HomeMy WebLinkAbout93-41 - Resolutions RESOLUTION NO. 93-41 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING A TIME EXTENSION FOR TENTATIVE TRACT NO. 14207, A RESIDENTIAL SUBDIVISION AND DESIGN REVIEW OF 28 SINGLE FAMILY LOTS ON 19.8 ACRES OF LAND IN THE VERY LOW RESIDENTIAL DISTRICT (LESS THAN 2 DWELLING UNITS PER ACRE) , LOCATED ON WILSON AVENUE, WEST OF BERYL STREET AND SOUTH OF HERITAGE PARK, AND MAKING FINDINGS IN SUPPORT THEREOF - APN: 1062-051-01. A. Recitals (i) Mr. Jung Hwang has filed an application for the extension of Tentative Tract No. 14207, and the associated Design Review, as described in the title of this Resolution. Hereinafter in this Resolution, the subject Time Extension request is referred to as "the application." (ii) On May 22, 1991, this Commission adopted Resolution Nos. 91-43 and 91-44, thereby approving, subject to specific conditions and time limits, Tentative Tract No. 14207 and the design review thereof. (iii) All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined, and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission, including written and oral staff reports, this Commission hereby specifically finds as follows: a. That prevailing economic conditions have caused a distressed market climate for development of the project. b. That current economic, marketing, and inventory conditions make it unreasonable to develop the project at this time. c. That strict enforcement of the conditions of approval regarding expirations would not be consistent with the intent of the Development Code. d. That the granting of said time extension will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. Based upon the findings and conclusions set forth in paragraphs 1 and 2 above, this Commission hereby grants a Time Extension for: Tract Applicant Expiration TT 14207 Jung Hwang May 22, 1994 DR for TT 14207 Jung Hwang May 22, 1994 4.
