HomeMy WebLinkAbout90-20 - Resolutions RESOLUTION NO. 90-20 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING DESIGN REVIEW FOR TRACT NO. 13717, AND RELATED TREE REMOVAL PERMIT 89-70, FOR THE DEVELOPMENT OF 394 CONDOMINIUMS LOCATED WITHIN THE TERRA VISTA PLANNED COMMUNITY ON THE NORTHEAST CORNER OF CHURCH STREET AND SPRUCE AVENUE IN THE MEDIUM-HIGH RESIDENTIAL DISTRICT AND MAKING FINDINGS IN SUPPORT THEREOF - APN: 1077-421-13 A. Recitals. ( i ) Lewis Homes has filed an application for the Design Review of Tract No. 13717 as described in the title of this Resolution. Hereinafter, the subject Design Review request is referred to as "the application" . ( ii) On February 14 , 1990, the Planning Commission of the City of Rancho Cucamonga held a meeting to consider the application. ( iii ) All legal prerequisites to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found , determined and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1 . This Commission hereby specifically finds that all of the facts set forth in the Recitals , Part A, of this Resolution are true and correct. 2 . Based upon substantial evidence presented to this Commission during the above-referenced meeting on February 14 , 1990, including written and oral staff reports, this Commission hereby specifically finds as follows : 1 ) That the proposed project is consistent with the objectives of the General Plan; and 2) That the proposed design is in accord with the objective of the Development Code and the purposes of the district in which the site is located ; and 3) That the proposed design is in compliance with each of the applicable provisions of the Development Code and Terra Vista Community Plan; and PLANNING COMMISSION RESOLUTION NO. 90-20 DR FOR TT 13717 - WESTERN PROPERTIES February 14 , 1990 Page 2 4) That the proposed design, together with the conditions applicable thereto, will not be detrimental to the public health, safety or welfare, or materially injurious to properties or improvements in the vicinity. 3. Based upon the findings and conclusions set forth in paragraphs 1 and 2 above, this Commission hereby approves the application subject to each and every condition set forth below and in the attached Standard Conditions, attached hereto and incorporated herein by this reference. 1) A colored , scored concrete apron shall be provided outside the garages. A second natural concrete band which may be used as a gutter in some locations shall also be provided adjacent to the colored , scored concrete apron. The design details shall be shown on the construction documents and be reviewed and approved by the City Planner. 2) A minimum two foot wide clear planter area shall be provided between the low screen walls and the curb edge of the drive aisles. 3) The enhanced paving at all project entries shall be extended the full length of the entry drive aisle. The paving details shall be shown on the construction documents and shall be reviewed and approved by the City Planner. 4) Additional tree plantings shall be provided outside all street facing patios. The additional trees shall be shown on the landscape construction documents and reviewed and approved by the City Planner. 5) Gas meters and/or any other utility fixtures shall be screened from view with low walls , berming, and/or landscaping. These fixtures may also be enclosed within outdoor storage areas if possible. 6) The project shall be constructed consistent with the preliminary acoustical studies. A final acoustical study shall be prepared and submitted for review prior to issuance of building permits. The study shall address the noise along both Spruce Avenue and Church Street and shall identify mitigation measures to be incorporated into the final project design. 7) The project perimeter wall between La Mission Park and Tentative Tract 13717 shall be constructed in conjunction with the La Mission Park improvements to avoid destruction of the park improvements should the park be completed prior to construction of Tract 13717. PLANNING COMMISSION RESOLUTION NO. 90-20 DR FOR TT 13717 - WESTERN PROPERTIES February 14, 1990 Page 3 8) Tree Removal Permit No. 89-70 is hereby approved subject to the following: a. The 12 Eucalyptus trees shall be removed and replaced on-site on a one-to-one basis with minimum 15 gallon size Eucalyptus maculata (Spotted Gum) prior to occupancy. b. The 33 Olive trees shall be preserved as follows: i . Minimum of twelve (12) boxed trees shall be planted within the adjoining La Mission Park. ii . Remainder of trees shall be transplanted elsewhere on-site, prior to occupancy. iii . The applicant shall be responsible for the protection of transplanted trees, including, but not limited to, installing appropriate construction barriers , securing the trees against vandalism or theft, watering or any other measures necessary for maintaining their continued health and growth. Replanting of trees shall be done to reflect the grove planting. c. The transplanted tree locations and replacement tree locations shall be clearly delineated on the detailed landscape plans and grading plan prior to issuance of any permits. 4. The Secretary to this Commission shall certify to the adoption of this Resolution. APPROVED AND ADOPTED THIS 14TH DAY OF FEBRUARY, 1990.
