HomeMy WebLinkAbout91-20 - Resolutions RESOLUTION NO. 91-20 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, CONDITIONALLY APPROVING TENTATIVE PARCEL MAP NUMBER 13800, LOCATED AT THE SOUTHEAST CORNER OF MAIN STREET AND REID AVENUE, AND MAKING FINDINGS IN SUPPORT THEREOF - APN: 209-062-05 WHEREAS , Tentative Parcel Map Number 13800, submitted by Bar Z Construction, applicant, for the purpose of subdividing into 2 parcels, the real property situated in the City of Rancho Cucamonga, County of San Bernardino, State of California, identified as APN 209-062-05, located at the southeast corner of Main Street and Reid Avenue; and WHEREAS, on February 13, 1991, the Planning Commission held a duly advertised public hearing for the above-described map. NOW, THEREFORE , THE RANCHO CUCAMONGA PLANNING COMMISSION RESOLVES AS FOLLOWS : SECTION 1 : That the following findings have been made: 1. That the map and the vacation of Reid Avenue are consistent with the General Plan. 2. That the improvement of the proposed subdivision is consistent with the General Plan. 3. That the site is physically suitable for the proposed development. 4. That the proposed subdivision and improvements will not cause substantial environmental damage or public health problems or have adverse affects on abutting properties. SECTION 2 : This Commission finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970; and further, this Commission hereby issues a Negative Declaration. SECTION 3 : Tentative Parcel Map Number 13800 is hereby approved subject to the attached Standard Conditions and the following Special Conditions: ENGINEERING DIVISION 1 . The vacation of Reid Avenue shall be completed as approved by the City Council prior to recordation of the final map. The approval of the parcel map shall be null and void if this item is not approved. PLANNING COMMISSION RESOLUTION NO 91-20 TENT PM 13800 & VAC REID AVE - BAR Z CONST FEBRUARY 13, 1991 PAGE 2 2. The pad elevation for each parcel shall be raised 1 foot above the top of the curb for drainage protection or as otherwise approved by the Building Official upon development of the parcels. 3. Existing Overhead Utilities: a. Main Street - An in-lieu fee as contribution to the future undergrounding of the existing overhead utilities (telecommunication and electrical ) on the opposite side of Main Street shall be paid to the City prior to the approval of the Final Map. The fee shall be one half the City adopted unit amount times the length from the east project boundary to the west project boundary. b. Railroad Communication Lines - An in-lieu fee as contribution to the future undergrounding of the existing overhead utilities (communications) within the Atchison, Topeka and Santa Fe Railroad right-of- way shall be paid to the City prior to the approval of the Final Map. The fee shall be one-half the City adopted unit amount times the length from the east project boundary to the west project boundary. 4. Pursuant to provisions of California Public Resources Code Section 21089(b), this application shall not be operative, vested or final , nor will building permits be issued or a map recorded, until (1) the Notice of Determination (NOD) regarding the associated environmental action is filed and posted with the Clerk of the Board of Supervisors of the County of San Bernardino; and (2) any and all required filing fees assessed pursuant to California Fish and Game Code Section 711.4, together with any required handling charges, are paid to the County Clerk of the County of San Bernardino. The applicant shall provide the Planning Department with a stamped and conformed copy of the NOD together with a receipt showing that all fees have been paid. In the event this application is determined exempt from such filing fees pursuant to the provisions of the California Fish and Game Code, or the guidelines promulgated thereunder, except for payment of any required handling charge for filing a Certificate of Fee Exemption, this condition shall be deemed null and void.
