HomeMy WebLinkAbout91-33 - Resolutions RESOLUTION NO. 91-33 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING DEVELOPMENT REVIEW NO. 90-21, THE DEVELOPMENT OF A 14,000 SQUARE FOOT INDUSTRIAL BUILDING WITHIN AN EXISTING MANUFACTURING COMPLEX IN THE MINIMUM IMPACT HEAVY INDUSTRIALS DESIGNATION (SUBAREA 9) OF THE INDUSTRIAL AREA SPECIFIC PLAN, LOCATED AT THE SOUTHWEST CORNER OF ARROW ROUTE AND ROCHESTER AVENUE, AND MAKING FINDINGS IN SUPPORT THEREOF - APN: 229-111-17. A. Recitals. (i) Schlosser Forge has filed an application for the approval of Development Review No. 90-21 as described in the title of this Resolution. Hereinafter in this Resolution, the subject Development Review request is referred to as "the application." (ii) On the of 27th of March 1991 the Planning Commission of the City of Rancho Cucamonga conducted a meeting on the application and concluded said meeting on that date. (iii) All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined, and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission during the above-referenced meeting on March 21, 1991, including written and oral staff reports, this Commission hereby specifically finds as follows: (a) The application applies to property located at the southwest corner of Arrow Route and Rochester Avenue and is presently developed with a manufacturing complex consisting primarily of pre-engineered metal buildings; and (b) The property to the north, south, and west are presently vacant and are designated for industrial uses. The property to the east is developed with an industrial complex and is designated for industrial uses. (c) The project, with approval of the variance, will comply with all minimum development standards of the City of Rancho Cucamonga; and (d) The development of a 14,000 square foot manufacturing building is consistent with the Heavy Industrial designation of the General Plan; and PLANNING COMMISSION RESOLUTION NO. 91-33 DR90-21 - SCHLOSSER FORGE March 27, 1991 Page 2 (e) The project is consistent with the provisions of the existing development agreement on the property. 3. Based upon the substantial evidence presented to this Commission during the above-referenced meeting and upon the specific findings of facts set forth in paragraphs 1 and 2 above, this Commission hereby finds and concludes as follows: (a) That the proposed project is consistent with the objectives of the General Plan; and (b) That the proposed use is in accord with the objective of the Development Code and the purposes of the district in which the site is located; and (c) That the proposed use is in compliance with each of the applicable provisions of the Development Code; and (d) That the proposed use, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. 4. This Commission hereby finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and, further, this Commission hereby issues a Negative Declaration. 5. Based upon the findings and conclusions set forth in paragraphs 1, 2, 3, and 4 above, this Commission hereby approves the application subject to each and every condition set forth below and in the attached Standard Conditions attached hereto and incorporated herein by this reference. Planning Division: 1. The accent striping (horizontal and vertical) shall be consistent with the existing buildings. The final design shall be reviewed and approved by the City Planner prior to the issuance of building permits. 2. Extensive landscaping shall be provided along the Arrow Route frontage. The final plans shall be reviewed and approved by the City Planner prior to the issuance of building permits. 3. Pursuant to provisions of California Public Resources Code Section 21089(b) , this application shall not be operative, vested or final, nor will building permits be issued or a map recorded, until (1) , the Notice of Determination (NOD) PLANNING COMMISSION RESOLUTION NO. 91-33 DR90-21 - SCHLOSSER FORGE March 27, 1991 Page 3 regarding the associated environmental action is filed and posted with the Clerk of the Board of Supervisors of the County of San Bernardino; and (2) , any and all required filing fees assessed pursuant to California Fish and Game Code Section 711.4, together with any required handling charges, are paid to the County Clerk of the County of San Bernardino. The applicant shall provide the Planning Department with a stamped and conformed copy of the Notice of Determination together with a receipt showing that all fees have been paid. In the event this application is determined exempt from such filing fees pursuant to the provisions of the California Fish and Game Code, or the guidelines promulgated thereunder, except for payment of any required handling charge for filing a Certificate of Fee Exemption, this condition shall be deemed null and void. Engineering Division: 1. The easterly most drive approach on Arrow Route shall be reconstructed to be in conformance with City Standard 306. 2. An in-lieu fee as contribution to the previously undergrounded utilities (electrical) on the opposite side of Rochester Avenue shall be paid to the City prior to the issuance of a building permit. The fee shall be one-half the difference between the undergrounding cost of the utilities (electrical) on the opposite side of Rochester Avenue minus those (telecommunications) on the project side times the length from the center of Arrow Route to the south project boundary. 6. The Secretary to this Commission shall certify to the adoption of this Resolution. APPROVED AND ADOPTED THIS 27TH DAY OF MARCH 1991.
