HomeMy WebLinkAbout91-14 - Resolutions RESOLUTION NO. 91-14 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT NO. 90-28 FOR THE DEVELOPMENT OF A GASOLINE STATION AND CAR WASH BUILDING TOTALING 1,596 SQUARE FEET ON .68 ACRES OF LAND IN THE NEIGHBORHOOD COMMERCIAL DISTRICT OF THE VICTORIA PLANNED COMMUNITY, LOCATED AT THE SOUTHEAST CORNER OF HIGHLAND AND MILLIKEN AVENUES , AND MAKING FINDINGS IN SUPPORT THEREOF - APN: 229-011- 22. A. Recitals. • (i ) Mobil Oil Corporation has filed an application for the issuance of the Conditional Use Permit No. 90-28 as described in the title of this Resolution. Hereinafter in this Resolution, the subject Conditional Use Permit request is referred to as "the application." (ii ) On the 13th of February, 1991, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. (iii ) All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined, and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission during the above-referenced public hearing on February 13, 1991, including written and oral staff reports, together with public testimony, this Commission hereby specifically finds as follows: (a) The application applies to property located at the southeast corner of Highland and Milliken Avenues with a street frontage of 181.16 feet and lot depth of approximately 212 feet and is presently improved with curb and gutter; and (b) The property to the north of the subject site is vacant freeway right-of-way, the property to the south of that site consists of vacant land, the property to the east is vacant, and the property to the west is a single family residential development under construction; and PLANNING COMMISSION RESOLUTION NO. 91-14 CUP 90-28 - MOBIL OIL CORPORATION FEBRUARY 13, 1991 Page 2 (c) The project design is in accordance with the conceptual master development plan for the gasoline station parcel , as indicated on the site plan for the Vineyards Marketplace Shopping Center (Conditional Use Permit 89-08); and (d) The application contemplates the construction and operation of a 24-hour gasoline station and automated car wash. 3. Based upon the substantial evidence presented to this Commission during the above-referenced public hearing and upon the specific findings of facts set forth in paragraphs 1 and 2 above, this Commission hereby finds and concludes as follows: (a) That the proposed use is in accord with the General Plan, the objectives of the Development Code and Victoria Community Plan, and the purposes of the district in which the site is located. (b) That the proposed use, together with the conditions applicable thereto, will not be detrimental to the public health, safety or welfare, or materially injurious to properties or improvements in the vicinity. (c) That the proposed use complies with each of the applicable provisions of the Development Code and Victoria Community Plan. 4. This Commission hereby finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and, further, this Commission hereby issues a Negative Declaration. 5. Based upon the findings and conclusions set forth in paragraphs 1, 2, 3, and 4 above, this Commission hereby approves the application subject to each and every condition set forth below and in the attached Standard Conditions attached hereto and incorporated herein by this reference. Planning Division: 1 . The mullions adjacent to the exterior cashier' s drawer shall be eliminated. 2. The design of the previously approved retaining wall along the north property line shall be modified to eliminate all sharp corners and include a substantial pilaster consistent with the pilaster design at the terminus of the retaining wall along Milliken Avenue. The design modifications to the wall shall be reviewed and approved by the City Planner prior to issuance of building permits for the gasoline station. A combination of landscaping berms, low walls, or a combination thereof, shall be provided within the landscape setback area to screen the gasoline pump islands from public view. Berms shall be undulating with an average height of 3 feet and a maximum slope not to exceed 3 to 1 in turf areas. Details of the berming and wall design shall be provided on the final landscape plans for review and approval by the City Planner. 4. Special landscaping shall be employed behind the sidewalk along Milliken Avenue to provide an intensified landscape screen between areas of public view and the pump islands. 5. Any signs proposed shall be in conformance with the Uniform Sign Program for the Vineyards Marketplace Shopping Center and the Sign Ordinance. 6. The monument sign shall be designed to appear as the terminus of the retaining wall behind the Milliken Avenue streetscape. The specific design shall be reviewed and approved by the City Planner prior to the issuance of any permits for the monument sign. 7 . The roof mansards shall be designed as to completely screen any roof equipment from public view. Special consideration shall be given to ultimate screening of the roof equipment from the raised elevation of the future Route 30 Freeway. 8. There shall be provision for the following design features in the trash enclosure to the satisfaction of the City Planner: a) Architecturally integrated into the design of this project. b) Separate pedestrian access that does not require opening the main doors and including a self-closing pedestrian door. c) Large enough to accommodate two trash bins. d) Roll-up doors. e) Trash bins with counterweighted lids. f) Architecturally treated overhead shade trellis. g) Chain link screen on top to prevent trash from blowing out of the enclosure and designed to be hidden from view. PLANNING COMMISSION RESOLUTION NO. 91-14 CUP 90-28 - MOBIL OIL CORPORATION FEBRUARY 13, 1991 Page 4 9. Trash collection shall occur between the hours of 9:00 a.m. to 10 :00 p.m. only. 10. The site shall be developed and maintained in accordance with the approved site plan which includes architectural elevations, exterior materials and colors, landscaping, sign programs, and grading on file with the Planning Division, the conditions contained herein, and Development Code regulations. Tree maintenance criteria shall be developed and submitted for review and approval by the City Planner for the project to encourage the natural growth characteristics of the selected tree species. 11. Graffiti shall be removed within 72 hours. 12. The entire site shall be keep free of trash and debris at all times, and in no event shall trash and debris remain for more than 24 hours. 13. The applicant shall resolve any Building Code compliance difficulties (with construction of canopies, property lines in relation to walls and other openings, and roof tile installation to withstand severe winds ) with the Building and Safety Department prior to issuance of building permits. 14. The business shall be conducted to comply with the following standards: a) Noise Levels. All commercial activities shall not create any noise that would exceed an exterior noise level of 60dBA during the hours of 10:00 p.m. to 7 :00 a.m. and 65dBA during the hours of 7 :00 a.m. to 10:00 p.m. b) Loading and Unloading. No person shall cause the loading, unloading, opening, closing, or other handling of boxes, crates, containers, building materials, garbage cans, or similar objects between the hours of 10:00 p.m. and 7 :00 a.m. , unless otherwise specified herein, in a manner which would cause a noise disturbance to a residential area. 15 . Pursuant to provisions of California Public Resources Code Section 21089(b), this application shall not be operative, vested or final , nor will building permits be issued or a map recorded, until (1) , the Notice of Determination (NOD) PLANNING COMMISSION RESOLUTION NO. 91-14 CUP 90-28 - MOBIL OIL CORPORATION FEBRUARY 13, 1991 Page 5 regarding the associated environmental action is filed and posted with the Clerk of the Board of Supervisors of the County of San Bernardino; and (2) , any and all required filing fees assessed pursuant to California Fish and Game Code Section 711.4, together with any required handling charges, are paid to the County Clerk of the County of San Bernardino. The applicant shall provide the Planning Department with a stamped and conformed copy of the Notice of Determination together with a receipt showing that all fees have been paid. In the event this application is determined exempt from such filing fees pursuant to the provisions of the California Fish and Game Code, or the guidelines promulgated thereunder, except for payment of any required handling charge for filing a Certificate of Fee Exemption, this condition shall be deemed null and void. Engineering Division: 1. The public sidewalk crossing of the drive approach shall be concrete, with interlocking pavers located outside the public sidewalk easement. 2. Landscaping along the Milliken Avenue frontage shall be compatible with the Milliken Avenue Parkway and Median Beautification Study to the satisfaction of the City Engineer. The street tree is (minimum) 15-gallon Cinamomum Caphora at 30 feet on center where the parkway is 6 feet wide or greater. Background trees shall be 15-gallon (minimum) Pinus Canariensis at 30 feet on center and may require a street tree easement. 3. The Highland Avenue street tree shall be Eucalyptus Carnaldulensis at 30 feet on center. 4. Sidewalk along the Milliken Avenue frontage shall be located to conform with the future right turn lane for the Route 30 Freeway on-ramp. Any portions which will ultimately be curb adjacent shall be 6 feet wide. 6. The Secretary to this Commission shall certify to the adoption of this Resolution.
