HomeMy WebLinkAbout91-06 - Resolutions RESOLUTION NO. 91-06 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, RECOMMENDING APPROVAL OF ENVIRONMENT ASSESSMENT AND GENERAL PLAN AMENDMENT 91-01B , REQUESTING TO AMEND THE CIRCULATION PLAN OF THE GENERAL PLAN, TO DELETE COLLECTOR STATUS OF BANYAN STREET BETWEEN ARCHIBALD AVENUE AND HAVEN AVENUE . A. Recitals. (i ) The City of Rancho Cucamonga has filed an application for General Plan Amendment No. 91-01B as described in the title of this Resolution. Hereinafter in this Resolution, the subject General Plan Amendment is referred to as "The Application". (ii ) On January 9, 1991, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application. (iii ) All legal prerequisites to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1 . This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part "A" , of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission during the above-referenced public hearing on January 9, 1991, including written and oral staff reports, together with public testimony, this Commission hereby specifically finds as follows: a) Banyan Street is designated as a collector street in the General Plan, but only functions as a local residential between Haven Avenue and Archibald Avenue. b) The present function of Banyan Street between Haven Avenue and Archibald Avenue is local and is not possible to be upgraded to collector status due to front-on residential property and the existing geometry of the street. c) The property along Banyan Street between Haven Avenue and Archibald Avenue is primary residential along its length. PLANNING COMMISSION RESOLUTION NO.91-06 GENERAL PLAN AMENDMENT 91-01B JANUARY 9, 1991 PAGE 2 d) This Amendment does not conflict with the land use policies of the General Plan and will provide for development, within the district, in a manner consistent with the General Plan and with related development; and e) This Amendment does promote the goals and objectives of the General Plan; and f) This Amendment would not be materially injurious or detrimental to the adjacent properties and would not have a significant impact on the environment nor the surrounding properties. 3. Based upon substantial evidence presented to this Commission during the above-referenced public hearing and upon the specific findings of facts set forth in Paragraph 1 and 2 above, this Commission hereby finds and concludes as follows: a) The Amendment promotes the goals of the circulation element of the General Plan; and b) The proposed Amendment is in conformance with the General Plan; and c) The amendment does not conflict with the circulation policies of the General Plan; and d) The Amendment would not be materially injurious or detrimental to the adjacent properties. 4. This Commission hereby finds that the project has been reviewed and considered for compliance with the California Environmental Quality Act of 1970 and further this Commission recommends the issuance of a Negative Declaration by the City Council . 5. Based upon the findings and conclusions set forth in Paragraphs 1, 2, 3 and 4 above, the Planning Commission of the City of Rancho Cucamonga hereby recommends approval of General Plan Amendment No. 91-01B on the 9th day of January 1991. 6 . The Secretary to the Commission shall certify to the adoption of this Resolution.
