HomeMy WebLinkAbout92-03A - Resolutions RESOLUTION NO. 92-03A A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING A MODIFICATION TO DEVELOPMENT REVIEW NO. 91-08, A REQUEST TO MODIFY THE APPROVED MASTER PLAN TO ALLOW THE CONSTRUCTION OF TWO INDUSTRIAL BUILDINGS TOTALING 471,625 SQUARE FEET ON 23.08 ACRES OF LAND IN THE GENERAL INDUSTRIAL DESIGNATION (SUBAREA 8) OF THE INDUSTRIAL AREA SPECIFIC PLAN, LOCATED SOUTH OF ARROW ROUTE AND EAST OF WHITE OAK AVENUE, AND MAKING FINDINGS IN SUPPORT THEREOF -APN: 209-471-08. A. Recitals. 1. Capellino and Associates has filed an application for the approval of a modification to Development Review No. 91-08, as described in the title of this Resolution. Hereinafter in this Resolution, the subject Development Review request is referred to as "the application." 2. On the 13th day of March 1996, the Planning Commission of the City of Rancho Cucamonga conducted a meeting on the application and concluded said meeting on that date. 3. All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined, and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission during the above- referenced meeting on March 13, 1996, including written and oral staff reports, this Commission hereby specifically finds as follows: a. The application applies to property located south of Arrow Route and east of White Oak Avenue with a street frontage of 2,040 feet along Arrow Route and 1,020 feet along White Oak Avenue, and is presently developed with seven industrial buildings; and b. On January 8, 1992, the Planning Commission approved Development Review 91-08 for the development of 31 industrial buildings; and c. The applicant requests approval to construct two industrial buildings totaling 471,625 square feet in the location that was previously approved for the construction of 13 smaller buildings; and d. The construction of two industrial buildings is consistent with the General Industrial designation of the Industrial Area Specific Plan and General Plan; and e. The construction of the two industrial buildings is consistent with surrounding development in the area; and PLANNING COMMISSION RESOLUTION NO. 92-03A DR 91-08 - CAPELLINO & ASSOCIATES March 13, 1996 Page 2 f. The industrial buildings, with the conditions of approval imposed on the application, will be consistent with the requirements of the Industrial Specific Plan and the Development Code. 3. Based upon the substantial evidence presented to this Commission during the above- referenced meeting and upon the specific findings of facts set forth in paragraphs 1 and 2 above, this Commission hereby finds and concludes as follows: a. That the proposed project is consistent with the objectives of the General Plan; and b. That the proposed use is in accord with the objectives of the Development Code and the purposes of the district in which the site is located; and c. That the proposed use is in compliance with each of the applicable provisions of the Development Code; and d. That the proposed use, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. 4. This Commission hereby finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970, as amended, and the State CEQA guidelines promulgated thereunder; and a Negative Declaration was issued by this Commission on January 8, 1992. Further this Commission finds that the application is in substantial compliance with the original approval for which a Negative Declaration was issued. 5. Based upon the findings and conclusions set forth in paragraphs 1, 2, 3, and 4 above, this Commission hereby approves the application subject to each and every condition set forth below and in the Standard Conditions, attached hereto and incorporated herein by this reference. Planning Division 1) All applicable conditions contained in Resolution No. 92-03, approving Development Review 91-08 shall apply. 2) All conditions of approval contained in the Resolution approving Development Review 95-33 shall apply. 6.
