HomeMy WebLinkAbout90-38 - Resolutions RESOLUTION NO. 90-38 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, CONDITIONALLY APPROVING VESTING TENTATIVE PARCEL MAP NUMBER 12781 , LOCATED AT THE SOUTHWEST CORNER OF JERSEY BOULEVARD AND ROCHESTER AVENUE - APN 229-111-07 , AND MAKING FINDINGS IN SUPPORT THEREOF WHEREAS, Vesting Tentative Parcel Map Number 12781 , submitted by Delgar Partners , applicant, for the purpose of subdividing into 3 parcels, the real property situated in the City of Rancho Cucamonga, County of San Bernardino, State of California , identified as APN 229-111-07 located at the southwest corner of Jersey Boulevard and Rochester Avenue; and WHEREAS, on March 28, 1990, the Planning Commission held a duly advertised public hearing for the above-described map. NOW, THEREFORE, THE RANCHO CUCAMONGA PLANNING COMMISSION RESOLVED AS FOLLOWS: SECTION 1 : That the following findings have been made: 1. That the map is consistent with the General Plan. 2. That the improvement of the proposed subdivision is consistent with the General Plan. 3. That the site is physically suitable for the proposed development. 4 . That the proposed subdivision and improvements will not cause substantial environmental damage or public health problems or have adverse affects on abutting property. SECTION 2 : This Commission finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and , further, this Commission hereby issues a Negative Declaration. SECTION 3: That Vesting Tentative Parcel Map No. 12781 is hereby approved subject to the attached Standard Conditions and the following Special Conditions: 1 . The existing overhead utilities (telecommunications) on the project side of Rochester Avenue shall be undergrounded from the first pole on the north side of Jersey Boulevard to the first pole off-site south PLANNING COMMISSION RESOLUTION NO. 90-38 VESTING TENTATIVE PARCEL MAP 12781 - DELGAR MARCH 28, 1990 PAGE 2 of the project south boundary, prior to public improvement acceptance or occupancy, whichever occurs first. In addition, an in-lieu fee as contribution to the undergrounding of the utilities on the opposite side of Rochester Avenue shall be paid to the City prior to issuance of building permits. The fee shall be one-half the difference between the undergrounding cost of the utilities (electrical ) on the opposite side of the street minus those (telecommunications) on the project side times the length from the center of Jersey Boulevard to the south project boundary. 2 . Construct Boston Place full curb-to-curb width, including street lights, from the intersection with Jersey Boulevard south to complete the cul-de-sac bulb. The Developer may request a reimbursement agreement to recover the cost of off-site improvements from adjacent property upon its development. If portions of these improvements are constructed by others , this developer shall honor any reimbursement agreements applicable to the project frontage. 3. Install storm drainage facilities as determined by the final drainage study approved by the City Engineer. 4. Easements for on-site drainage retention areas shall be delineated and inundation rights dedicated on the Final Parcel Map. The retention areas shall be designed to limit the maximum ponding depth to 12 inches and 18 inches in parking and maneuvering areas for automobiles and trucks , respectively. In no case shall the ponding depth exceed 6 inches for more than 4 hours. No public water shall be tributary directly to the on-site retention areas. 5. The portion of the project along Rochester Avenue is located in a Flood Zone A; therefore, flood protection measures shall be provided upon development as certified by a Registered Civil Engineer and approved by the City Engineer.
