HomeMy WebLinkAbout90-01 - Resolutions RESOLUTION NO. 90-01 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT 88-28 FOR THE DEVELOPMENT OF A 5,380 SQUARE FOOT RETAIL BUILDING WITHIN AN EXISTING SHOPPING CENTER LOCATED AT THE SOUTHWEST CORNER OF FOOTHILL BOULEVARD AND MALACHITE AVENUE IN THE COMMUNITY COMMERCIAL DISTRICT - APN: 208-261-20; AND MAKING FINDINGS IN SUPPORT THEREOF A. Recitals. (i ) Mr. Forrest Perry has filed an application for the issuance of the Conditional Use Permit No. 88-28 as described in the title of this Resolution. Hereinafter in this Resolution, the subject Conditional Use Permit request is referred to as "the application." (ii ) On the 14th day of September, 1988, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. (iii ) On the 28th day of September, 1988, the Planning Commission adopted Resolution No. 88-189, denying the project. (iv) On the 28th day of September, 1988, the applicant appealed the Planning Commission 's decision to the City Council . (v) On the 16th day of November, 1988, the City Council directed the applicant to return to the Design Review Committee and the Planning Commission for review and approval . (vi ) On the 10th day of January, 1990, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. (vii ) All legal prerequisites to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. PLANNING COMMISSION RESOLUTION NO. 90-01 CUP 88-28 - PERRY January 10, 1990 Page 2 2. Based upon substantial evidence presented to this Commission during the above-referenced public hearing on January 10, 1990, including written and oral staff reports, together with public testimony, this Commission hereby specifically finds as follows: (a) The application applies to property located at the southwest corner of Foothill Boulevard and Malachite Avenue with a street frontage of 145 feet and is presently vacant; and (b) The property to the north of the subject site is vacant, the property to the south of that site consists of a single family residence, the property to the east is an existing office building, and the property to the west is the existing Perry 's Market Center; and (c) The proposed design of the new retail building together with the upgrade of the existing building would further implement the goals of the Foothill Specific Plan. The new development would set the tone for future redevelopment of the entire center. 3. Based upon the substantial evidence presented to this Commission during the above-referenced public hearing and upon the specific findings of facts set forth in paragraphs 1 and 2 above, this Commission hereby finds and concludes as follows: (a) That the proposed use is in accord with the General Plan, the objectives of the Development Code, and the purposes of the district in which the site is located; and (b) That the proposed use, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity; and (c) That the proposed use complies with each of the applicable provisions of the Development Code and the Foothill Boulevard Specific Plan. 4. This Commission hereby finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and, further, this Commission hereby issues a Negative Declaration. 5. Based upon the findings and conclusions set forth in paragraphs 1, 2, 3, and 4 above, this Commission hereby approves the application subject to each and every condition set forth below and in the attached Standard Conditions attached hereto and incorporated herein by this reference. PLANNING COMMISSION RESOLUTION NO. 90-01 CUP 88-28 - PERRY January 10, 1990 Page 3 Planning Division: 1) Colored concrete shall be used outside the storefronts and shall complement or match the colored concrete column bases. The final design and color of the concrete shall be reviewed and approved by the City Planner, prior to issuance of building permits. 2) The parapet wall atop the rear elevation shall , if necessary, be raised to screen the roof- mounted equipment. 3) Within 6 months of Phase I occupancy release, Phase II (architectural improvements to the storefronts of the building east of Perry 's Market) shall be under construction. The plans for the storefront design, which shall match the new shops built in Phase I, shall be submitted for City Planner review and approval prior to the release of occupancy of Phase I. The plans shall be reviewed with a new Conditional Use Permit application for the entire shopping center. 4) The proposed double bin trash enclosure shall be relocated to the west in conjunction with any development of Perry's Market and/or the vacant corner parcel at the southwest corner of Malachite Avenue and Foothill Boulevard. 5) The existing alley south of the proposed project shall be removed and landscaped to City standards. The final design of the removed alley shall be reviewed and approved by the City Planner with the final landscape construction documents. 6) A uniform hardscape and street furniture treatment, including trash receptacles, free- standing potted plants, bike racks, light bollards, benches, etc. , shall be utilized for the project and shall be designed to be compatible with the architectural style. Detailed designs shall be submitted for City Planner review and approval prior to issuance of building permits. PLANNING COMMISSION RESOLUTION NO. 90-01 CUP 88-28 - PERRY January 10, 1990 Page 4 7) The site shall be developed and maintained in accordance with the approved site plan which includes architectural elevations, exterior materials and colors, landscaping, sign programs, and grading on file with the Planning Division, the conditions contained herein and Development Code regulations. Tree maintenance criteria shall be developed and submitted for review and approval by the City Planner for the project to encourage the natural growth characteristics of the selected tree species. 8) A Uniform Sign Program for the shopping center, including all tenants, shall be designed to be compatible with the architectural style. Variation of sign color shall be minimal . The size of the sign copy shall be visually balanced and proportionate to the building and the architecture style. The Uniform Sign Program shall be reviewed and approved by the Design Review Committee prior to issuance of building permits. 9) Graffiti shall be removed within 72 hours. 10) The entire site shall be kept free of trash and debris at all times, and in no event shall trash and debris remain for more than twenty- four (24) hours. 11) There shall be provision for the following design features in the trash enclosure to the satisfaction of the City Planner: a) Architecturally integrated into the design of the shopping center. b) Separate pedestrian access that does not require opening the main doors to include self-closing pedestrian door. c) Large enough to accommodate two trash bins. d) Roll-up doors. e) Trash bins with counterweighted lids. PLANNING COMMISSION RESOLUTION NO. 90-01 CUP 88-28 - PERRY January 10, 1990 Page 5 f) Architecturally treated overhead shade trellis. g) Chain link screen on top to prevent trash from blowing out of enclosure and designed to be hidden from view. 12) Trash collection shall occur between the hours of 9:00 A.M. and 10:00 P.M. only. 13) All operations and businesses shall be conducted to comply with the following standards, which shall be incorporated into the lease agreements of all tenants: a) Noise Levels. All commercial activities shall not create any noise that would exceed an exterior noise level of 60dBA during the hours of 10:00 P.M. to 7:00 A.M. and 65dBA during the hours of 7:00 A.M. to 10:00 P.M. b) Loading and Unloading. No person shall cause the loading, unloading, opening, closing, or other handling of boxes, crates, containers, building materials, garbage cans, or similar objects between the hours of 10:00 P.M. and 7:00 A.M. , unless otherwise specified herein, in a manner which would cause a noise disturbance to a residential area. 14) Any outdoor vending machines shall be recessed into building faces and shall not extend out into the pedestrian walkways. The design details shall be reviewed and approved by the City Planner. Engineering Division: 1) In-lieu fees as contribution to the future undergrounding of existing overhead utilities (telecommunications and electrical ) shall be paid to the City prior to issuance of building permits. The fee shall be calculated as follows: PLANNING COMMISSION RESOLUTION NO. 90-01 CUP 88-28 - PERRY January 10, 1990 Page 6 a) For utilities on the opposite side of Malachite Avenue, the fee shall be one-half the City adopted unit amount times the length of the project frontage ( 155 feet) ; and b) For utilities on the opposite side of the alley adjacent to the south property line, the fee shall be one half the City adopted unit amount times the length from the center of Malachite Avenue to the west project boundary ( 145 feet) . 2) Existing alley along south property line: a) The developer shall submit a request to vacate the existing alley right-of-way along the south property line prior to the issuance of building permits. b) If the existing service drive ( including the alley) is to be removed and replaced with landscaping, the existing drive approach onto Malachite shall be removed and replaced with City standard curb and gutter and sidewalk . c) If the existing service drive is to remain it shall be reconstructed to convey drainage to Malachite, including a parkway culvert, and the drive approach shall be reconstructed to City commercial standards with a 20-foot minimum width at the street right-of-way line. 6.
