HomeMy WebLinkAbout93-89 - Resolutions RESOLUTION NO. 93-89 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, DENYING WITHOUT PREJUDICE DEVELOPMENT REVIEW NO. 93-13, THE DESIGN REVIEW OF ELEVATIONS FOR BUILDING X, A 5,350 SQUARE FOOT RETAIL BUILDING, WITHIN THE TERRA VISTA TOWN CENTER, LOCATED AT THE NORTHEAST CORNER OF FOOTHILL BOULEVARD AND HAVEN AVENUE IN THE COMMUNITY COMMERCIAL DISTRICT, AND MAKING FINDINGS IN SUPPORT THEREOF - APN: 1077-421-70. A. Recitals. 1. Western Properties has filed an application for the approval of Development Review No. 93-13 as described in the title of this Resolution. Hereinafter in this Resolution, the subject Development Review request is referred to as "the application. " 2. On August 11, August 25, October 13, and October 27, 1993, the Planning Commission of the City of Rancho Cucamonga conducted a meeting on the application and concluded said meeting on that date. 3. All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined, and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission during the above-referenced meetings on August 12, August 25, October 13, and October 27, 1993, including written and oral staff reports, this Commission hereby specifically finds as follows: a. The application applies to property identified as Pads X and Y, located at the northeast corner of Foothill Boulevard and Haven Avenue and is presently improved with landscape and hardscape; and b. The properties to the north and east of the subject site are developed with a shopping center, the property to the south is developed with an office park, and the property to the west is developed with a mixed-use business park; and c. Buildings X and Y are part of the Terra Vista Town Center and were approved as two-story office buildings; and d. The applicant requested to change the approved elevations for Buildings X and Y from a two-story to a single-story building design, and from office to retail use; and PLANNING COMMISSION RESOLUTION NO. 93-89 DR 93-13 DENIAL - WESTERN PROPERTIES October 27, 1993 Page 2 e. The Commission stated that the northeast corner of Foothill Boulevard and Haven Avenue is very important and that the architecture should be of significance; and f. The Commission initially reviewed the new elevations at the meeting on August 11, 1993, and the applicant agreed with the Commission that additional exhibits were necessary to better depict and address the concerns raised by the Commission. The Commission did not find the two buildings, as presented, consistent with the standard set with the original project approval for these two building pads. At that time, the Commission directed the applicant to revise the two single story buildings with a design that matches the same level of sophistication as the approved elevations; and g. At the meeting on August 25, 1993, the Commission found the revised elevations of Building Y to be acceptable but determined that Building X was not. The Commission approved Building Y with the condition that Building X be subject to further Commission review; and h. At the meeting on October 13, 1993, the Commission deliberated on the issue of whether Building X meets the design standards of the center. The Commission agreed that the applicant had tried to address design concerns by adding storefront glass and architectural details to the building but the effect was not successful. The majority of the Commission determined that the proposed scale of Building X does not provide compatibility to Building Y and the design does not have the level of architectural excellence required for a building at this intersection. The Commission, with a majority vote, directed staff to prepare a Resolution of Denial for their adoption at the meeting on October 27, 1993. 3. Based upon the substantial evidence presented to this Commission during the above-referenced meeting and upon the specific findings of facts set forth in paragraphs 1 and 2 above, this Commission hereby finds and concludes as follows: a. That the proposed project is consistent with the objectives of the General Plan; and b. That the proposed project is in accord with the objective of the Terra Vista Planned Community and the purposes of the district in which the site is located; and c. That the architecture of Building X is not consistent with the architectural standards established in the Terra Vista Town Center through Conditional Use Permit 88-12. 4. Based upon the findings and conclusions set forth in paragraphs 1, 2, and 3 above, this Commission hereby denies the application without prejudice.
