HomeMy WebLinkAbout90-24 - Resolutions RESOLUTION NO. 90-24 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, FINDING THAT A PROPOSED DISPOSITION OF FEE TITLE TO A CERTAIN PROPERTY LOCATED AT THE NORTHWEST CORNER OF 8TH STREET AND BAKER AVENUE IS IN CONFORMANCE WITH THE GENERAL PLAN, AND MAKING FINDINGS IN SUPPORT THEREOF - APN: 207-541-60 A. Recitals (i) California Government Code Section 65402(a) provides, in pertinent part, as follows : "(a) If a general plan or part thereof has been adopted, . . . no real property shall be acquired . . . (or) disposed of, . if the adopted general plan or part thereof applies thereto, until the location, purpose and extent of such acquisition or disposition , . has been submitted to and reported upon by the planning agency as to conformity with said adopted general plan or part thereof . . . " ( ii ) The City of Rancho Cucamonga proposes to dispose of fee title to those certain parcels of real property described in Exhibits "A" and "B", attached hereto, and incorporated herein by this reference. ( iii ) This Commission has reviewed the location, purpose, and extent of the proposed actions heretofore described as to the conformity of said actions with the General Plan of the City of Rancho Cucamonga. B. Resolution NOW, THEREFORE, be it found, determined and resolved as follows : 1. In all respects as set forth in the Recitals, Part A, of this Resolution . 2. This Commission hereby finds that the actions described in this Resolution proposed to be taken by the City of Rancho Cucamonga ( "said proposed actions" hereinafter) conform to the General Plan of the City of Rancho Cucamonga . 3. This Commission hereby finds that said proposed actions are categorically exempt from environmental review under the California Environmental Quality Act of 1970, as amended, pursuant to the provisions of Section 15312 of Division 6 of Title 14 of the California Administrative Code. 4. This Resolution shall constitute the report with respect to said proposed actions required to be rendered under Government Code Section 65402(a) . The Secretary of this Commission shall : (a) Certify to the adoption of this Resolution ; and (b) Forthwith transmit a copy of this Resolution to the Council of the City of Rancho Cucamonga APPROVED AND ADOPTED THIS 28TH DAY OF FEBRUARY, 1990. Land is described as follows: Lot 30, Cucamonga Fruit Lands, lying south of that portion conveyed to Atchison, Topeka and Sante Fe Railroad Companies, formerly the San Bernardino and Los Angeles Railroad Company, in Section 9, Township 1 south, Range 7 west, San Bernardino Base and Meridian in the City of Rancho Cucamonga, in the County of San Bernardino, State of California, as per plat recorded in book 4 of Maps, page 9, records of said County.
