HomeMy WebLinkAbout93-19 - Resolutions RESOLUTION NO. 93-19 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING A TIME EXTENSION FOR TENTATIVE TRACT NO. 14055, AND DESIGN REVIEW THEREOF, A 3-LOT SUBDIVISION OF 115 CONDOMINIUM UNITS ON 10.27 ACRES OF LAND IN THE MEDIUM RESIDENTIAL DISTRICT (8-14 DWELLING UNITS PER ACRE) , LOCATED NORTH OF ARROW HIGHWAY AND EAST OF BAKER AVENUE, AND MAKING FINDINGS IN SUPPORT THEREOF - APN: 207-201-44. A. Recitals (i) Diversified Pacific has filed an application for the extension of Tentative Tract No. 14055 as described in the title of this Resolution. Hereinafter in this Resolution, the subject Time Extension request is referred to as "the application. " (ii) On February 8, 1989, this Commission adopted its Resolutions No. 89-26 and 89-27, thereby approving, subject to specific conditions and time limits, Tentative Tract No. 14055 and Design Review for Tentative Tract 14055. (iii) On March 27, 1991, this Commission adopted its Resolution No. 89-26A, thereby modifying certain conditions of approval for Tentative Tract No. 14055. (iv) All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined, and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission, including written and oral staff reports, this Commission hereby specifically finds as follows: a. That prevailing economic conditions have caused a distressed market climate for development of the project. b. That current economic, marketing, and inventory conditions make it unreasonable to develop the project at this time. c. That strict enforcement of the conditions of approval regarding expirations would not be consistent with the intent of the Development Code. That the granting of said time extension will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. 3. Based upon the findings and conclusions set forth in paragraphs 1 and 2 above, this Commission hereby grants a Time Extension for: Tract Applicant Expiration TT 14055 Diversified Pacific February 8, 1994 Design Review for Diversified Pacific February 8, 1994 TT 14055 4.
