HomeMy WebLinkAbout90-101 - Resolutions RESOLUTION NO. 90-101 A RESOLUTION OF THE PLANNING COMMISSION OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING THE REVISION TO TREE REMOVAL PERMIT 88-11 ASSOCIATED WITH CONDITIONAL USE PERMIT 88-01 AND TENTATIVE TRACT 13886, LOCATED AT THE NORTHWEST CORNER OF ETIWANDA AVENUE AND BASE LINE ROAD, AND MAKING FINDINGS IN SUPPORT THEREOF - APN: 227-522-01 , 02, 03 AND 04. A. Recitals. ( i ) BCER Architects has filed an application for the revision of Tree Removal Permit 88-11 as described in the title of this Resolution. Hereinafter in this Resolution, the subject revision is referred to as "the application." (ii ) On July 25 and continued to August 8, 1990, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application. (iii ) All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined, and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1 . This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission during the above-referenced public hearings on July 25 and August 8, 1990, including written and oral staff reports, together with public testimony, this Commission hereby specifically finds as follows: (a) The application applies to property located at the northwest corner of Base Line Road and Etiwanda Avenue with a street frontage of 637 feet along Base Line Road and 634 feet along Etiwanda Avenue and is vacant; and • (b) A mixed use development project has been approved for the subject site. (c) The proposed revision to Tree Removal Permit 88-11 with conditions is consistent with Rancho Cucamonga Code Chapter 19.08 (Tree Preservation Ordinance) . (d) The proposed revision to Tree Removal Permit 88-11 with conditions is consistent with the Etiwanda Specific Plan, (particularly Figures 5-13, 5-25 and 5-26) . Based upon the substantial evidence presented to this Commission during the above-referenced public hearing and upon the specific findings of facts set forth in paragraphs 1 and 2 above, this Commission hereby finds and concludes as follows: (a) That the proposed revision to Tree Removal Permit 88-11 is in accord with the General Plan, the objectives of the Etiwanda Specific Plan, and the purposes of the district in which the site is located. (b) That the proposed revision, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. (c) That the proposed revision complies with each of the applicable provisions of the Etiwanda Specific Plan. 4. Based upon the findings and conclusions set forth in paragraphs 1 , 2, and 3 above, this Commission hereby approves the revision subject to each and every condition set forth below: 1. The following six trees shall be transplanted on site: Washingtonia robusta #2 , #3, #4, #5, and #6 and Washingtonia filifera #10. 2. The following trees shall be preserved in place : Schinus molle #11 and #18 and Washingtonia filifera #13, #14, and #15 . 3. All trees to be preserved in place shall be protected during grading and construction per Rancho Cucamonga Municipal Code Section 19.08.110. Protection shall be accomplished prior to issuance of building permits. 4. Schinus molle #17 shall be replaced with a 96-inch box Schinus molle and shall be located somewhere along the Etiwanda Avenue frontage. The precise location shall be determined in the landscape plan. 5. Eucalyptus species #1 shall be replaced with one 15-gallon Eucalyptus maculata (Spotted Gum) . 6. Ailanthus altissima #7 shall be replaced with one 24-inch box tree. The species may be chosen by the applicant to better fit in with the proposed landscape plan. 7. Cedrus atlantica #8 and #9 shall be replaced with two 96-inch box trees. The species may be chosen by the cant to better fit in with the proposed landscape P plan. PLANNING COMMISSION RESOLUTION NO. 90-101 REVISION TO TRP 88-11 - BCER ARCHITECTS August 8, 1990 Page 3 8. Platanus racemosa #16 shall be replaced with a 96-inch box tree. The species may be chosen by the developer to better fit in with the proposed landscape plan. 9. All replacement trees, relocated trees, and preserved trees shall be clearly delineated on the landscape plan which shall be reviewed and approved by the City Planner prior to the issuance of any Grading or Building Permits. 10. Relocation of existing trees and replanting of the 96-inch box Schinus molle shall be supervised by a qualified arborist. 11. The approval of this revision to Tree Removal Permit 88-11 shall not become effective until building permits are issued for Conditional Use Permit 88-01. No trees shall be removed or transplanted until building permits are issued. 5. The Secretary to this Commission shall certify to the adoption of this Resolution.
