HomeMy WebLinkAbout91-72 - Resolutions RESOLUTION NO. 91-72 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, CONDITIONALLY APPROVING TENTATIVE PARCEL MAP NUMBER 13321, LOCATED ON THE NORTH SIDE OF LA SENDA ROAD, WEST OF SAPPHIRE STREET AND MAKING FINDINGS IN SUPPORT THEREOF - APN: 1061-101-07 WHEREAS, Tentative Parcel Map Number 13321, submitted by C and G Construction, applicant, for the purpose of subdividing into 3 parcels, the real property situated in the City of Rancho Cucamonga, County of San Bernardino, State of California, identified as APN 1061-101-07, located on the north side of La Senda Road, east of Sapphire Street; and WHEREAS, on June 13, 1991, the Planning Commission held a duly advertised public hearing for the above-described map. NOW, THEREFORE, THE RANCHO CUCAMONGA PLANNING COMMISSION RESOLVES AS FOLLOWS: SECTION 1: That the following findings have been made: 1. That the map is consistent with the General Plan. 2. That the improvement of the proposed subdivision is consistent with the General Plan. 3. That the site is physically suitable for the proposed development. 4. That the proposed subdivision and improvements will not cause substantial environmental damage or public health problems or have adverse affects on abutting properties. SECTION 2: This Commission finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970; and further, this Commission hereby issues a Negative Declaration. SECTION 3: Tentative Parcel Map Number 13321 is hereby approved subject to the attached Standard Conditions and the following Special Conditions: Engineering Division 1. Pursuant to provisions of California Public Resources Code Section 21089(b) , this application shall not be operative, vested or final, nor will building permits be issued or a map recorded, until (1) the Notice of Determination (NOD) regarding PLANNING COMMISSION RESOLUTION NO. 91-72 TENT PARCEL MAP 13321 - C & G CONSTRUCTION June 12, 1991 Page 2 the associated environmental action is filed and posted with the Clerk of the Board of Supervisors of the County of San Bernardino; and (2) any and all required filing fees assessed pursuant to California Fish and Game Code Section 711.4, together with any required handling charges, are paid to the County Clerk of the County of San Bernardino. The applicant shall provide the Engineering Department with a stamped and conformed copy of the NOD together with a receipt showing that all fees have been paid. In the event this application is determined exempt from such filing fees pursuant to the provisions of the California Fish and Game Code, or the guidelines promulgated thereunder, except for payment of any required handling charge for filing a Certificate of Fee Exemption, this condition shall be deemed null and void. 2. Reconstruct La Senda Road from the west project boundary to Sapphire Street as follows: a. Pavement: The existing pavement shall be removed and replaced with 3-inch asphalt concrete over compacted native soil as approved by the Engineering and Fire Divisions and shall be 26 feet in width. b. Typical Section: Provide a straight tilt section with curb and gutter along the south edge. If this type of section cannot be designed to meet the existing conditions (causes excessively steep driveways, etc. ) , then a "V" section with a center concrete ribbon gutter may be used. c. Drainage: The street section shall be designed to contain a Q100 for the total area on the north side of La Senda Road extending from Sapphire Street to and including the property at the northwest corner of La Senda Road and Carol Avenue considering all properties to be fully developed. If the flows cannot be contained within the street section, a storm drain or other method of conveying the flows shall be provided as approved by the City Engineer and Building Official. d. Cost Reimbursement: The Developer may request a reimbursement agreement to recover one-half the cost of the improvements from the future subdivision of the property on the south side of La Senda Road (APN: 1061-101-17) . 3. Ultimate standard public street improvements shall be provided along the parcel frontages at such time in the future that their construction is feasible. Said improvements shall be guaranteed by a lien agreement to be executed prior to recordation of the Final Parcel Map. An in-lieu fee as contribution to the future undergrounding of the existing overhead utilities (telecommunications and electrical) on the project side of La Senda Road shall be paid to the City prior to the recordation of the Final Parcel Map. The fee shall be the full City's adopted unit amount times the length of the project frontage. The Developer may request a reimbursement agreement to recover one-half the City's adopted cost for undergrounding from the future subdivision as it occurs on the opposite side of the street. Planning Division 1. Provide a 15 foot local equestrian trail along the north property line of Parcels 1, 2, and 3. 2. Prior to the recordation of the final map or issuance of building permits, whichever comes first, the applicant shall consent to, or participate in, the establishment of a Mello-Roos Community Facilities District pertaining to the project site to provide in conjunction with the applicable school district for the construction and maintenance of necessary school facilities. However, if any school district has previously established such a Community Facilities District, the applicant shall, in the alternative, consent to the annexation of the project site into the territory of such existing district prior to the recordation of the final map or the issuance of building permits, whichever comes first. Further, if the affected school district has not formed a Mello-Roos Community Facilities District within twelve months of the date of approval of the project and prior to the recordation of the final map or issuance of building permits for said project, this condition shall be deemed null and void.
