A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO CUCAMONGA, CALIFORNIA, APPROVING VARIANCE
NO. 93-06, A REQUEST TO REDUCE THE REQUIRED BUILDING
SETBACK FROM RESIDENTIAL AREAS FROM 45 FEET TO 0 FEET FOR
THE DEVELOPMENT OF A MINI-STORAGE FACILITY IN THE GENERAL
INDUSTRIAL DESIGNATION (SUBAREA 5) OF THE INDUSTRIAL AREA
SPECIFIC PLAN, LOCATED ON THE EAST SIDE OF HERMOSA
AVENUE, SOUTH OF 8TH STREET, AND MAKING FINDINGS IN
SUPPORT THEREOF - APN: 209-221-19.
A. Recitals.
(i) E & R Rancho Pacific, Inc. has filed an application for the
issuance of Variance No. 93-06 as described in the title of this Resolution.
Hereinafter in this Resolution, the subject Variance request is referred to as
"the application. "
(ii) On the 13th day of October 1993, the Planning Commission of the
City of Rancho Cucamonga conducted a duly noticed public hearing on the
application and concluded said hearing on that date.
(iii) All legal prerequisites prior to the adoption of this Resolution
have occurred.
B. Resolution.
NOW, THEREFORE, it is hereby found, determined, and resolved by the
Planning Commission of the City of Rancho Cucamonga as follows:
1. This Commission hereby specifically finds that all of the facts
set forth in the Recitals, Part A, of this Resolution are true and correct.
2. Based upon substantial evidence presented to this Commission
during the above-referenced public hearing on October 13, 1993, including
written and oral staff reports, together with public testimony, this
Commission hereby specifically finds as follows:
(a) The application applies to property located on the east
side of Hermosa Avenue, south of 8th Street with a street frontage of 210 feet
and lot depth of 563 feet and is presently improved with a single family
residence; and
(b) The property to the north of the subject site is
designated for industrial uses and is developed with legal non-conforming
single family residences. The property to the south is designated for
industrial uses and is developed with a legal non-conforming single family
residence and is vacant. The property to the east is designated for flood

control purposes and is developed with the Deer Creek Flood Control Channel.
The property to the west is designated for industrial uses and is developed
with a church and a legal non-conforming single family residence.
(c) Few industrial parcels within the City have residential
areas on two sides of the property. To require the 45-foot building setback
from the residential area would create a hardship on the property inconsistent
with the objectives of the Industrial Area Specific Plan.
(d) From the residences, the buildings along the property line
will appear as an 8-foot high wall which is permitted by the Industrial Area
Specific Plan.
(e) The buildings located at the property line provide a
buffer between the residences and the drive aisles of the mini-storage,
thereby locating the activity area away from the residences consistent with
the intent of the 45-foot setback requirement. Under the Industrial Area
Specific Plan, the drive aisles could be located 5 feet off the property line.
(f) The proposed use is less intensive than other uses
permitted in the subarea. Manufacturing and warehouse uses have the potential
to generate more noise, vibration, and odor than the mini-storage facility.
The mini-storage facility is more compatible with the residential uses,
consistent with the intent of the Industrial Area Specific Plan.
3. Based upon the substantial evidence presented to this Commission
during the above-referenced public hearing and upon the specific findings of
facts set forth in paragraphs 1 and 2 above, this Commission hereby finds and
concludes as follows:
(a) That strict or literal interpretation and enforcement of
the specified regulations would result in practical difficulty or unnecessary
physical hardship inconsistent with the objectives of the Development Code.
(b) That there are exceptional or extraordinary circumstances
or conditions applicable to the property involved or to the intended use of
the property that do not apply generally to other properties in the same
district.
(c) That strict or literal interpretation and enforcement of
the specified regulation would deprive the applicant of privileges enjoyed by
the owners of other properties in the same district.
(d) That the granting of the Variance will not constitute a
grant of special privilege inconsistent with the limitations on other
properties classified in the same district.
(e) That the granting of the Variance will not be detrimental
to the public health, safety, or welfare or materially injurious to properties
or improvements in the vicinity.

4. Based upon the findings and conclusions set forth in
paragraphs 1, 2, and 3 above, this Commission hereby approves the application
subject to each and every condition set forth below.
Planning Division
1) Approval is granted for the mini-storage use
only.
2) Building walls along the north property line
and within a 45-foot setback, shall not exceed
8 feet in height as measured at the property
line.
3) Landscaping shall be provided along the
property lines, or in the back yards of
adjoining residences, to soften the appearance
of the wall.
5. The Secretary to this Commission shall certify to the adoption
of this Resolution.
