HomeMy WebLinkAbout91-08 - Resolutions RESOLUTION NO. 91-08 A RESOLUTION OF THE RANCHO CUCAMONGA PLANNING COMMISSION DENYING A REQUEST THAT THE USE, STRIPPING AND REBUNDLING USED COPPER WIRE , BE CATEGORIZED AS MEDIUM MANUFACTURING, AND DETERMINING THE USE TO BE A RECYCLING OPERATION, AND MAKING FINDINGS IN SUPPORT THEREOF. A. Recitals. (i ) George Fox, of California Copper Recycling, Inc. , has filed an application for Use Determination No. 90-05 as described in the title of this Resolution. Hereinafter, the subject Use Determination request is referred to as "the application." (ii ) On January 9, 1991, the Planning Commission of the City of Rancho Cucamonga held a meeting to consider the application. (iii ) All legal prerequisites to the adoption of this Resolution have occurred. B . Resolution. NOW, THEREFORE, it is hereby found, determined and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission during the above-referenced meeting on January 9, 1991, including written and oral staff reports, this Commission hereby specifically finds as follows: (a) The application applies to property located at 8889 Etiwanda Avenue and is presently improved with an older industrial building; and (b) The subject site is located in a Heavy Industrial District, Subarea 15 of the Industrial Area Specific Plan; and (c) Recycling Operations should be conditionally permitted uses within Subarea 15 of the Industrial Area Specific Plan; and (d) The proposed use involves the recycling of used or waste copper wire which is not used in any subsequent manufacturing process on-site; and (e) The character and intensity of the proposed use most closely matches that of Recycling Operations. Based upon the substantial evidence presented to this Commission during the above-referenced meeting and upon the specific findings of facts set forth in paragraphs 1 and 2 above, this Commission hereby finds and concludes that the use in question is not of a similar intensity to other permitted uses in the same district. 4. Based upon the findings and conclusions set forth in Paragraphs 1, 2, and 3 above, this Commission hereby determines the use to be a Recycling Operation. 5. The Secretary of this Commission shall certify to the adoption of this Resolution. APPROVED AND ADOPTED THIS 9TH DAY OF JANUARY 1991.
