HomeMy WebLinkAbout89-145 - Resolutions RESOLUTION NO. 89-145 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, CONDITIONALLY APPROVING TENTATIVE PARCEL MAP NUMBER 12596, LOCATED AT THE NORTHEAST CORNER OF FOOTHILL BOULEVARD AND VINEYARD AVENUE - APN 208-101-21 WHEREAS, Tentative Parcel Map Number 12596, submitted by O'Neil, Adler, Strauss , applicant, for the purpose of subdividing into 4 parcels, the real property situated in the City of Rancho Cucamonga, County of San Bernardino, State of California, identified as APN(s) 208-101-21, located at the northeast corner of Foothill Boulevard and Vineyard Avenue; and WHEREAS, on November 29, 1989, the Planning Commission held a duly advertised public hearing for the above-described map. NOW, THEREFORE, THE RANCHO CUCAMONGA PLANNING COMMISSION RESOLVED AS FOLLOWS: SECTION 1: That the following findings have been made: 1. That the map is consistent with the General Plan. 2. That the improvement of the proposed subdivision is consistent with the General Plan. 3. That the site is physically suitable for the proposed development. 4. That the proposed subdivision and improvements will not cause substantial environmental damage, public health problems or have adverse affects on abutting property. SECTION 2: This Commission finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and , further, this Commission hereby issues a Negative Declaration. SECTION 3: That Tentative Parcel Map No. 12596 is hereby approved subject to the attached Standard Conditions and the following Special Conditions: Special Conditions: 1. All outstanding conditions of approval for CUP 87-26 for public improvements, including , but not limited to: undergrounding of overhead utilities, reconstruction of sidewalk on Foothill Boulevard, and encroachment agreement for the arbor, shall be completed and accepted by the City prior to final Parcel Map approval . The south wall of Building I shall be constructed with a full 1-hour fire resistive rating as per Chapter 5 of the U. B.C. , and all openings within 10 feet of the property line to be labeled 45 minute assemblies to the satisfaction of the Building Official. Any architectural changes to Building I due to fire protection requirements shall be subject to City Planner review and approval prior to final approval of the Parcel Map. 3. Fire protection shall be provided for the Still Building to the satisfaction of the Building Official . 4. The developer shall attempt in good faith to obtain reciprocal driveway access and pedestrian access easements from the easterly adjacent property. In the event that the developer is unable to obtain such easements, the modification to the east property boundary shall be subject to City Planner review and approval .
