HomeMy WebLinkAbout91-15 - Resolutions RESOLUTION NO. 91-15 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT NO. 90-40 FOR SIERRA VISTA BAPTIST CHURCH, LOCATED ON THE SOUTH SIDE OF JASPER STREET, WEST OF SIERRA VISTA DRIVE IN THE LOW DENSITY RESIDENTIAL DISTRICT, AND MAKING FINDINGS IN SUPPORT THEREOF - APN: 202-026-13. A. Recitals. (i ) Sierra Vista Baptist Church has filed an application for the issuance of the Conditional Use Permit No. 90-40 as described in the title of this Resolution. Hereinafter in this Resolution, the subject Conditional Use Permit request is referred to as "the application." (ii ) On the 13th of February, 1991, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. (iii ) All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE , it is hereby found, determined, and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1 . This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission during the above-referenced public hearing on February 13, 1991, including written and oral staff reports, together with public testimony, this Commission hereby specifically finds as follows: (a) The application applies to property located at 7192 Jasper Street with a street frontage of approximately 1,121 feet and lot depth of approximately 330 feet at its greatest point; and (b) The property to the north of the subject site is a single family residence, the property to the south of that site consists of a commercial shopping center, the property to the east is single family residences, and the property to the west is San Bernardino County Flood Control District; and (c) The subject site is partially improved with a 2,900 square foot church administration building under Conditional Use Permit 87-19, which subsequently expired. Based upon the substantial evidence presented to this Commission during the above-referenced public hearing and upon the specific findings of facts set forth in paragraphs 1 and 2 above, this Commission hereby finds and concludes as follows: (a) That the proposed use is in accord with the General Plan, the objectives of the Development Code, and the purposes of the district in which the site is located. (b) That the proposed use, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. (c) That the proposed use complies with each of the applicable provisions of the Development Code. 4. This Commission hereby finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and, further, this Commission hereby issues a Negative Declaration. 5. Based upon the findings and conclusions set forth in paragraphs 1, 2, 3, and 4 above, this Commission hereby approves the application subject to each and every condition set forth below and in the attached Standard Conditions, attached hereto and incorporated herein by this reference. Planning Division: 1. The top of the parapet on the large flat stucco panels at the corner of the building shall introduce a cornice element built on top of the parapet to create a shadow line and compliment the proposed stucco banding. The cornice shall be a 2" x 4" or 2" x 6" on top of a 2" x 10" with stucco-over to match the building. The flashing on top of the cornice shall be painted to match the building. 2. All rock veneer shall be native stone. 3. The three service doors on the west elevation shall be painted to match the building wall . 4. The entrance doors on the north elevation shall be stained decorative wood or glass. 5. The 5-foot high retaining wall along the west and south property lines shall have a decorative cap, stucco finish and river rock pilasters with a 5-foot high wrought iron fence on top. This shall be finished as part of Phase 2. 6. Extensive landscaping shall be provided along the south and west property lines to soften impacts of the retaining wall and buildings from Base Line Road as part of Phase 2. Pursuant to provisions of California Public Resources Code Section 21089(b) , this application shall not be operative, vested, or final , nor will building permits be issued or a map recorded, until (1) the Notice of Determination (NOD) regarding the associated environmental action is filed and posted with the Clerk of the Board of Supervisors of the County of San Bernardino; and (2) any and all required filing fees assessed pursuant to California Fish and Game Code Section 711.4, together with any required handling charges, are paid to the County Clerk of the County of San Bernardino. The applicant shall provide the Planning Department with a stamped and conformed copy of the NOD together with a receipt showing that all fees have been paid. In the event this application is determined exempt from such filing fees pursuant to the provisions of the California Fish and Game Code, or the guidelines promulgated thereunder, except for payment of any required handling charge for filing a Certificate of Fee Exemption, this condition shall be deemed null and void. Engineerinq Division 1 . The applicant shall either install the landscaping and irrigation or contribute, in lieu of construction, to the future City Beautification Project for the area between the church property and Base Line Road prior to the issuance of building permits. If the area is to be maintained by the City, the area shall be annexed into the City Landscape Maintenance District. Also, additional , dedication for the landscaped area to be maintained by the City may be requi red. 2. Parkway improvements on Lomita Drive shall be constructed with the development of Phase 3. 6.
