HomeMy WebLinkAbout90-160 - Resolutions RESOLUTION NO. 90-160 A RESOLUTION OF THE RANCHO CUCAMONGA PLANNING COMMISSION APPROVING CONDITIONAL USE PERMIT NO. 88-47 FOR THE DEVELOPMENT OF A NEIGHBORHOOD SHOPPING CENTER CONSISTING OF TWO RETAIL BUILDINGS TOTALING 25,665 SQUARE FEET ON 2.7 ACRES OF LAND IN THE COMMUNITY COMMERCIAL DISTRICT OF THE FOOTHILL BOULEVARD SPECIFIC PLAN (SUBAREA 2) , LOCATED AT THE NORTHEAST CORNER OF FOOTHILL BOULEVARD AND LION STREET - APN: 208-632-47 . A. Recitals. (i ) Mark Kaufman has filed an application for the issuance of the Conditional Use Permit No. 88-47 as described in the title of this Resolution. Hereinafter in this Resolution, the subject Conditional Use Permit request is referred to as "the application." (ii ) On the 12th of December 1990, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. (iii ) All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined, and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission during the above-referenced public hearing on December 12, 1990, including written and oral staff reports, together with public testimony, this Commission hereby specifically finds as follows: (a) The application applies to property located at 9224 Foothill Boulevard with a street frontage of 408 feet and lot depth of 290 feet and is presently improved with a single story commercial structure; and (b) The property to the north of the subject site is single family residential , Low Residential (2-4 dwelling units per acre) ; the property to the south of that site consists of multi-family residential , Foothill Boulevard Specific Plan, Medium-High Residential Commercial ; and the property to the west is retail , Foothill Boulevard Specific Plan, Community Commercial . Based upon the substantial evidence presented to this Commission during the above-referenced public hearing and upon the specific findings of facts set forth in paragraphs 1 and 2 above, this Commission hereby finds and concludes as follows: (a) That the proposed use is in accord with the General Plan, the objectives of the Development Code, and the purposes of the district in which the site is located. (b) That the proposed use, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. (c) That the proposed use complies with each of the applicable provisions of the Development Code. 4. This Commission hereby finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and, further, this Commission hereby issues a Negative Declaration. 5. Based upon the findings and conclusions set forth in paragraphs 1, 2, 3, and 4 above, this Commission hereby approves the application subject to each and every condition set forth below and in the Standard Conditions attached hereto and incorporated herein by this reference. 1) Redesign the plaza/fountain area to have a more open inviting feeling, less disruptive to pedestrian traffic through the center. The design of the plaza should come back to the Design Review Committee for approval prior to issuance of building permits. 2) The circular pre-cast molding should be adequate in size and relief to compete with the quatrefoils. 3) The lighting fixture design shall complement the architectural program. It shall include the plaza area lighting fixtures, building lighting fixtures (exterior), and parking lot lighting fixtures. Also, decorative light fixtures should be used along the rear of the building to encourage the use of the rear parking area. PLANNING COMMISSION RESOLUTION NO. 90-160 CONDITIONAL USE PERMIT 88-47 - WALD INVESTMENT December 12, 1990 Page 3 4) The Foothill Boulevard street tree, "Rhus lancea", (African sumac) shall be planted behind the sight lines roughly 25 feet on center interspaced with the London plane trees. 5) Existing trees are to be preserved or transplanted per the recommendations of the Arborist Report on file with the Planning Division. 6) The project shall meet all the requirements of the City' s adopted Xeriscape Ordinance. Details shall be provided on the final landscape plan. 7) Tree maintenance criteria shall be developed and submitted for review and approval by the City Planner for the project to encourage the natural growth characteristics of the selected tree species. 8) Any outdoor vending machines shall be recessed into building faces and shall not extend out into the pedestrian walkways. The design details shall be reviewed and approved by the City Planner. 9) There shall be provision for the following design features in the trash enclosures to the satisfaction of the City Planner: a) Architecturally integrated into the design of the shopping center. b) Separate pedestrian access that does not require opening the main doors to include self-closing pedestrian door. c) Large enough to accommodate two trash bins. d) Roll-up doors. e) Trash bins with counterweighted lids. f) Architecturally treated overhead shade trellis. g) Chain link screen on top to prevent trash from blowing out of enclosure and designed to be hidden from view. PLANNING COMMISSION RESOLUTION NO. 90-160 CONDITIONAL USE PERMIT 88-47 - WALD INVESTMENT December 12, 1990 Page 4 10) Trash collection shall occur between the hours of 9:00 a.m. and 10:00 p.m. only. 11) Graffiti shall be removed within 72 hours . 12) The entire site shall be kept free of trash and debris at all times, and in no event shall trash and debris remain for more than 24 hours. 13) All operations and businesses shall be conducted to comply with the following standards, which shall be incorporated into the lease agreement of all tenants: a) Noise levels. All commercial activities shall not create any noise that would exceed an exterior noise level of 60dBA during the hours of 10:00 p.m. to 7 :00 a.m. b) Loading and Unloading. No person shall cause the loading, unloading, opening, closing, or other handling of boxes, crates, containers, building materials, garbage cans, or similar objects between the hours of 10 :00 p.m. and 7 :00 a.m., unless otherwise specified herein, in a manner which would cause a noise disturbance to a residential area. 14) The site shall be developed and maintained in accordance with the approved site plan which includes architectural elevations, exterior materials and colors, landscaping, sign programs, grading on file with the Planning Division, the conditions contained herein, Development Code regulations, and the Foothill Boulevard Specific Plan. Engineering Division: 1) If the Public Safety Commission, upon its review of the temporary measures, finds a permanent narrowing of Lion Street is warranted, such permanent narrowing shall be installed, to the satisfaction of the City Traffic Engineer, to make one way operation more effective. PLANNING COMMISSION RESOLUTION N0. 90-160 CONDITIONAL USE PERMIT 88-47 - WALD INVESTMENT December 12, 1990 Page 5 2) Reconstruct the existing catch basin and storm drain lateral in Foothill Boulevard as determined by the Final Drainage Study. 3) An in-lieu fee as contribution to the future construction of the median island within Foothill Boulevard shall be paid to the City prior to the issuance of building permits. The amount of the fee shall be one half the cost of the median times the length of the project frontage from a projection of the easterly right-of-way line for Lion Street to the east project boundary. 4) Install a traffic signal at the Foothill Boulevard/Lion Street intersection. A signal warrant study shall be submitted to Caltrans with the permit application. The developer shall request Caltrans reimbursement for 50 percent of the signal cost. a) If Caltrans agrees to fund half of the signal costs, then the developer shall receive Systems Fee credit for 25 percent of the total costs, if City Council agrees; or b) If Caltrans refuses to participate, the developer shall receive Systems Fee Credit and reimbursement for 75 percent of the signal costs, if City Council agrees. 5) Landscaping within the lines of sight for the Foothill/Lion intersection and the proposed driveway on Lion Street, shall be approved by the City Traffic Engineer. 6) Obtain an easement from the property owner to the east for the construction and maintenance of a private storm drain connection to the public catch basin in Foothill Boulevard. 7) Install "No Stopping Any Time" signs along the Lion Street and Foothill Boulevard frontages. 8) Street trees shall be installed per Engineering Standards and are subject to approval of the City Engineer. 9) Foothill Boulevard landscaping shall conform to the Foothill Boulevard Specific Plan.
