HomeMy WebLinkAbout90-04 - Resolutions RESOLUTION NO. 90-04 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA APPROVING TENTATIVE TRACT MAP NO. 14316, LOCATED WITHIN THE TERRA VISTA PLANNED COMMUNITY IN THE LOW-MEDIUM DENSITY RESIDENTIAL DISTRICT - APN: 227-151- 17, AND MAKING FINDINGS IN SUPPCRT THEREOF A. Recitals . (i) Lewis Homes has filed an application for the approval of Tentative Tract Map No. 14316 as described in the title of this Resolution. Hereinafter in this Resolution, the subject Tentative Tract Map request is referred to as "the application". ( ii) On the 10th day of January, 1990, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. (iii) All legal prerequisites to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined and resolved by the Planning Commission of the City of Rancho Cucamonga as follows : 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2 . Based upon substantial evidence presented to this Commission during the above-referenced public hearing on January 10, 1990, including written and oral staff reports, together with public testimony, this Commission hereby specifically finds as follows: ( a) The application applies to property located at the northwest corner of Rochester Avenue and Church Street with a street frontage of ±500 feet on Rochester Avenue and a lot depth of ±830 feet and is presently unimproved; and ( b) The property to the north of the subject site is vacant, the property to the south of that site is vacant, the property to the east is existing single family detached homes, and the property to the west is vacant. 3. Based upon the substantial evidence presented to this Commission during the above-referenced public hearing and upon the specific findings of facts set forth in paragraphs 1 and 2 above, this Commission hereby finds and concludes as follows: PLANNING COMMISSION RESOLUTION NO. 90-04 RE: TT 14316 - LEWIS HOMES January 10, 1990 Page 2 ( a) That tentative tract is consistent with the General Plan, Development Code, and specific plans ; and ( b) The design or improvements of the tentative tract is consistent with the General Plan, Development Code, and specific plans ; and (c) The site is physically suitable for the type of development proposed; and ( d) The design of the subdivision is not likely to cause substantial environmental damage and avoidable injury to humans and wildlife or their habitat; and ( e) The tentative tract is not likely to cause serious public health problems ; and ( f) The design of the tentative tract will not conflict with any easement acquired by the public at large, now of record, for access through or use of the property within the proposed subdivision. 4. This Commission hereby finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and, further, this Commission hereby issues a Negative Declaration. 5. Based upon the findings and conclusions set forth in paragraphs 1, 2, 3, and 4 above, this Commission hereby approves the application subject to each and every condition set forth below and in the attached Standard Conditions , attached hereto and incorporated herein by this reference. Planning Division: 1) Prior to recordation of the final map or the issuance of building permits, whichever comes first, the applicant— shall consent to, or participate in, the establishment of a Mello- Roos Community Facilities District pertaining to the project site to provide in conjunction with the applicable school district for the construction and maintenance of necessary school facilities. However, if any school district has previously established such a Community Facilities District, the applicant shall , in the alternative, consent to the annexation of the project site into the territory of such existing district prior to the recordation of the final map or the issuance of building permits, whichever comes first. PLANNING COMMISSION RESOLUTION NO. 90-04 RE: TT 14316 - LEWIS HOMES January 10, 1990 Page 3 Further, if the affected school district has not formed a Mello-Roos Community Facilities District within twelve months of the date of approval of the project and prior to the recordation of the final map or issuance of building permits for said project, this condition shall be deemed null and void. Engineering Division: 1) An in-lieu fee as contribution to the future undergrounding of the existing overhead utilities ( teleconmunication and electrical except for the 66KV electrical) on the opposite side of Rochester Avenue shall be paid to the City prior to approval of the final map. The fee shall be one half the City adopted unit amount times the length from the center of Church Street to the north project boundary. 2) Provide easements for full width dedication for Rochester Avenue and construct full width from Church Street to Base Line Road. Sidewalk, street lights and parkway landscaping may be deferred until development of the adjacent property. 3) Church Street shall be constructed full width from Rochester Avenue to Terra Vista Parkway including the landscaped median island and improvements of the intersection of Terra Vista and Church. 4) Street "A" shall be constructed full width . Parkway improvements on the west side may be deferred until development of the adjacent property. 5) The following storm drain facilities shall be constructed prior to occupancy: a) Storm Drain Line 5-3 from Terra Vista Parkway to the La Mission Park basin. b) La Mission Park basin located at the northwest corner of Church Street and Elm Avenue. PLANNING COMMISSION RESOLUTION NO. 90-04 RE: TT 14316 - LEWIS HOMES January 10, 1990 Page 4 c) Storm Drain Line No. 1 from La Mission Park basin to the Deer Creek Channel . 6) The developer's engineer shall obtain or provide the necessary engineering information to forward to FEMA in order to have the site removed from the flood plain. This information shall consist of copies of the plans of flood facilities now under construction, and the hydrologic/hydraulic calculation put into the format acceptable to FEMA. Include all areas within Terra Vista Community that are eligible for removal from the flood plain . 7) Secondary access shall be provided for the project by extending either Terra Vista Parkway or Church Street full width to meet the existing improvements to the west. Off-site parkway improvements may be deferred until development of the adjacent property. 8) A median opening will not be allowed within Church Street at "A" Street, because there is not sufficient distance to allow for proper landscaping within the median. 9) The developer shall provide a guarantee that the construction of Base Line Road and the related storm drain will be completed to provide drainage protection for this project. This can be in the form of a rider to the bonds submitted for the project. 10) The cross gutters within Church Street at Rochester Avenue (both the proposed and the existing on the east side) shall be eliminated and replaced with a catch basin and storm drain system compatible with the future Master Plan Line No. 6-1. 11) The developer shall dedicate sufficient street right-of-way along Rochester Avenue at the Foothill Boulevard intersection to enable the construction of the proposed City intersection improvement project. 12) Perimeter walls shall not encroach into the public right-of-way. The pavers shall be constructed to the satisfaction of the City Engineer. 6. The Deputy Secretary to this Commission shall certify to the adoption of this Resolution.
