HomeMy WebLinkAbout91-10 - Resolutions RESOLUTION NO. 91-10 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, CONDITIONALLY APPROVING TENTATIVE PARCEL MAP NUMBER 13707 LOCATED AT THE NORTHEAST CORNER OF EIGHTH STREET, AND MAKING FINDINGS IN SUPPORT THEREOF - APN : 207-271-01 WHEREAS , Tentative Parcel Map Number 13707, submitted by Michael Investment Company, applicant, for the purpose of subdividing into one parcel , the real property situated in the City of Rancho Cucamonga, County of San Bernardino, State of California, identified as APN : 207-271-01, located at the northeast corner of Eighth Street and Baker Avenue; and WHEREAS, on January 23, 1991, the Planning Commission held a duly advertised public hearing for the above-described map. NOW, THEREFORE , THE RANCHO CUCAMONGA PLANNING COMMISSION RESOLVES AS FOLLOWS : SECTION 1 : That the following findings have been made: 1. That the map is consistent with the General Plan. 2. That the improvement of the proposed subdivision is consistent with the General Plan. 3. That the site is physically suitable for the proposed development. 4. That the proposed subdivision and improvements will not cause substantial environmental damage or public health problems or have adverse affects on abutting properties. SECTION 2 : This Commission finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970; and further, this Commission hereby issues a Negative Declaration. SECTION 3 : Tentative Parcel Map Number 13707 is hereby approved subject to the attached Standard Conditions and the following Special Conditions: PLANNING DIVISION : 1 . The following items shall be completed to the satisfaction of the City Planner prior to final Parcel Map approval : a. All trees shall be properly staked per City Standard. Submit screen material to the Planning Division for City Planner review and approval prior to installation. c. Removal of graffiti from all sides of all buildings and walls. d. Installation of benches conditioned upon approval of development. Refer to approved landscape and irrigation plans for design and location. e. Reciprocal access and parking agreements shall be submitted and approved. 2. Pursuant to provisions of California Public Resources Code Section 21089(b), this application shall not be operative, vested or final , nor will building permits be issued or a map recorded, until (1) the Notice of Determination (NOD) regarding the associated environmental action is filed and posted with the Clerk of the Board of Supervisors of the County of San Bernardino; and (2) any and all required filing fees assessed pursuant to California Fish and Game Code Section 711.4, together with any required handling charges, are paid to the County Clerk of the County of San Bernardino. The applicant shall provide the Planning Department with a stamped and conformed copy of the NOD together with a receipt showing that all fees have been paid. In the event this application is determined exempt from such filing fees pursuant to the provisions of the California Fish and Game Code, or the guidelines promulgated thereunder, except for payment of any required handling charge for filing a Certificate of Fee Exemption, this condition shall be deemed null and void. 3. The project shall require an Owners' Association. A copy of the Association Articles of Incorporation Bylaws and CC&R' s shall be reviewed by the City Attorney and City Engineer prior to recordation of the final map. , PLANNING COMMISSION RESOLUTION NO. 91-10 TENT.
