HomeMy WebLinkAbout91-36 - Resolutions RESOLUTION NO. 91-36 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, RECOMMENDING APPROVAL OF INDUSTRIAL SPECIFIC PLAN AMENDMENT 91-02 TO DEFINE AND ESTABLISH DEVELOPMENT CRITERIA FOR RECYCLING USES, AND TO AMEND THE LAND USE REGULATIONS FOR SUBAREAS 1-5, 8-11, and 13-15 TO CONDITIONALLY PERMIT COLLECTION AND PROCESSING FACILITIES, AND MAKING FINDINGS IN SUPPORT THEREOF. A. Recitals. (i) The City of Rancho Cucamonga has initiated an application for Industrial Specific Plan Amendment 91-02 as described in the title of this Resolution. Hereinafter in this Resolution, the subject Specific Plan Amendment request is referred to as "the application." (ii) On April 10, 1991, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. (iii) All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined, and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission during the above-referenced public hearing on April 10, 1991, including written and oral staff reports, together with public testimony, this Commission hereby specifically finds as follows: (a) The proposed amendments will not have a significant impact on the environment as evidenced by the conclusions and findings of the Initial Study, Part II; and (b) The application applies to properties located within Subareas 1-5, 8-11, and 13-15 of the Industrial Area Specific Plan. (c) The proposed amendment would be in the best interest of the health, safety, and welfare of the citizens of the City of Rancho Cucamonga for the reasons as follows: (i) That the proposed amendment will distinguish between Collection Facilities, Processing Facilities, and Scrap Operations. PLANNING COMMISSION RESOLUTION NO. 91-36 ISPA 91-02 - CITY OF RANCHO CUCAMONGA April 10, 1991 Page 2 (ii) That the proposed amendment will establish specific development criteria for Material Recovery Facilities (MRFS) within the Industrial Area Specific Plan. (iii) That the proposed amendment will reduce the amount of solid waste, promote conservation of recyclable materials, and lessen the impact of solid waste on the environment. (iv) That the proposed amendment will conserve valuable material resources and energy, thereby creating greater efficiency in the regional economy, and promote local employment. (v) The proposed amendment will reduce the storage, collection, and transportation and disposal costs for solid waste. 3. Based upon the substantial evidence presented to this Commission during the above-referenced public hearing and upon the specific findings of facts set forth in paragraphs 1 and 2 above, this Commission hereby finds and concludes as follows: (a) That the proposed amendment is consistent with the objectives of the Industrial Specific Plan and the purposes of the District in which the site is located. (b) That the proposed amendment will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. (c) That the proposed amendment is in compliance with each of the applicable provisions of the Industrial Specific Plan. (d) That the proposed amendment will not be detrimental to the objectives of the General Plan or the Industrial Specific Plan. 4. This Commission hereby finds that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and, further, this Commission hereby recommends issuance of a Negative Declaration. 5. Based upon the findings and conclusions set forth in paragraphs 1, 2, 3, and 4 above, this Commission hereby resolves as follows: (a) That the Planning Commission of the City of Rancho Cucamonga hereby recommends approval of Industrial Specific Plan Amendment 91-02 per the attached Ordinance. 6. The secretary of this Commission shall certify to the adoption of this Resolution. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING INDUSTRIAL SPECIFIC PLAN AMENDMENT 91-02, ESTABLISHING REGULATIONS FOR RECYCLING COLLECTION AND PROCESSING, AND MAKING FINDINGS IN SUPPORT THEREOF. THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA DOES ORDAIN AS FOLLOWS: SECTION 1: Part III, Table III-1 is hereby amended to read, in words and figures, as shown in the attached Exhibit "A." SECTION 2: Part III, Table III-2, Section H is hereby added to read, in words and figures, as follows: H. MATERIALS RECOVERY FACILITIES (MRFs) Collection Facility: Activities typically include the acceptance by donation, redemption, or purchase of recyclable materials from the public for sorting and storage. Such a facility may involve aggregating, weighing, and storing large amounts of material on-site, including bailing, compacting, or similar packaging operations for shipment. Outdoor storage may be permitted when approved by a Conditional Use Permit. Processing Facility: Activities typically include, but are not limited to: weighing, heating, melting, crushing, grinding, briquetting, mechanical sorting, shredding, stripping, cleaning, and remanufacturing. The finished materials are semi-finished or raw materials to be shipped for further manufacture or assembly. Such a facility may involve outdoor storage of large amounts of recyclable or processed materials. Scrap Operation: Activities typically include, but are not limited to: the storage and sale from the premises and/or dismantling of used, recyclable, or waste materials, except when such activities are part of a manufacturing operation. SECTION 3: Part III, Table III-2, Subsection D, land use type definition for "Scrap operation" is hereby deleted in its entirety. SECTION 4: Part III, Section IV, Development Standards, Subsection J is hereby added to read, in words and figures, as shown in the attached Exhibit "B. " SECTION 5: Appendix F is hereby added to read, in words and figures, as shown in the attached Exhibit "C. " SECTION 6: Part IV is hereby amended to add "Collection Facilities" as a permitted use within Subareas 1-5, 8-11, and 13-15. PLANNING COMMISSION ORDINANCE NO. ISPA 91-02 - CITY OF RANCHO CUCAMONGA April 10, 1991 Page 2 SECTION 7: Part IV is hereby amended to add "Processing Facilities" as a conditionally permitted use within Subareas 5, 8-11, and 13-15. SECTION 8: This Council finds that this amendment will not adversely effect the environment and hereby issues a Negative Declaration. SECTION 9: The City Council declares that, should any provision, section, paragraph, sentence, or word of this Ordinance be rendered or declared invalid by any final court action in a court of competent jurisdiction, or by reason of any preemptive legislation, the remaining provisions, sections, paragraphs, sentences, and words of this Ordinance shall remain in full force and effect. SECTION 10: The City Clerk shall certify the adoption of this Ordinance and shall cause the same to be published within fifteen (15) days after its passage at least once in the Inland Valley Daily Bulletin, a newspaper of general circulation published in the City of Ontario, California, and circulated in the City of Rancho Cucamonga, California. MATERIALS RECOVERY FACILITIES STANDARDS The purpose of Materials Recovery Facilities Standards is to establish minimum standards for screening, parking, noise, and litter control which meet the intent of the plan. Unless specifically modified through the Conditional Use Permit, all other development standards of the City of Rancho Cucamonga shall apply, including but not limited to, grading, drainage, and street improvements. J.1. All business operations shall be conducted within an enclosed building unless specifically permitted within the General Industrial and Heavy Industrial categories and adequately screened from public view pursuant to the Section A, General Provisions, for the Industrial Area; in particular, screening from the Ontario I-15 Freeway shall be required. J.2. All facilities shall be maintained free of litter and vermin and any other undesirable material and shall be cleaned of loose debris on a daily basis. J.3. The facility shall meet the parking requirements for warehouse uses. In addition, stacking space shall be provided for six vehicles or the anticipated peak customer load, whichever is higher. If no drive-up facilities are available, than a minimum of six additional spaces for customer drop-off shall be provided. J.8. Power-driven equipment, including aluminum foil and can compacting or bailing, necessary for efficient temporary storage and shipment of material shall be permitted. 44 ORb. �X H test i C " APPENDIX F RECYCLING DEFINITIONS The following definitions are offered to provide clarification to technical terms relative to recyclable materials and recycling operations: Construction Waste - Construction and demolition debris, dredgings, grubbing from land clearing, rubble resulting from construction, remolding, repair, and demolition operations on housing, commercial buildings and other structures and pavements. Domestics - A class for discards that occurs both in the home and in the work place: i.e. , beverage containers and newspapers. Heavy Industrial Wastes - Waste derived from industrial or manufacturing operations such as ship building, construction, and demolition operations. Light Industrial Waste - Waste derived from research and development facilities and light manufacturing operations such as semiconductors and computer manufacturers. Materials Recovery Facilities (MRFs) - The point of extraction of valuable raw materials, which are then sold on the commodity and scrap markets or are used as part of a manufacturing operation. Materials targeted are paper, plastic, glass, metals, textiles, and other goods deemed similar by the City Planner. Recyclables - Recyclables are discards or waste materials, that are collated, separated, or processed, and used as raw materials or products. Typically recyclables would include: domestics such as beverage containers and newspaper, cardboard, high grade paper, plastics, textiles, light industrial waste, or other similar materials. Recyclables are not intended to include: chemicals, toxic water, heavy industrial waste, petroleum, construction waste, unsorted garbage, heavy metals, or other similar materials as determined by the City Planner. Recycling - The series of activities by which materials that would otherwise be disposed of, are collected, separated, or processed and used in the form of raw materials.
