occupancy. PLANNING COMMISSION RESOLUTION NO. 89-86 RE: CUP 89-12 - VICTORY BAPTIST CHURCH June 28, 1989 Page 3 3) All signage proposed for this Conditional Use Permit shall be designed in conformance with the City's Sign Ordinance and shall require review and approval by the Planning Division prior to installation. 4) If the operation of this Conditional Use Permit causes adverse effects to neighboring residences, the Conditional Use Permit shall be brought before the Planning Commission for the consideration and possible termination of the use. 5) Plans for a change of occupancy shall be submitted to and approved by the Foothill Fire Department and Building & Safety Division for their review and approval prior to the issuance of building permits. The plans shall indicate: A. A seating diagram for the sanctuary with the type of seating illustrated. B. The proposed use for each room, including ages of children using each room. 6) The building shall not be occupied by Victory Baptist Church, except for church office activity, until completion of all improvements required by Building and Fire Codes to the satisfaction of the Building & Safety Division and Foothill Fire Protection District. 7) Operating hours shall be limited to weekends and after 7:00 P.M. Monday through Friday. 6. The Secretary to this Commission shall certify to the adoption of this Resolution. APPROVED AND ADOPTED THIS 28TH DAY OF JUNE, 1989.
