HomeMy WebLinkAbout90-39 - Resolutions RESOLUTION NO. 90-39 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, CONDITIONALLY APPROVING TENTATIVE PARCEL MAP NUMBER 12756, LOCATED AT THE WEST SIDE OF HAVEN AVENUE AND NORTH OF FOOTHILL BOULEVARD - APN 1177-401-29 , AND MAKING FINDINGS IN SUPPORT THEREOF WHEREAS , Tentative Parcel Map Number 12756, submitted by Leiserv, Inc. , applicant, for the purpose of subdividing into 2 parcels, the real property situated in the City of Rancho Cucamonga, County of San Bernardino, State of California, identified as APN(s) 1177-401-29, located at the west side of Haven Avenue and north of Foothill Boulevard; and WHEREAS, on March 28, 1990, the Planning Commission held a duly advertised public hearing for the above-described map. NOW, THEREFORE , THE RANCHO CUCAMONGA PLANNING COMMISSION RESOLVED AS FOLLOWS : SECTION 1 : That the following findings have been made: 1. That the map is consistent with the General Plan. 2. That the improvement of the proposed subdivision is consistent with the General Plan. 3. That the site is physically suitable for the proposed development. 4. That the proposed subdivision and improvements will not cause substantial environmental damage or public health problems or have adverse affects on abutting property. SECTION 2 : This Commission finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and, further, this Commission hereby issues a Negative Declaration. SECTION 3 : That Tentative Parcel Map No. 12756 is hereby approved subject to the attached Standard Conditions and the following Special Conditions: 1 . In order to provide equivalent fire protection of openings along the newly established property lines, the following shall be provided: (a) Verification of one-hour fire resistive construction of canopy at the retail center to a distance equal to the depth of the canopy beyond the northern-most property line adjacent; to be completed prior to recordation of the Final Map. MARCH 28, 1990 PAGE 2 (b) Install an approved fire sprinkler system along the canopy as outlined in item (a) above. (c) Record the amended CC&R' s, as preliminarily approved by the Building and Safety Division, concurrent with the map. A copy of the recorded document shall be provided to Building and Safety Division immediately thereafter. 2. Record a reciprocal parking agreement concurrent with the map. 3. An in-lieu fee as contribution to the future undergrounding of the existing overhead utilities (electrical , except for the 66 KV electrical ) on the opposite side of Haven Avenue shall be paid to the City prior to the approval of the final parcel map. The fee shall be one-half the difference between the undergrounding cost of the utilities (electrical ) on the opposite side of the street minus those (recently undergrounded telecommunication) on the project side times the length of the project frontage (approximately 446 feet) .
