HomeMy WebLinkAbout90-49 - Resolutions RESOLUTION NO. 90-49 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT NO. 89-26 TO EXPAND THE COMMUNITY BAPTIST CHURCH OF ALTA LOMA, LOCATED AT 9090 19TH STREET IN THE MEDIUM RESIDENTIAL DISTRICT, AND MAKING FINDINGS IN SUPPORT THEREOF - APN: 201-221 -08. A. Recitals. (i ) The Community Baptist Church of Alta Loma , has filed an application for the issuance of the Conditional Use Permit No . 89-26 as described in the title of this Resolution. Hereinafter in this Resolution, the subject Conditional Use Permit request is referred to as "the application." ( ii) On the 25th day of April , 1990, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. ( iii ) All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution . NOW, THEREFORE, it is hereby found, determined, and resolved by the Planning Commission of the City of Rancho Cucamonga as follows : 1 . This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2 . Based upon substantial evidence presented to this Commission during the above-referenced public hearing on April 25 , 1990, including written and oral staff reports , together with public testimony, this Commission hereby specifically finds as follows : (a) The application applies to property located at 9090 19th Street with a street frontage of 330 feet and a lot depth of 654 feet and is presently improved with a 10,500 square foot sanctuary; and (b) The property to the north of the subject site is the Foothill Freeway right-of-way; the property to the south of that site consists of Single Family Residential and Vacant, Low Residential ; the property to the east is Single Family Residential , and the property to the west is apartments. 3. Based upon the substantial evidence presented to this Commission during the above-referenced public hearing and upon the specific findings of facts set forth in paragraphs 1 and 2 above, this Commission hereby finds and concludes as follows : PLANNING COMMISSION RESOLUTION NO. 90-49 CUP 89-26 - COMMUNITY BAPTIST CHURCH April 25 , 1990 Page 2 (a) That the proposed use is in accord with the General Plan, the objectives of the Development Code, and the purposes of the district in which the site is located . (b) That the proposed use, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. (c) That the proposed use complies with each of the applicable provisions of the Development Code. 4. This Commission hereby finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and , further, this Commission hereby issues a Negative Declaration. 5 . Based upon the findings and conclusions set forth in paragraphs I , 2, 3 , and 4 above, this Commission hereby approves the application subject to each and every condition set forth below and in the attached Standard Conditions, attached hereto and incorporated herein by this reference: Planning Division : 1 . Any modification, expansion, or other change in operation will require a revision to the Conditional Use Permit. 2. Approval of this request shall not waive compliance with all sections of the Development Code and all other applicable City Ordinances in effect at the time of occupancy. 3. Any day care services to be provided by the Church will require an amendment to this Conditional Use Permit and compliance with State Licensing Regulations. 4. The northern-most driveway approach on Beryl Street shall be reconstructed as follows : a . Delete the island planter. b. Reconstruct the southerly portion of the drive approach to the north. c . Provide a standard 35-foot minimum drive approach. d. Reduce the amount of enhanced pavement to include the driveway throat only. PLANNING COMMISSION RESOLUTION NO. CUP 89-26 - COMMUNITY BAPTIST CHURCH April 25, 1990 Page 3 5. Enhanced pavement shall be colored concrete with a textured, washed finish. The color shall be approved by staff and must be an integral part of the mixture. Provide a test panel for approval by the Planning staff in the field. 6. Provide a screed at the base of the 45-degree cornice detail to create a smooth transition between the two stucco colors. 7. The temporary trailers shall be permitted until such time as Phase One is completed or two years , whichever comes first. A deposit or letter of credit to cover the cost to remove the trailers and restore the site shall be paid to the City prior to the issuance of building permits, to insure the timely compliance with this condition. The deposit shall have a cash value of not less than $5,000. In addition, a right of entry, granted to the City of Rancho Cucamonga , shall be filed with the Planning Division prior to issuance of building permits. 8. All existing landscaped areas shall be healthy and thriving at the time of occupancy of Phase One. All dead, damaged, diseased, or decaying plant material shall be replaced per the approved landscape plan prior to receiving occupancy of the new structure. Engineering Division: 1 . The most northerly drive approach on Beryl Avenue shall be reduced in width to 35 feet at the property line and the center median island removed. The street improvement plans shall be revised to the satisfaction of the City Engineer prior to the issuance of building permits. 2. A construction permit shall be obtained and a surety posted prior to work being performed in the public right-of-way. 6. The Secretary to this Commission shall certify to the adoption of this Resolution.
