HomeMy WebLinkAbout90-144 - Resolutions RESOLUTION NO. 90-144 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, CONDITIONALLY APPROVING TENTATIVE PARCEL MAP NUMBER 13075, LOCATED AT THE WEST SIDE OF HELLMAN AVENUE AND SOUTH OF 19TH STREET AND MAKING FINDINGS IN SUPPORT THEREOF - APN: 202-041-30 WHEREAS, Tentative Parcel Map Number 13075, submitted by William Perry Roofing, applicant, for the purpose of subdividing into 2 parcels, the real property situated in the City of Rancho Cucamonga, County of San Bernardino, State of California, identified as APN(s) 202-041-30, located at the west side of Hellman Avenue and south of 19th Street; and WHEREAS, on November 14, 1990, the Planning Commission held a duly advertised public hearing for the above-described map. NOW, THEREFORE, THE RANCHO CUCAMONGA PLANNING COMMISSION RESOLVES AS FOLLOWS: SECTION 1: That the following findings have been made: 1. That the map is consistent with the General Plan. 2. That the improvement of the proposed subdivision is consistent with the General Plan. 3. That the site is physically suitable for the proposed development. 4. That the proposed subdivision and improvements will not cause substantial environmental damage or public health problems or have adverse affects on abutting properties. SECTION 2: This Commission finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970; and further, this Commission hereby issues a Negative Declaration. SECTION 3: Tentative Parcel Map Number 13075 is hereby approved subject to the attached Standard Conditions and the following Special Conditions: 1. An in-lieu fee as contribution to the future undergrounding of the existing overhead utilities (telecommunication and electrical ) on the opposite side of Hellman Avenue shall be paid to the City prior to approval of the final map. The fee shall be one-half the City adopted unit amount times the length of the project frontage. A request to vacate the excess City storm drainage easement adjacent on both sides of the Beryl-Hellman channel access roads shall be submitted and approved prior to approval of the final map. 3. Prior to approval of the Final Parcel Map, the property owner shall make a good faith effort to negotiate with the adjacent property owner on the west side of the City storm drain channel to transfer Parcel "A" to said property owner. If the property owner is unsuccessful in accomplishing the transfer of Parcel "A" to the property to the west, Parcel "A" shall not be a separate parcel but shall be a portion of Parcel 1. In addition, a bridge designed to the satisfaction of the City Engineer shall be constructed across the channel to provide access to the portion of Parcel 1 on the west side of the channel . 4. All drainage improvements per conceptual grading plan shall be installed prior to recordation of the final map. APPROVED AND ADOPTED THIS 14th DAY OF NOVEMBER, 1990.
